NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR
NPDES PERMITS FOR CAFOsThe State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

PUBLIC WATER SUPPLY (PWS) PERMITS Under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1—721.17), the following parties have applied for PWS permits to construct or substantially modify public water systems.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995
PREAMBLE 1
Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907)
Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.
For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office listed before the notice. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Besecker Excavating and Paving, Inc., 2701 Hamilton E. Street, Hamilton Township, Monroe County. David Everitt and Mark Ellis, MEA, Inc., 1365 Ackermanville Road, Bangor, PA 18013 have submitted a Notice of Intent to Remediate (on behalf of their client, William Besecker, 1211 Bush Road, Cresco, PA 18326), concerning the remediation of soil found to have been impacted by No 2 fuel oil as a result of a release from a 1,000-gallon underground storage tank, which had a broken return line. The applicant proposes to remediate the site to meet the Residential Statewide Health Standard for soil. The proposed future property use will be residential. AIR QUALITY
PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS NEW SOURCES AND MODIFICATIONS The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.
The Department received applications for Plan Approvals or Operating Permits from the following facilities.
Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the regional office listed before the applications. Persons interested in reviewing the application files should contact the appropriate regional office to schedule appointments.
Persons wishing to receive a copy of a proposed Plan Approval or Operating Permit shall indicate interests to the Department regional office within 30 days of the date of this notice and shall file protests or comments on a proposed Plan Approval or Operating Permit within 30 days of the Department providing a copy of the proposed documents to persons or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that hearings be held concerning a proposed Plan Approval or Operating Permit. A comment or protest filed with the Department regional office shall include a concise statement of the objections to the issuance of the Plan Approval or Operating Permit and relevant facts which serve as the basis for the objections. 67-05009C: York Plant Holding, LLC (P. O. Box 3492, York PA 17402) for construction of two simple cycle combustion turbines at their facility in Springettsbury Township, York County.
In accordance with 25 Pa. Code §§ 127.44(a) and 127.45(a), the Department of Environmental Protection (DEP) has received and intends to issue a Plan Approval to the abovementioned company for the abovementioned project. This plan approval may be incorporated into the company's facility-wide permit via an administrative amendment at a later date.
67-05009C is for the construction and temporary operation of two new combustion turbines. The construction of two simple cycle turbines includes the following major equipment:
a. Two simple cycle turbines—between 41.3—61.5 MW gross output each.
b. Two selective catalytic reduction (SCR) systems.
c. Two catalytic oxidizer systems.
d. One 300,000 gallons distillate fuel oil tank.
e. One 15,000 gallon tank to hold a 19% solution of aqueous ammonia for the SCR system.
f. One 200,000 gallon demineralized water tank
Nitrogen oxide (NOx) emissions from the turbines will be controlled by water injection and SCR. Carbon monoxide (CO) and volatile organic compound (VOC) emissions will be controlled by good combustion practices and catalytic oxidizers. Particulate (PM/PM10/PM2.5) and Sulfur oxide (as SO2) emissions will be controlled by combusting natural gas or ultra low sulfur distillate oil.
The company shall be subject to and shall comply with 25 Pa. Code, Chapter 127, Subchapter D (Prevention of Significant Deterioration of Air Quality), 40 CFR Part 60 Subpart KKKK—Standards of Performance for Stationary Combustion Turbines, Acid Rain, Cross State Transport Rule and Best Available Technology (BAT) requirements pursuant to 25 Pa. Code, Section 127.1.
The Plan Approval and Operating permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.
The expected potential air emission increases from the proposed project are as follows:

• A concise statement regarding the relevancy of the information or objections to the issuance of the permit.

A public hearing may be held, if the Department of Environmental Protection, in its discretion, decides that such a hearing is warranted based on the comments received. The Department will give notice of any scheduled public hearing at least thirty days in advance of the hearing. The hearing notice will be published in the Pennsylvania Bulletin and a newspaper of general circulation where the facility is located.

