AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS NEW SOURCES AND MODIFICATIONS

 The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

 The Department received applications for Plan Approvals or Operating Permits from the following facilities.

 Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the regional office listed before the applications. Persons interested in reviewing the application files should contact the appropriate regional office to schedule appointments.

 Persons wishing to receive a copy of a proposed Plan Approval or Operating Permit shall indicate interests to the Department regional office within 30 days of the date of this notice and shall file protests or comments on a proposed Plan Approval or Operating Permit within 30 days of the Department providing a copy of the proposed documents to persons or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that hearings be held concerning a proposed Plan Approval or Operating Permit. A comment or protest filed with the Department regional office shall include a concise statement of the objections to the issuance of the Plan Approval or Operating Permit and relevant facts which serve as the basis for the objections. If the Department schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior the date of the hearing.

 Persons with a disability who wish to comment and require an auxiliary aid, service or other accommodation to participate should contact the regional office listed before the application. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

 Final Plan Approvals and Operating Permits will contain terms and conditions to ensure that the source is constructed and operating in compliance with applicable requirements in 25 Pa. Code Chapters 121—143, the Federal Clean Air Act (42 U.S.C.A. §§ 7401—7671q) and regulations adopted under the Federal Clean Air Act.

This equipment will replace the cupola furnace melting operation.


Intent to Issue Plan Approvals and Intent to Issue or Amend Operating Permits under the Air Pollution Control Act (35 P. S. §§ 4001—4015) and 25 Pa. Code Chapter 127, Subchapter B. These actions may include the administrative amendments of an associated operating permit.

15-0115F: QVC, Inc. (1200 Wilson Drive, West Chester, Pa 19380) for modification of formaldehyde emissions from a replacement 2-MW generator at an existing facility and for updating engine information in West Goshen Township, Chester County. The engine for this generator is a 2009 model. Formaldehyde emissions will increase from a limit of 725 ppmdv, corrected to 15% O2, to 1,106 ppmdv, corrected to 15% O2. The new limit is equivalent to 0.01 TPY of formaldehyde emissions. The Plan Approval will contain recordkeeping and operating restrictions designed to keep the facility operating within the allowable emissions and all applicable air quality requirements.

Southwest Region: Air Quality Program, 400 Waterfront Drive, Pittsburgh, PA 15222-4745

30-00183B: EQT Gathering, LP (225 North Shore Drive, Pittsburgh, PA, 15212) for construction and temporary operation of a natural gas compressor station, known as the Jupiter Station, in Morgan Township, Greene County.

 The facility will contain air contamination sources, consisting of three 2,370-bhp Caterpillar/Ariel 3608 compressor units, one 690-bhp emergency generator, seven tanks, and two triethylene glycol (TEG) dehydration systems. The construction and temporary operation of this equipment, with the exception one 120 MMSCF per day dehydration system was previously authorized under Plan Approval PA-30-00183A. Facility emissions will be 41.78 tons of NOx, expressed as NO2, 14.42 tons of CO, 22.20 tons of VOC, 2.75 tons of formaldehyde, and 13.17 tons of the sum of all hazardous air pollutants, annually. The proposed process units are subject to the applicable requirements of 25 Pa. Code, Chapter 127, related to construction, modification, reactivation and operation of sources, 40 CFR 60 Subpart JJJJ, and 40 CFR 630 Subpart ZZZZ. The Plan Approval contains appropriate emission limitations, testing, monitoring, recordkeeping, reporting requirements, and work practice standards.

 Those who wish to provide the Department with additional written information that they believe should be considered prior to the issuance of this State Only Operating Permit may submit the information to Martin L. Hochhauser, P.E., Pennsylvania Department of Environmental Protection, 400 Waterfront Drive, Pittsburgh, PA, 15222. Each written comment must contain the following:

 Name, address and telephone number of the person submitting the comments,

 Identification of the proposed Plan Approval (specify Plan Approval PA-30-00183B), and

 Concise statements regarding the relevancy of the information or objections to issuance of the Operating Permit.

