THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications concern, but are not limited to, discharges regarding industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFO). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 Individual Permits and Individual Stormwater Construction Permits in Sections IV and VI, the Department, based upon preliminary reviews, has made tentative determinations of proposed effluent limitations and other terms and conditions for the permit applications. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the United States Environmental Protection Agency (EPA) Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).
Persons wishing to comment on NPDES applications are invited to submit statements to the contact office noted before the application within 30 days from the date of this public notice. Persons wishing to comment on WQM permit applications are invited to submit statements to the office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests for public hearings on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

Description of Proposed Activity: Renewal of NPDES permit to discharge treated groundwater from on-site recovery wells to an unnamed tributary to Stony Creek. There are no longer manufacturing operations at the site, and all materials have been removed from outside and inside the facility. The only activity is the continuing groundwater cleanup which resulted from a TCE spill in the 1980s.
The receiving stream, an unnamed tributary to Stony Creek, is in the State Water Plan watershed 3F and is classified for: trout stocking, aquatic life, water supply, and recreation. The nearest downstream public water supply intake for PA America Water Company is located on the Schuylkill River and is approximately 4.4 miles below the point of discharge.
The proposed effluent limits for Outfall 001 are based on a design flow of 0.016 mgd.

Application No. PA0261521, Concentrated Animal Feeding Operation (CAFO), William and Karol Wingert, 5497 Shade Lane, Alexandria, Pennsylvania 16611.
William and Karol Wingert have submitted an application for an Individual NPDES permit for an existing CAFO known as Wingert Farms, located at Porter Township in Huntingdon.
The CAFO is situated near Frankstown Branch of the Juniata River in Watershed 11-A, which is classified for warm water fishery. The CAFO is designed to maintain an animal population of approximately 1,168.9 animal equivalent units (AEU) consisting of 716 cows and 676 heifers/calves. Manure is collected and stored in an aboveground glass-lined metal slurry store stank. A release or discharge to waters of the Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 25-year, 24-hour storm event.
The Department has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations, the Department has made a tentative determination to issue an NPDES permit for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the permit.
