JOINT COMMITTEE
ON DOCUMENTS

Resolution 2011-1

Whereas, the Joint Committee on Documents has determined that the appropriation for the printing of the Pennsylvania Code and Bulletin is insufficient to pay current contractual obligations; and

Whereas, the Joint Committee on Documents issued Requests for Proposals for both the Pennsylvania Code and Bulletin and received no responses.

Now, therefore, be it known by Resolution of the Joint Committee on Documents that:

 1. The Committee authorizes the Legislative Reference Bureau to negotiate a renewal of the current contract with Fry Communications:

 As a sole source provider;

 On the basis of drastic reductions in the overall product, including the areas of:

 indexing;

 cross referencing; and

 annotations;

 On the basis of online publication with limited print; and

 On the basis of a maximum annual contract price of $700,000 or such amount as may be approved by the Committee.

 2. The Committee authorizes the Legislative Reference Bureau, if there is no contractor for the Pennsylvania Bulletin or the Pennsylvania Code, or both, or by July 1, 2012, to meet legal requirements relating to publication, printing, and dissemination of the Pennsylvania Bulletin and the Pennsylvania Code as follows:

 As to the Pennsylvania Bulletin, the Bureau will continue to receive deposited material and will

 compile deposited material on a weekly basis;

 prepare a hard copy of the compilation and maintain the hard copy in the Legislative Reference Bureau, the State Law Library, and the Senate Library;

 prepare an electronic version of the compilation available to the public without charge; and

 disseminate the compilation to county law libraries.

 As to the Pennsylvania Code, the Bureau will:

 edit the regulations and surrounding material to engross amendments and effectuate changes required by law;

 prepare an electronic version of the Pennsylvania Code, updated on the most efficient basis possible, considering the need for currency and the need to maintain historical versions;

 prepare, on an annual basis, a hard copy of the Pennsylvania Code and maintain the hard copy in the Legislative Reference Bureau, the State Law Library, and the Senate Library; and

 disseminate the contents of the Pennsylvania Code to county law libraries.