 All comments must be received prior to the close of business 30 days after the date of this publication. In accordance with Pa. Code Title 25 § 127.428, prior to issuing an operating permit, the Department may hold a fact-finding conference or hearing at which the petitioner, and a person who has properly filed a protest under § 127.426 (relating to filing protests) may appear and give testimony. The Department is not required to hold a conference or hearing. The applicant, the protestant and other participants will be notified of the time, place and purpose of a conference or hearing, in writing or by publication in a newspaper or the Pennsylvania Bulletin, unless the Department determines that notification by telephone will be sufficient.

Northwest Region: Air Quality Program, 230 Chestnut Street, Meadville, PA 16335-3481

20-305A: Crawford Renewable Energy, LLC (Keystone Regional Industrial Park, Greenwood Township, PA 16335 and mailing address of 360 Chestnut Street, Meadville, PA 16335) for construction of a tire-derived-fuel (TDF) fired power generation facility that is designed to generate up to 100 MW gross, 90 MW net of electrical power using circulating fluidized bed boiler (CFB) technology in Greenwood Township, Crawford County. This is a Title V facility. The public notice is required for sources required to obtain a Plan Approval in accordance with 25 Pa. Code § 127.44. This plan approval will, in accordance with 25 Pa. Code § 127.450 or 127.505, be incorporated into the Title V operating permit at a later date.

 In accordance with 25 Pa. Code § 127.44(e)(1), all the pertinent documents regarding CRE's application (applications, review memos, and draft approvals) are also available for review from 8:00 a.m. to 4:00 p.m. at the Meadville Regional DEP office (Air Quality). Appointments for scheduling a review must be made by calling the DEP (814) 332-6340. The information is also available at the Meadville Public Library and Greenwood Township Building. Appointments for scheduling a review must be made with those entities.

 In accordance with 25 Pa. Code § 127.44(e)(2), a 30-day comment period, from the date of publication, will exist for the submission of comments. Any person(s) wishing to provide DEP with additional information, which they believe should be considered prior to the issuance of this permit, may submit the information to Regional Air Quality Program Manager, Pennsylvania Department of Environmental Protection, 230 Chestnut Street, Mead-ville, PA 16335-3494 and must contain the following:

 • Name, address and telephone number of the person submitting the comments

 • Identification of the proposed plan approval [20-305A]

 • A concise statement regarding the relevancy of the information or objections to the issuance of the permit.

 Notice is hereby given pursuant to 25 Pa. Code §§ 127.44(b), 127.45 and 127.48 that the Pennsylvania Department of Environmental Protection (DEP) will hold a public meeting and hearing on Wednesday July 27, 2011, at Conneaut Lake High School located at 10331 US Hwy 6, Conneaut Lake, PA 16316. The meeting will start at 6:30 PM and the hearing will follow the meeting.

 The meeting is to answer questions concerning Crawford Renewable Energy (CRE) application to construct a tire-derived-fuel fired power generation facility that is designed to generate up to 100 MW gross, 90 MW net of electrical power using CFB boiler technology. The Department intends to issue a plan approval for this construction and has submitted the proposed plan approval to U.S. Environmental Protection Agency (EPA) for its review.

 During the hearing, in accordance with 25 Pa. Code §§ 127.48 and 127.49, the Department will accept and record testimony concerning CRE's application. Persons wishing to present testimony at the hearing should contact Community Relations Coordinator Freda Tarbell, (814) 332-6945, at least one week in advance of the hearing to reserve a time to present testimony. Oral testimony during the hearing will be limited to a maximum of five minutes and three written copies of the oral testimony, together with exhibits are required. Organizations are encouraged to designate one witness to present testimony on behalf of the organization. Persons unable to attend the hearing may submit three copies of a written statement and exhibits within 10 days thereafter to the Department in care of Regional Air Quality Program Manager, Department of Environmental Protection, 230 Chestnut Street, Meadville, PA 16335. Written submittals must contain the following:

 • Name, address and telephone number of the person submitting the comments

 • Identification of the proposed plan approval [20-305A]

 • A concise statement regarding the relevancy of the information or objections to the issuance of the permit.

 In accordance with 25 Pa. Code § 127.45, a person may oppose the proposed plan approval by filing a written protest with the Department's Northwest Region.

