FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).
Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.
Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. SPECIAL NOTICES
Notice of Proposed Interim Response under the Hazardous Sites Cleanup Act Keystone Instruments, Inc., Castanea Township, Clinton County The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6029.101—6020.1305), proposes to initiate an interim response at Keystone Instruments, Inc., located in Castanea Township with an address of 320 Proctor Street, Lock Haven, PA 17745.
Keystone Instruments, Inc. consists of a 2-story wood frame building on a concrete slab with exterior dimensions of 32` by 48` on a 47` by 120` (0.13 acre) lot (Site). The Site is located at the W.T. Piper Memorial Airport approximately 150 feet west of the recently HSCA remediated Karnish Instruments Airport Site.
The Site building was constructed in the mid-1960s by Keystone Instruments, Inc. (Keystone) who have been repairing and maintaining aircraft instruments, many of which contained radium paint, at this location to the present time. The Department became aware of Keystone in 2006 when a trash truck hauling waste from the Site triggered a radiation monitoring alarm at the Wayne Township Landfill. Subsequent inspections of the Site conducted with field instruments determined there to be widespread radium contamination in instrument repair areas, in hallways, on stairs, on furniture, tools, and equipment, and on the grounds outside the building. Radium-226 is a radioactive isotope, the use or possession of which requires a license under Pennsylvania regulations. Keystone does not posses and had never applied for a license to operate. Up until recently, Keystone removed radium containing paint using solvents and/or sanding methods before the dials would be repainted using non-radioactive paint. In the most recent days of operating at this location, Keystone no longer removed the radium containing paint, but simply flipped the dials over before repainting.
The Department has worked with Keystone for over two years in an attempt to bring them into compliance with Pennsylvania regulations, and on October 10, 2008 entered into a Consent Order & Agreement (CO&A) that outlined the necessary tasks to accomplish this. Keystone had subsequently notified the Department that they were unable to secure the financial assurance required by the CO&A. After Keystone's failure to adequately characterize radioactive contamination around the exterior of the Site also as required by the CO&A, the Department retained the services of a HSCA funded contractor who from June 29 through July 3, 2009, conducted an exterior characterization survey. Based on these results, an estimated 1,500 cubic feet of radiologically contaminated soil will need to be removed to achieve acceptable exposure levels. On November 9, 2009, we received from Keystone an internal building characterization report. It indicated that readily accessible interior surface contamination has largely been cleaned up and poses minimal risk to workers in the building in its current condition. However, significant radium contamination remains in the walls and floor space due to past flooding and could pose a risk during any future renovation.
The Department's major objective in addressing the Site is to protect the public health and environment by eliminating the health threats posed by exposure to the radium contamination.
To achieve this objective, the Department considered the following alternatives:
Alternative No. 1—No Further Action.
This action would be to conduct no further remedial activities at the Site, leaving it in its current condition.
Alternative No. 2—Soil removal in exterior areas and ''surgical'' removal of contaminated materials inside the building structure.
This alternative involves the excavation of exterior contaminated soils. For building remediation, this option consists of surveying structural surfaces to determine if there is radioactivity above background, marking the areas of contamination on interior surfaces of the building and using surgical demolition to remove the areas identified. A final radiological site survey would be conducted.
Alternative No. 3—Soil removal in exterior areas and complete demolition of the building.
Alternative 3 consists of excavation of contaminated soils. Additionally, the entire structure would be completely demolished. All building debris, including the concrete building slab, and all contaminated soils, including any found beneath the concrete slab, would be sent to a landfill permitted/licensed to accept radiologically contaminated material. A final radiological site survey would be conducted.
The Department's preferred course of action is Alternative No. 3, Soil removal in exterior areas and complete demolition of the building. This was determined to be the response that is the most cost effective, permanent, and protective of human health and the environment. The Department may implement this response before the close of the public comment period if it is determined that prompt action is required to protect the public health or safety or the environment.
All information (documents, technical references, detailed site information, and the like), which was used as the basis for evaluation of alternatives and selection of the proposed interim response action outlined in this notice, is contained in the Administrative Record. Written comments concerning the Department's proposed response action and information in the Administrative Record will be accepted either in person if delivered to the West Third Street office on or before June 11, 2010, or by mail postmarked on or before June 11, 2010, sent to the attention of Denny Wright at 208 West Third Street, Williamsport, PA 17701, or by e-mail sent to dewright@state.pa.us on or before midnight June 11, 2010. All written and oral comments received during the public comment period and the Department's responses, will be placed into the Administrative Record.
The Department is providing this notice under section 506(b) of HSCA. The date of publication of this notice in the Pennsylvania Bulletin initiates the 90-day comment period on the Administrative Record, as provided under HSCA.
Notice of Public Meeting and Public Hearing Keystone Instruments, Inc. Site Castanea Township, Clinton County The Department of Environmental Protection (Department) will conduct a public meeting at 6 p.m. on May 4, 2010, in the Council Chambers at Lock Haven City Hall to discuss the proposed remedial actions at the Keystone Instruments, Inc. site. Staff from the Department's Environmental Cleanup and Radiation Protection programs will make presentations and then answer questions from the public.
The public meeting will be followed by a Department public hearing beginning at 7:30 p.m. during which time citizens will have an opportunity to present oral testimony regarding the proposed remedial actions. Anyone who wishes to present oral testimony during the public hearing may register that evening prior to the hearing. Citizens will have a maximum of 5 minutes each to present testimony. Written testimony of any length also will be accepted. The testimony will be recorded by a court reporter and transcribed into a written document. The Department will respond in writing to all relevant testimony provided during the public hearing.
