THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS

 This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications concern, but are not limited to, discharges regarding industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFO). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 For NPDES renewal applications in Section I, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements.

 For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 Individual Permits and Individual Stormwater Construction Permits in Sections IV and VI, the Department, based upon preliminary reviews, has made tentative determinations of proposed effluent limitations and other terms and conditions for the permit applications. These determinations are published as proposed actions for comments prior to taking final actions.

 Unless indicated otherwise, the United States Environmental Protection Agency (EPA) Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).

 Persons wishing to comment on NPDES applications are invited to submit statements to the contact office noted before the application within 30 days from the date of this public notice. Persons wishing to comment on WQM permit applications are invited to submit statements to the office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

 The Department will also accept requests for public hearings on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

PA0005037-A1, SIC Code 4911, EME Homer City Generation LP, 1750 Power Plant Road, Homer City, PA 15748-8009. Facility Name: EME Homer City Generating Station. This existing facility is located in Center Township, Indiana County.

 Description of Existing Activity: The application is to amend the NPDES permit for discharges associated with the residual waste landfill, cooling tower blowdown system and make up water treatment system. In addition, changes to the previously noticed proposed NPDES amendment associated with the coal combustion waste landfill expansion are included. Only changes to the previously noticed draft are being included and subject to the public comment period.

 The receiving streams are an Unnamed Tributary of Blacklick Creek, Unnamed Tributary of Muddy Run, Unnamed Tributary of Two Lick Creek all classified as Cold Water Fishes, aquatic life, water supply and recreation and Two Lick Creek, classified as Trout Stocking, aquatic life, water supply and recreation. All streams are located in State Water Plan watershed 18-D. The discharge is not expected to affect public water supplies.

 This proposed facility is located in South Abington Township, Lackawanna County, PA.

 Description of Proposed Action/Activity: This Project involves replacing and upgrading approximately 1600 feet of the Authority's main interceptor sewer. The existing 18-inch diameter line will be replaced with a new 30-inch diameter line with a peak instantaneous flow capacity of 22.12 million gallons per day.

 Description of Proposed Action/Activity: This Project involves replacing the existing 0.050 MGD wastewater treatment plant at Penn State's Wilkes-Barre campus. The new plant will include flow equalization, fine screening, a membrane bioreactor activated sludge system and ultraviolet disinfection.