 If a plan approval has not undergone the above public notice process the change to an operating permit must be treated as a significant modification. In these situations the Department should follow the procedures described in §§ 127.421 to 127.431 for state only operating permits or §§ 127.521 to 127.524 for Title V operating permits.

 The plan approval is for the construction of two CFB boilers operating in parallel with a net generating capacity of 90 megawatts. Other air emission sources at the facility include a totally-enclosed tire shredding and preparation area and material handling operations such as TDF conveyance; limestone, sand, ash & lime storage & handling; anhydrous ammonia handling; wire/metals. Sources also include roadways and a diesel fire pump. Control technology for each CFB will be a TurboSorp scrubber for SOx control (Best Available Control Technology (BACT) and Best Available Technology (BAT)), fabric filter for PM10 & PM2.5 control (BACT and BAT), a Regenerative Selective Catalytic Reduction (RSCR) system for NOx control (Lowest Achievable Emission Rate (LAER), BACT and BAT) and energy efficiency for greenhouse gas (GHG) control (BACT and BAT). Best available technology for other sources will be the control of emissions through inherent low-emitting designs, bin vents filters, or good operating practices.

 This construction will result in facility emissions of less than 854,324 tpy of CO2(e), 691 tpy of CO, 0.034 tpy of lead, 27.7 tpy of VOC, 143 tpy of SOx, 253 tpy of NOx, 53.1 tpy of PM2.5, 99.3 tpy of PM10, 9.9 tpy of a single HAP, and 24.9 tpy of all HAPs combined. The application was reviewed in accordance with Prevention of Significant Deterioration (PSD) and Non-Attainment New Source Review (NSR) requirements. Facility is subject to State and Federal requirements, including 40 CFR 60 Subpart Da & IIII; 40 CFR 63 Subpart JJJJJJ; Acid Rain Regulations (40 CFR 72-78); Clean Air Interstate Rule (CAIR) (40 CFR 96 & 97); Continuous Assurance Monitoring (CAM) (40 CFR 64); Risk Management Program (40 CFR 68—if greater than 20,000 pounds of aqueous ammonia is stored at facility) and Greenhouse Gas Tailoring Rule (GHG) (40 CFR 98). To comply with these requirements, the plan approval contains conditions relating to emission limitations, testing, monitoring, recordkeeping, reporting, work practices, and additional requirements. This Plan Approval will contain conditions, which will satisfy the requirements of 25 Pa. Code § 127.12b (pertaining to plan approval terms and conditions) and will demonstrate BAT for the source including, but are not limited to, the following:

 • Nothing in this plan approval shall relieve the owner or operator from complying with any local zoning ordinances.

 • Emission Reduction Credit Requirements

 • The permittee shall secure 291 tons of NOx ERCs. ERCs shall be properly generated and certified by the Department. Upon transfer, the permittee shall provide the Department with documentation clearly specifying the details of the ERC transaction. The 291 tons of ERCs was determined by the facility NOx PTE of 252.958 times the offset of 1.15. The facility NOx PTE is 252.95 tpy for the boilers and 0.008 tpy for the fire pump.

 • CFB Boilers (Source 031 & 032)

 • No person may permit the emission into the outdoor atmosphere of the following in a manner that exceeds the following:

 • Particulate Matter (PM) - 0.02 #/mmbtu

 • Particulate Matter 10 (PM-10) - 0.02 #/mmbtu

 • Particulate Matter 2.5 (PM-2.5) - 0.01 #/mmbtu

 • Sulfur Oxides (SOx) - 0.031 #/mmbtu

 • Nitrogen Oxides (NOx) - 0.055 #/mmbtu

 • Carbon Monoxide (CO) - 0.15 #/mmbtu

 • Lead (Pb) - 7.17 x 10^-6 #/mmbtu

 • Volatile Organic Compounds (VOC) - 0.006 #/mmbtu

 • Ammonia Slip (NH3 Slip) - 10 ppmv, on a dry basis corrected 7% oxygen, averaged over any rolling 1-hour period at stack conditions.

