FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

PA DOT Engineering District 3-0 proposes to replace a single span concrete encased steel I-beam bridge with a single span Steel Pipe Arch. The existing structure has a normal span of 12 Ft., Skew of 90°, an underclearance of 9.0 Ft. and a low chord elevation of 450.80 Ft. The proposed structure has a normal span of 14.17 Ft., Skew of 90°, an underclearance of 7.5 Ft. and a low chord elevation of 450.60 Ft. The proposed structure will be located on the same horizontal and vertical alignment. Both the existing and proposed structures will have a paved concrete flow line. The stream impact from the proposed structure will be 85.8 Ft, which is beyond the limits of the General Permit 11. The project will temporarily impact 0.03 acre of jurisdictional wetland. This project will not require mitigation. The project is located over an Unnamed Tributary to the Susquehanna River (WWF). The project is located in Shamokin Dam Borough, Snyder County. Correction. PA DOT Engineering District 3-0 proposes to repair the roadway side slope adjacent to Elk Lick Creek. The roadway side slope will consist of 2:1 Rip Rap and Fill slope for approximately 470 Ft. Approximately 249 Linear Feet of Elk Lick Creek will be relocated to accommodate the new roadway side slope. The project will also impact approximately 1,635 Ft of Unnamed Tributaries to Elk Lick Creek for drainage improvements. The project will construct approximately 1,139 Ft of channel for the Unnamed Tributaries. The project will include the construction of log habitat structures and tree plantings as mitigation. The project will permanently impact 0.01 acre of jurisdictional wetlands and does not require mitigation. Elk Lick Creek is classified as Exceptional Value Cold Water Fishery by Title 25, Chapter 93 Water Quality Standards.

PA DOT Engineering District 3-0 proposes to stabilize a slope failure adjacent to the Tioga River at the Tioga Reservoir in Tioga Township, Tioga County. The project includes the placement of approximately 6,000 cubic yards of fill in the floodway to act as a counter berm to stabilize the slope and the excavation of approximately 6,000 cubic yards of material to offset the fill. Approximately, 360 ft. of stormwater drainage will be relocated at the toe of slope. Approximately 460 driven steel piles will be driven in the footprint of the old SR 0015 roadway. Tioga River is classified as a Cold Water Fishery by Title 25, Chapter 93 Water Quality Standards. The project will not result in any wetland impacts.

Applicant proposes to permanently affect a total of approximately 2,274 linear feet (LF) of various watercourses and 0.74 acre of wetland, and to temporarily affect a total of approximately 1,167 LF of various watercourses and 0.384 acre of wetland, in association with the widening and reconstruction of the Pennsylvania Turnpike (Interstate 70/76), between milepost (MP) 43.56 and MP 47.07. This construction activity is one (1) of eight (8) subprojects that is associated with a total reconstruction of a portion of the PA Turnpike, between MP 39 and 47, between the Butler Valley and Allegheny Valley Interchanges (a.k.a. the PTC 40-48 Project). Water Obstruction and Encroachment Permits have already been issued for two (2) of the other subprojects (i.e. Permit Nos. E02-1651 and GP070211202), and a separate application is currently under review for another subproject (i.e. DEP File No. E02-1669). The structures and activities requiring authorization for the current subproject (a.k.a. the Mainline East Subproject) include, but are not limited to, the following (impact values are approximate):
1. Extend and maintain a 18` x 9`-6" arch culvert in Blue Run (CWF) by 105 linear feet (LF),
2. Extend and maintain a 56` x 26` R.C. arch Bridge in Deer Creek (CWF) by 51 LF,
3. Extend and maintain a 8` x 5` R.C. box culvert in UNT-8 to Deer Creek (CWF) by 62 LF,
4. Extend and maintain a 36" R.C. pipe in UNT-12 to Deer Creek (CWF) by 31 LF,
5. Extend and maintain a 48" R.C. pipe in UNT-14 to Deer Creek (CWF) by 105 LF,
6. Extend and maintain a 36" R.C. pipe in UNT-16 to Deer Creek (CWF) by 19 LF,
7. Extend and maintain a 24" R.C. pipe in UNT-17 to Deer Creek (CWF) by 20 LF,

