Excess Home Equity Limit for Individuals Applying for or Receiving Medical Assistance and Payment of Long-Term Care Services

[Saturday, September 24, 2011]The Department of Public Welfare increased the excess home equity limit described in 55 Pa. Code §§ 178.62a and 178.104b (relating to clarification of disqualification for payment of long-term care services due to substantial home equity—statement of policy; and clarification of fair consideration provisions for disposition of assets made on or after February 8, 2006—statement of policy). These statements of policy provide guidance for determining disqualification for payment of long-term care services due to excess home equity. These standards are required to be published annually in the Pennsylvania Bulletin and are available to the public upon request at the local County Assistance Office.
The following limit became effective January 1, 2011, as required by section 6014(f)(1)(C) of the Deficit Reduction Act of 2005 (42 U.S.C.A. § 1396p(f)(1)(C)):

Fiscal Impact
It is anticipated that there will be no fiscal impact.