 • Hydrogen Chloride (HCl) - 0.002 #/mmbtu

 • Sulfuric Acid (H2SO4) - 0.0022 #/mmbtu

 • Dioxins / Furans - 7.7 x 10^-10 #/mmbtu

 • Mercury (Hg) - 3.27 x 10^-7 #/mmbtu

 • A person may not permit the emission into the outdoor atmosphere of visible air contaminants in such a manner that the opacity of the emission is either of the following:

 • Equal to or greater than 10% for a period or periods aggregating more than 3 minutes in any 1 hour.

 • Equal to or greater than 30% at any time.

 • All emission limitations (except for opacity) are measured at 7 percent oxygen, dry conditions.

 • All emission limitations (except for opacity) are 3-hour averages unless otherwise noted.

 • No person may permit the emission into the outdoor atmosphere of the following in a manner that exceeds the following for each boiler:

 • Particulate Matter (PM) - 45.99 tpy based on 12-month rolling totals

 • Particulate Matter 10 (PM-10) - 45.99 tpy based on 12-month rolling totals

 • Particulate Matter 2.5 (PM-2.5) - 23.0 tpy based on 12-month rolling totals

 • Sulfur Oxides (SOx) - 71.49 tpy based on 12-month rolling totals

 • Nitrogen Oxides (NOx) - 126.48 tpy based on 12-month rolling totals

 • Carbon Monoxide (CO) - 344.93 tpy based on 12-month rolling totals

 • Lead (Pb) - 0.0165 tpy based on 12-month rolling totals

 • Volatile Organic Compounds (VOC) - 13.8 tpy based on 12-month rolling totals

 • Hydrogen Chloride (HCl) - 4.6 tpy based on 12-month rolling totals

 • Sulfuric Acid (H2SO4) - 5.06 tpy based on 12-month rolling totals

 • Dioxins / Furans - 0.0035 lbs/yr based on 12-month rolling totals

 • Mercury (Hg) - 1.5 lbs/yr based on 12-month rolling totals

 • The TDF shall meet the ASTM Active Standard D6700-01 Standard Practice for Use of Scrap Tire Derived Fuel.

 • The facility shall perform an initial stack test for PM, PM10 (filterable & condensable), PM2.5 (filterable & condensable), NOx, SOx, CO, mercury, lead, VOC, ammonia slip, hydrogen chloride, sulfuric acid, and dioxins/furans in accordance with the provisions of Chapter 139 of the Rules and Regulations of the Department of Environmental Protection.

 • The facility shall perform an annual stack test for PM, PM10 (filterable & condensable), PM2.5 (filterable & condensable), NOx, SOx, CO, mercury, lead, VOC, ammonia slip, hydrogen chloride, sulfuric acid, and dioxins/furan. The facility may petition the Department, after three (3) years, to reduce the frequency of testing.

 • Within twelve (12) to eighteen (18) months prior to the expiration of the facility operating permit, a stack test for PM, PM10 (filterable & condensable), PM2.5 (filterable & condensable), NOx, SOx, CO, mercury, lead, VOC, ammonia slip, hydrogen chloride, sulfuric acid, and dioxins/furans shall be performed.

 • The following conditions are related to CAM:

 • The permittee shall use the approved process parameter(s) or indicator(s) to obtain data and monitor the emission control equipment performance. A departure from the specified indicator range over a specified averaging period shall be defined as an excursion.

 • Circulating Fluidized Bed Scrubber

 • Pressure Drop: Pressure gauges or equivalent - continuously meaning a reading at least once every 15-minutes averaged over a 3-hour period

 • Scrubber gas flow rate: Flow meters or equivalent - continuously meaning a reading at least once every 15-minutes averaged over a 3-hour period

 • Baghouse

 • Pressure Drop: Pressure gauges or equivalent - continuously meaning a reading at least once every 15-minutes averaged over a 3-hour period

 • Baghouse Temperature: 300 F maximum at inlet - Thermocouple or equivalent - continuously meaning a reading at least once every 15-minutes averaged over a 3-hour period

 • Bag Leak Detection Signals: Bag Leak Detection Signals

 • Regenerative SCR

 • Ammonia Injection rate (lbs/hr): Flow meter or equivalent - continuously meaning a reading at least once every 15-minutes averaged over a 3-hour period

