FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevantState requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 To abandon an existing concrete culvert and to install and maintain a 48 inch high density polyethylene pipe outfall with concrete endwall and riprap apron along Eshleman Run (CWF) (Latitude 40°00`11", Longitude -76°06`45"). The project is to improve drainage conditions for the railroad, preventing the tracks from becoming inundated with stormwater. No wetlands will be disturbed as a result of the project.

 E36-917: Lancaster County Commissioners, 150 North Queen Street, Lancaster, Pennsylvania, 17603 in Marietta Borough and West Lampeter Township, Lancaster County, ACOE Baltimore District.

 To construct and maintain a 117 foot long, 15 foot, two inch wide, 3 span, pre-stressed concrete adjacent box beam pedestrian bridge on existing piers over Chiques Creek (WWF, MF); 2.) place and maintain 25 cubic yards of fill in the floodplains of Chiques Creek (WWF, MF) and the Susquehanna River (WWF, MF), for the purpose of providing a safe connection between the recreation trail network south of Chiques Creek and the recreation trail network north of Chiques Creek. The project is located approximately 1/2 mile south of the intersection of S.R. 441 and SR 23 (Latitude 40°03`18", Longitude -76°31`37") in West Hempfield Township and Marietta Borough, Lancaster County. No wetlands will be impacted by this project.

 Applicant proposes to place and maintain approximately 700 cubic yards (CY) of fill and concrete, and to remove approximately 12,600 CY of material from the floodplain of the Conemaugh River (WWF), with a netvolume of approximately 11,900 CY of material to be removed from the floodplain, for the purpose of constructing a reinforce concrete sump, in place of an existing stormwater collection pond, to facilitate the collection and use of stormwater in the flue gas desulfurization scrubber or ash handling system, at the Conemaugh Generating Station, which is a coal-fired, steam electric generating station. The project is located on the grounds of the existing generating station, (New Florence Quadrangle: N: 1.26 inches; W: 8.58 inches; Latitude: 40° 22` 54.9"; Longitude: -79° 3` 41.9") at 1442 Power Plant Road, in West Wheatfield Township, Indiana County.

 E56-369. Pennsylvania Department of Transportation—District 9-0, 1620 North Juniata Street Hollidaysburg, PA 16648, Elk Lick Township and Salisbury Borough, Somerset County; ACOE Pittsburgh District

 Applicant proposes to remove the existing SR 669, two lane, 25.7 ft total width, three span bridge having a total clear span length of 125 ft, and having a minimum underclearance of 13.9 ft; to construct and maintain adjacent to and upstream of the existing bridge a two span, two lane, 33.4 ft width replacement bridge and having a total clear span length of 152 ft, and having a minimum underclearance of 14.52 ft over the Casselman River (WWF) with a drainage area of 96 square miles; fill and maintain 0.04 acre of wetland. In addition the project includes temporary encroachments for construction and demolition, and encroachments associated with modification or replacement of stormwater facilities from the road alignment adjustment and new bridge. The Penndot improvement and relocation project extends between Salisbury Borough and Elk Lick Township (Myersdale Quadrangle, Latitude 39° 45` 36" and Longitude -79° 5` 0") in Somerset County.

 Applicant proposes to remove the existing 24` 10" wide, 66` long, two span, SR 669 bridge with a 90 degree skew and to construct and maintain a new 31` 4" wide, 66` long, single span bridge with minimum 5` 6" underclearance over Tub Mill Run (TSF); to construct and maintain associated outfalls; fill and maintain 0.01 acre of wetland; and construct and remove a temporary 16` wide crossing.  The project consists of construction of a bridge across North Fork Cole Creek. The bridge will be constructed of concrete abutments and steel members.

 To construct, operate, and maintain:

 1) one 6-inch gas pipeline and a timber mat bridge impacting 110 linear feet of an unnamed tributary to Murray Run (EV) (Bodines, PA Quadrangle 41°23`20"N 76°56`22"W);

 2) one 6-inch gas pipeline bored beneath 47 linear feet of Murray Run (EV) (Bodines, PA Quadrangle 41°23`30"N 76°56`14"W);

 3) one temporary mobile bridge impacting 44 linear feet of Murray Run (EV) (Bodines, PA Quadrangle 41°23` 29"N 76°56`13"W).

 The project will result in a total of 201 linear feet of stream impacts all for the purpose of installing a natural gas gathering line and temporary access roadways for Marcellus well development.

 E0829-023: Chesapeake Appalachia, LLC, 4 Chesapeake Lane, Sayre, PA 18840, Wilmot Township, Bradford County, ACOE Baltimore District.

 To construct, operate, and maintain:

 (1) a 16 inch temporary waterline and a timber mat bridge impacting 67 linear feet of an unnamed tributary to Sugar Run (CWF,MF) and impacting 2,505 square feet of an adjacent Palustrine Emergent Wetland and Palustrine Forested Wetland (Colley, PA Quadrangle, Latitude: 41°33`08", Longitude: -76°19`58");

 (2) a 16 inch diameter temporary waterline and a timber mat bridge impacting 28 linear feet of an unnamed tributary to North Branch Mehoopany Creek (CWF, MF) (Colley Quadrangle 41°33`07"N 76°19`58"W),

 (3) a 16 inch diameter temporary waterline over an existing culvert on an unnamed tributary to North Branch Mehoopany Creek (CWF, MF) impacting 3 linear feet (Colley Quadrangle 41°33`05"N 76°20`10"W),

 (4) a 16 inch diameter temporary waterline and a timber mat impacting 2,420 square feet of Palustrine Emergent Wetland (Colley Quadrangle 41°33`19"N 76°19` 43"W),

 The project will result in 98 linear feet and 240 square feet of temporary stream impacts and 4,925 square feet (0.11 acre) of temporary PEM wetland impacts from temporary waterlines and timber mat bridge crossings all for the purpose of establishing a temporary water supply for Marcellus well development.

This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.101) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period.