67-05004P: P.H. Glatfelter Co. (228 South Main Street, Spring Grove, PA 17362-0500) for a retrospective Prevention of Significant Deterioration (PSD) application for the No. 6 Turbine Generator project at their facility in spring Grove Borough, York County.
In accordance with 25 Pa. Code §§ 127.44(a) and 127.45(a), the Department of Environmental Protection (DEP) has received and intends to issue a Plan Approval to the abovementioned company for the abovementioned project. This plan approval may be incorporated into the company's facility-wide permit via an administrative amendment at a later date.
Plan Approval No. 67-05004P is the retrospective PSD Application for the No. 6 Turbine Generator (TG6) project. In the summer of 1994, Glatfelter made a physical change to the Mill by installing the No. 6 Turbine Generator (TG6). The 39.14 MW turbine started operating in December 1994. No existing emission units were modified during the TG6 project. Since Glatfelter did not obtain a Plan Approval prior to the installation & operation of TG6, a Notice of Violation was issued in September 1999. On October 25, 2004, Glatfelter and the Department entered into a Consent Order Agreement (COA). The COA required Glatfelter to install a selective non-catalytic reduction (SNCR) system on Power Boiler No. 5 and required them to submit a Prevention of Significant Deterioration (PSD) Plan Approval Application. The Plan Approval will establish new SOx limits to ensure compliance with the NAAQS for the following sources: ID 103—Fluo-Solids Calciner and ID 110—Smelt Dissolving Tank.
Copies of the application, DEP's analysis and other documents used in the evaluation of the application are available for public review during normal business hours at Air Quality Program, 909 Elmerton Avenue, Harrisburg, PA 17110.

57-00004A: Central New York Oil & Gas, LLC (800 Robinson Road, Owego, NY 13827) for a plan approval to construct a natural gas compressor station incorporating an 8,180 horsepower natural gas-fired compressor engine and a 6,315 natural gas-fired compressor engine at a site located in Davidson Township, Sullivan County. The respective facility is a state only (natural minor) facility for which a state only operating permit has not been issued.
The Department's review of the information submitted by Central New York Oil & Gas, LLC indicates that construction of the natural gas compressor station will meet all applicable air quality regulatory requirements pertaining to air contamination sources and the emission of air contaminants. Based on these findings, the Department intends to issue a plan approval for the construction of the station. Additionally, if the Department determines the station is operating in compliance with all plan approval conditions, the conditions established in the plan approval will be incorporated into a state only (natural minor) operating permit.
The following is a summary of the conditions that the Department proposes to place in the plan approval to be issued to ensure compliance with all applicable regulatory requirements:
1. The air contaminant emissions from the 8,180 horsepower Caterpillar model G16CM34 compressor engine shall not exceed the following limitations:
• nitrogen oxides (NOx, expressed as NO2)—0.50 grams per brake horsepower-hour, 9.02 pounds per hour and 39.50 tons in any 12 consecutive month period.
• carbon monoxide—0.24 grams per brake horsepower-hour, 4.29 pounds per hour and 18.80 tons in any 12 consecutive month period.
• volatile organic compounds—0.15 grams per brake horsepower-hour, 2.71 pounds per hour and 11.85 tons in any 12 consecutive month period.
• sulfur oxides—(SOx, expressed as SO2)—0.03 pounds per hour and 0.14 tons in any 12 consecutive month period.
• particulate matter/PM-10—0.54 pounds per hour and 2.38 tons in any 12 consecutive month period.
• hazardous air pollutants (including formaldehyde)—1.13 pounds per hour and 4.94 tons in any 12 consecutive month period.
• formaldehyde—0.034 grams per brake horsepower-hour, 0.61 pounds per hour and 2.65 tons in any 12 consecutive month period.
2. The air contaminant emissions from the 6,135 horsepower Caterpillar model G12CM34 compressor engine shall not exceed the following limitations:
• nitrogen oxides (NOx, expressed as NO2)—0.50 grams per brake horsepower-hour, 6.76 pounds per hour and 29.60 tons in any 12 consecutive month period.
• carbon monoxide—0.24 grams per brake horsepower-hour, 3.22 pounds per hour and 14.10 tons in any 12 consecutive month period.
• volatile organic compounds—0.15 grams per brake horsepower-hour, 2.03 pounds per hour and 8.89 tons in any 12 consecutive month period.
• sulfur oxides—(SOx, expressed as SO2)—0.02 pounds per hour and 0.11 tons in any 12 consecutive month period.
• particulate matter/PM-10—0.41 pounds per hour and 1.78 tons in any 12 consecutive month period.
• hazardous air pollutants (including formaldehyde)—0.84 pounds per hour and 3.68 tons in any 12 consecutive month period.
• formaldehyde—0.034 grams per brake horsepower-hour, 0.45 pounds per hour and 1.99 tons in any 12 consecutive month period.
3. The oxidation catalysts shall be equipped with instrumentation to continuously monitor the differential pressure and outlet temperature of the catalyst.
4. The permittee shall keep a maintenance plan for the compressor engines and shall, to the extent practicable, maintain and operate the engines in a manner consistent with good air pollution control practice for minimizing emissions.
5. The air contaminant emissions from the 1,450 horsepower (1,025 kilowatt) Dresser Waukesha model L5794LT emergency generator engine shall not exceed the following limitations:

This construction of the additional hydrogen selenide production process (Train 4) and associated controls will result in annual emission increase of 0.483 tpy for VOC and 0.00017 tpy for HAPs. This Plan Approval will contain conditions, which will satisfy the requirements of 25 Pa. • The air pollution control devices (C121) used shall be designed to reduce process outlet concentrations to atmospheric emissions of 25 ppb or less of hydrogen selenide. The emergency vent scrubber (C103C) shall be designed to reduce process outlet concentrations to atmospheric emissions of 500 ppb or less of hydrogen selenide.
• The facility shall monitor the pH for the scrubber solution and the pressure drop across each of the scrubbers on a weekly basis (at a minimum). This condition refers to the H2SE #4 A & B Scrubber & Carbon Bed System (C121).
• The facility shall monitor the pH for the scrubber solution and the pressure drop across the scrubber, daily, whenever it is in operation. This condition refers to the emergency vent scrubber (C103C).
• The company shall monitor and record on a quarterly basis, the concentration of Hydrogen Selenide in the stack exhaust gases while the sources are operating at maximum rated capacity as stated in the application. A Hydrogen Selenide length of stain detector tube (Type S direct reading type or equivalent) shall be utilized to monitor the emission concentrations. The minimum sensing limit for this method is 0.500 ppm (500 ppb). Results in excess of the minimum sensing limit shall be reported to the Department on a quarterly basis. The report shall include the date of the excess emissions and the reason for the excess emissions.
• The company shall maintain a log of all preventative maintenance inspections of the sources and control devices. The inspection logs, at a minimum, shall contain the dates of the inspections, any potential problems or defects that were encountered, and the steps taken to correct them.
• The company shall maintain a log of the following, at a minimum, from the operational inspections:
o Pressure drop across the scrubbers
o pH of the scrubber solution
• The permittee shall perform a weekly operational inspection of the control devices (C121).
• The permittee shall perform a daily operational inspection of the control device (C103C) when it is being used for emergency venting purposes.
• The control device (C103C) shall be automatically activated upon detection of hydrogen selenide gas leak inside the hoods enclosing the existing DH process trains (Hoods #1 and #2 and #3), the proposed DH process trains (Hoods #4), the existing Cold Vault Storage room (Hood #6), and the existing Gas Transfer Process (Hood #5).
• The permittee shall adhere to the approved indicator range for the scrubber so that operation within the range shall provide reasonable assurance of compliance. A departure from the specified indicator range over a specified averaging period shall be defined as an excursion. The approved indicator range shall be determined by the manufacturer specifications, or developed during the initial ninety (90) day shakedown period, or developed during the initial performance test and any subsequently approved performance tests. The initial indicator range will be the following:
o Pressure drop: 1.0 to 5.0 inches water
o pH: 12 or greater
• Within 24-hours of discovery of a reading outside of the prescribed range, the permittee shall perform a maintenance inspection on the control device and take corrective action. In the event of more than one documented excursion outside the prescribed range in any calendar quarter the permittee shall submit a corrective measure plan to the Department. Corrective measures may include an increase of the frequency of required preventative maintenance inspections of the control device, a modification of the prescribed range, or other appropriate action as approved by the Department. Upon receipt of a corrective measure plan the Department shall determine the appropriate corrective measure on a case-by case basis.
• The permittee shall operate the control device(s) at all times that the source is in operation.
• The company shall maintain and operate the sources and control devices in accordance with the manufacturer's specifications and in accordance with good air pollution control practices.

• The permittee shall adhere to the approved indicator range for the baghouse so that operation within the range shall provide reasonable assurance of compliance. In accordance with 25 Pa Code §§ 127.424 and 127.425 the Department of Environmental Protection (DEP) intends to issue a State Only Operating Permit (SOOP) renewal to Reaxis Inc. to authorize the continued operation of a inorganic tin compounds manufacturing facility at their McDonald Plant located in Robinson Township, Washington County. The facility consists of a boiler, two reactors, three evaporators, a stannous chloride hammer mill, storage tanks, three scrubbers and other miscellaneous equipment associated with this type of operations.
The facility's potential to emit SO2, NOx, PM10, VOCs and HAP are well below their respective major emission thresholds. The proposed SOOP renewal contains conditions relating to monitoring, recordkeeping and work practice standards.

Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application and request for Section 401 water quality certification application may be submitted by any person or any officer or head of any Federal, state or local government agency or authority to the Department at the address of the district mining office indicated before each application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34.
Written comments or objections regarding a mining permit application should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.
A request for an informal conference or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 or § 86.34, must contain the name, address and telephone number of the requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.