 • pH level: pH meter or equivalent - continuously meaning a reading at least once every 15-minutes averaged over a 3-hour period

 • Catalyst temperature (F): 570 to 800F - thermocouple or equivalent - continuously meaning a reading at least once every 15-minutes averaged over a 3-hour period

 • The following conditions are related to CEMs:

 • The following continuous emission monitoring system[s] (CEMS[s]) must be installed, approved by the Department, operated and maintained in accordance with the requirements of 25 Pa. Code Chapter 139, Subchapter C (relating to requirements for source monitoring for stationary sources) and the 'Submittal and Approval', 'Record Keeping and Reporting', and 'Quality Assurance' requirements of Revision No. 8 of the Department's Continuous Source Monitoring Manual, 274-0300-001 and the Technical Guidance Pertaining to Continuous Source Monitoring Systems for Mercury, 274-0300-006. Compliance with any subsequently issued revision to the Continuous Source Monitoring Manual or Technical Guidance Pertaining to Continuous Source Monitoring Systems for Mercury will constitute compliance with this permit condition.

 • CEMS #1: CO (lbs/mmbtu)

 • CEMS #2: NOx (lbs/mmbtu)

 • CEMS #3: SO2 (lbs/mmbtu)

 • CEMS #4: Opacity (%)

 • CEMS #5: Mercury (lbs/mmbtu and oz/hr)

 • CEMS #6: PM (lbs/mmbtu)

 • CEMS #7: CO2 [short tons per MW-hr (gross)]

 • The facility shall monitor Gross Electrical Output (Mwhs, using a CEMS) in order to comply with the CO2 emission standard.

 • The following conditions are related to GHG:

 • No person may permit the emission into the outdoor atmosphere of the following in a manner that exceeds the following:

 • GHG emission rate of 97.52 tph (88.52 metric tph) and 854,324 tpy (775,555 metric tpy) based on a 12-month rolling total where GHG emissions are CO2(e).

 • GHG emission rate based on net plant output of 90 MW: 1.08 short tons per MW-hr (net) and 0.984 metric tons per MW-hr (net) where GHG emissions are CO2(e).

 • GHG emission rate based on gross plant output of 98 MW: 0.99516 short tons per MW-hr (gross) and 0.9034 metric tons per MW-hr (gross) where GHG emissions are CO2(e).

 • Carbon neutral GHG emission rate of 78.72 tph (71.46 metric tph) and 689,578 tpy (626,007 metric tpy) based on a 12-month rolling total where carbon neutral GHG emissions are CO2(e).

 • Carbon neutral GHG emission rate based on net plant output of 90 MW: 0.874 short tons per MW-hr (net) and 0.794 metric tons per MW-hr (net) where carbon neutral GHG emissions are CO2(e).

 • Carbon neutral GHG emission rate based on gross plant output of 98 MW: 0.803 short tons per MW-hr (gross) and 0.729 metric tons per MW-hr (gross) where carbon neutral GHG emissions are CO2(e).

 • Carbon neutral GHG emission rate is defined in this condition as the GHG emission rate minus the biomass fraction emission rate.

 • The following conditions are related to modeling/risk management:

 • The operation of the CFB boilers shall at no time result in the emission of the following contaminants at rates exceeding the limits identified in pounds per hour and verified by annual stack testing:

 • Arsenic: 2.53E-04

 • Cadmium: 4.20E-04

 • Chromium VI: 2.73E-04

 • Cobalt: 9.939E-03

 • Copper: 1.595E-02

 • Lead: 7.5E-03

 • Manganese: 2.59E-03

 • Nickel: 1.82E-03

 • Zinc: 3.19E-01

 • Formaldehyde: 1.785E-01

 • Chlorine: 1.4E-03

 • Hydrogen chloride: 2.1

 • Hydrogen bromide: 1.71

 • * The Department may modify this list, and the frequency of stack testing, based upon the stack test results.

 • Within 180 days after commencement of operation, a stack test shall be conducted to verify that the emission rates for each of the compounds included in the risk assessment are lower than the estimated emission rates used in the risk assessment portion of the plan approval application.