14. Replace, widen and maintain an existing bridge in Deer Creek (WWF) with 42 LF of 125`-4.5" X 152"-0" single span bridge,
15. Extend and maintain a 54" RC pipe in UNT-26 to Deer Creek (WWF) by 77 LF,
16. Extend and maintain a 54" RC pipe in UNT-28 to Deer Creek (WWF) by 14 LF,
17. Place and maintain retaining walls, at two (2) locations, in and/or along Deer Creek (WWF),
18. Place and maintain fill in several wetlands (PEM, PSS, PFO & POW), affecting approximately 0.77 acre of wetland, and temporarily affecting an additional 0.384 acre of wetland,
19. Place and maintain riprap in various watercourses, in association with the preceding activities, within a cumulative total of 77 LF
20. Realign/relocate various watercourses, in association with the preceding activities, which will impact a cumulative total of 524 LF of watercourses, and
21. Place and maintain fill in various watercourses, which will impact a cumulative total of 930 LF of watercourses.
22. An approximate, cumulative total of temporary impacts are anticipated to 1,167 LF of various watercourses.
Several mitigation projects are proposed to compensate for the cumulative total of impacts to watercourses from the Mainline East Subproject, as well as for impacts from several future subprojects associated with the overall PTC 40-48 Project (i.e. the Mainline West and State Route 1013/Saxonburg Boulevard Bridge Replacement Projects). Although final plans are not available, the applicant estimates that the aforementioned future subprojects and the current project will permanently affect a cumulative total of approximately 6,129 LF, and temporarily impact approximately 4,446 LF, of various watercourses. The proposed stream mitigation plan includes the reconstruction of approximately 1,728 LF of various reaches of watercourses, including approximately 198 LF of an unnamed tributary to Deer Creek (a.k.a. UNT-8), on-site, and approximately 2,550 LF of Deer Creek, off site. To compensate for the cumulative total of impacts to wetlands from the Mainline East Subproject, as well as for impacts from one other future subproject (i.e. SR 1013/Saxonburg Boulevard Bridge Replacement) and a previously permitted subproject (i.e. SR 910/Gibsonia Road/E02-1651 Bridge Replacement), the applicant will construct approximately 1.11 acres of wetlands, at two (2) locations (i.e. Site MLE-1 and Site MLE-2). Although final plans are not available, the applicant estimates that the SR 1013 Bridge Replacement will permanently affect an additional 0.07 acre of wetlands; while, Permit No. E02-1651 authorized impacts to 0.03 acre of wetland. Temporary impacts to wetlands from these and the current project are estimated to be 0.974 acre.
The Pennsylvania Turnpike Commission project in Indiana and Harmar Townships, Allegheny County, Quadrangle (start of Mainline East Subproject): Glenshaw, PA, N: 15.54 inches; W: 0.08 inch Sub-basin; Latitude: 40° 35` 8" and Longitude 79° 52` 32" and Quadrangle (end of Mainline East Subproject): New Kensington West, PA, N: 8.58 inches; W: 10.30 inches Sub-basin: 18A, Latitude: 40° 32` 50" and Longitude: -79° 49` 27".

Applicant is proposing to remove the existing 41` long, 14.5` wide, single span, SR 7225 bridge with a 90 degree skew and to construct and maintain a new 55.5` long, 31.2` wide single span bridge with a 77.5 degree skew and minimum 8.8' underclearance over Pigeon Creek (WWF) with a drainage area of 18.1 square miles; fill and maintain 0.035 acre of PEM wetland; and construct and maintain associated stormwater outfalls. The new bridge is located on an adjacent alignment with the existing bridge. To construct a retail development adjacent to the existing Cranberry Crossroads Phase I site. The project consists of a retail building and restaurant with associated roadways, parking, utilities, and stormwater management facilities. This project will permanently fill 0.06 acre PEM wetland and will permanently impact 376 LF of 2 UNTs Brush Creek by fill and an enclosure. Applicant proposes payment into the PA Wetland Replacement Fund to mitigate for the wetland impact. Stream impacts will be mitigated by relocating/restoring 185 LF of UNT Brush Creek onsite and restoring 325LF of UNT Brush Creek downstream of the project area using coir logs and mats, riparian plantings, bank grading, re-contouring slopes, and toe protection.

To construct, operate, and maintain:
1) a 17 foot wide permanent access road crossing temporarily impacting 9,583 square feet (0.22 acre) of PEM wetlands and permanently impacting 6,098 square feet (0.14 acre) of PEM wetlands (Harford, PA Quadrangle; N 41° 52` 23" Lat., W -75° 40` 53" Long.).
The project consists of a permanent access road to a Bluestone Pipeline Company of PA launcher/receiver site utilizing approximately 0.23 mile of access road in New Milford Township, Susquehanna County. The project will result in the temporary impact of 0.22 acre of PEM wetland and 0.14 acre of permanent PEM wetland impacts. All for the purpose of supporting Marcellus Shale natural gas pipeline activities for conveyance to market.

EROSION AND SEDIMENT CONTROL PERMITS The following parties have applied for Erosion and Sediment Control Permits for earth disturbance activities associated with either road maintenance or timber harvesting operations.