 • Within ninety (90) days of receiving approval from the Department on the acceptability of the stack test results, the permittee shall perform the risk assessment using the stack test emission rates, the exhaust parameters from each test, and the dispersion modeling techniques as approved by the Department for all compounds submitted to the Department for approval.

 • Silos (Source 101):

 • The PM-10 emissions from the silos shall not exceed the following:

 • Hydrated Lime Silo #1 & 2: 0.000535 #/day or 0.005 gr/dscf whichever is more stringent

 • Hydrated Lime Silo #1 & 2: 0.0000975 tpy based on a 12-month rolling total

 • Fly Ash Silo: 0.064 #/hr or 0.005 gr/dscf whichever is more stringent

 • Fly Ash Silo: 0.282 tpy based on a 12-month rolling total

 • Bottom Ash Silo #1 & 2: 0.0091 #/hr or 0.005 gr/dscf whichever is more stringent

 • Bottom Ash Silo #1 & 2: 0.04 tpy based on a 12-month rolling total

 • The PM-2.5 emissions from the silos shall not exceed the following:

 • Hydrated Lime Silo #1 & 2: 0.0004 #/day or 0.00375 gr/dscf whichever is more stringent

 • Hydrated Lime Silo #1 & 2: 0.000074 tpy based on a 12-month rolling total

 • Fly Ash Silo: 0.048 #/hr or 0.00375 gr/dscf whichever is more stringent

 • Fly Ash Silo: 0.201 tpy based on a 12-month rolling total

 Dispersion modeling was conducted for the proposed CRE facility with representative emission source data, terrain data, and meteorological data. The impacts of the emissions of carbon monoxide, nitrogen dioxide, particulate matter less than 2.5 micrometers, particulate matter less than 10 micrometers, and sulfur dioxide from the proposed facility are estimated by modeling to be less than the significant impact levels established by the U.S. EPA; therefore, it is estimated by modeling that these emissions from the proposed facility will not cause or significantly contribute to air pollution in violation of the National Ambient Air Quality Standards or PSD increment standards.

25-066I: Accuride Corp. (1015 East 12th Street, Erie, PA 16503) for modification of pressure drop requirements associated with two (2) existing wet scrubbers in the City of Erie, Erie County.

 Notice is hereby given, pursuant to 25 Pa. Code Sections 127.44(a) and 127.424(b), that the Pennsylvania Department of Environmental Protection (DEP) has received and intends to issue a Plan Approval to for their facility located in the City of Erie, Erie County. 03-00194: Glacial Sand and Gravel Co.—Tarrtown Barge Unloading Facility (133 Camp Ground Road, Harrisville, PA 16038) for operation of a barge unloading and bulk commodity storage in East Franklin Township, Armstrong County. In accordance with 25 Pa Code §§ 127.424 and 127.425 the Department of Environmental Protection (DEP) has received an application and intends to issue an Air Quality Operating Permit for the above mentioned facility.

 The subject facility consists of unloading barges with a clam shell, two diesel engines, hopper and stockpiling. The diesel engines are used to power the clam shell and are rated at 525 hp and 250 hp. The facility has the potential to emit: 1.39 tpy CO; 6.44 tpy NOx; 0.43 tpy SOx; 0.52 tpy VOC; 1.73 tpy PM; and 1.01 tpy PM10. The facility is required to conduct weekly surveys of the site for fugitive emissions and malodors, minimize drop height of clam shell, and must take all actions to prevent particulate matter from becoming airborne. MINING ACTIVITY NPDES DRAFT PERMITS

 This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accord-ance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.

Effluent Limits for Coal Mining Activities

 For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

 The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

 In addition, the Department imposes a technology-based aluminum limit of 2.0 mg/l (30 day average) to protect stream uses.

 A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

 Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

 The BAT limits for noncoal mining activities as provided in 40 CFR Part 436 and 25 Pa. Code Chapters 77 are as follows:

 Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

 In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.

 More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).

 The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 362-0600-001, NPDES Program Implementation-Memorandum of Understanding (MOU) Concerning Water Quality Management, NPDES Program Implementation, and Related Matters. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.

 Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.

 Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

 The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public notice and contain the name, address, telephone number and the interest of the party filing the request, and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.
