PUBLIC WATER SUPPLY PERMITS The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropri-ate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.
For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

PREAMBLE 2
The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).
Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

Carbondale Former Manufactured Gas Plant, 8th Avenue at Mill Street, Lackawanna County, Bruce Middleman, Stantec Consulting Services Inc., has submitted a Cleanup Plan on behalf of his clients, Anthony Rymar, UGI Penn Natural Gas, Inc., 2525 North 12th Street, Reading, PA 19612, concerning the remediation of soil and groundwater found to have been impacted by polycyclic aromatic hydrocarbons (PAH), volatile organic compounds (VOC) and lead caused from historical operations used for the manufacture of coal gas. The applicants propose to remediate the site to meet the residential Statewide Health Standards for soil and the Site Specific Standards for soil and groundwater. A summary of the Cleanup Plan was published in The Carbondale News/The Villager on September 11, 2013.
Okula Property, 2 Deibert Drive, Jackson Township, Monroe County. Jim Gibson, Brinkerhoff Environmental Services, Inc., 133 Jackson Road, Suite D, Medford, NJ 08055 has submitted a Final Report (on behalf of his client, Anna Okula, 2 Deibert Drive, Stroudsburg, PA 18360), concerning the remediation of soil and groundwater found to have been impacted by kerosene as a result of a release from a kerosene aboveground storage tank. The applicant proposes to remediate the site to meet the Residential Statewide Health Standard for soil and groundwater. A public notice regarding the submission of the Final Report was published in The Pocono Record, on September 4, 2013.
Marston Property, 104 Bone Ridge Road, Paupack Township, Wayne County, Thomas Hippensteal, Enviro-search Consultants, Inc., has submitted a Final Report on behalf of his client, Mr. Charles Marston, 301 Green Road, Berwyn, PA 19312, concerning the remediation of soil found to have been impacted by #2 fuel oil, released from an aboveground storage tank due to vandalism. The applicant proposes to remediate the site to meet the Residential Statewide Health Standards for soil. The intended future use of the site is residential. A public notice regarding the submission of the Final Report was published in The Wayne Independent on September 19, 2013.
Southwest Region: Environmental Cleanup Program Manager, 400 Waterfront Drive, Pittsburgh, Pa 15222-4745
Buffalo Creek Farms, 207 Iron Bridge Road, South Buffalo Township, Armstrong County, Harris Environmental Inc., 600 Stone House Road, Clarion PA. 16214, on behalf of Buffalo Creek Farms, submitted a final report for the remediation of contaminated site soils encountered during the removal of two unregulated underground storage tanks that contained gasoline for farm equipment use. The report is intended to document remediation of the site to meet the residential statewide health standard.
Comtech Industries Inc. (former Fort Pitt Lot #2), Fort Pitt Business Park, Four Coins Drive, Borough of Canonsburg, Washington County. BA Group Inc., 2525 Green Tech Drive, Suite D, State College PA 16803, on behalf of Comtech Industries Inc., submitted a Final Report concerning remediate localized areas of contam-ination present in site soils to the statewide health and suite specific standard for VOC's, SVOC's and metals. Future use of the property will be non-residential.
Former GM Stamping Plant, West Mifflin Borough, Allegheny County. KU Resources, 22 South Linden Street, Duquesne PA 15110 on behalf of Michael J. Roberts, Mifflin, LLC, 1650 Des Peres Rd, Suite 303, St. Louis, MO 63131 has submitted a Risk Assessment and Cleanup Plan Remedial on September 26 2013. Environmental concerns include metal impacted soil and groundwater with hydraulic oils which have been released throughout the former manufacturing building.

A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

09-00096: Suburban Heating Oil Partners (3115 State Road, Telford, PA 18969) on September 27, 2013, for renewal of a State Only, Synthetic Minor Operating Permit in West Rockhill Township, Bucks County. The facility operates a petroleum bulk facility and gasoline dispensing facility. The proposed renewal of the Operating Permit includes: name change from Inergy Propane to Suburban Heating Oil Partners, the addition of a facility Volatile Organic Compound (VOC) emission limit of 2.0 tons per year, and the addition of NESHAPS Subpart CCCCCC regulations for gasoline dispensing facilities. 11-00498: Pets After Life Services / Portage (3215 Frankstown Road, Portage, PA 15946) on September 24, 2013, the Department issued a State Only Operating Permit for the pet crematory located in Portage Township, Cambria County. The subject facility consists of a R&K Incinerator, Model 36, with a primary chamber rated at 0.210 MMBtu/hr and a secondary chamber rated at 0.280 MMBtu/hr. The facility has the potential to emit less than 1 ton per year of each criteria pollutant. Once during each cremation cycle, the permittee shall conduct a fugitive emission survey and a malodor survey around the perimeter of the facility property to ensure compliance with 25 Pa. Code §§ 123.1, 123.2, and 123.31. Records of the survey performed must be recorded. Particulate emissions shall not exceed 0.08 gr/dscf corrected to 7% oxygen. The permittee shall maintain records of time and corresponding temperature during each cremation cycle when the temperature of the secondary combustion chamber is least 1800 degrees Fahrenheit; the amount of fuel used on a monthly basis; hours of operation; and cremation cycles. The temperature of the secondary (or last) chamber shall achieve at least 1800 degrees Fahrenheit during each cremation cycle. The proposed authorization is subject to State and Federal Regulations. The permit includes operation requirements, monitoring requirements, and recordkeeping requirements.
63-00874: Therm-O-Rock East, Inc. (85 Washington Avenue, Donora, PA 15033) on September 24, 2013, the Department issued a State Only Operation Permit for the operation blending, bagging of thermally expanding nonmetallic minerals (perlite and vermiculite) located in the Donora Borough, Washington County. The subject facility consists of storage silos, mixers, and material handling and transferring. The facility has the potential to emit 9.19 tpy PM and 2.70 tpy PM-10. The facility is required to conduct a weekly survey of the facility during daylight hours while the facility is operating to ensure compliance with the visible emission, fugitive emission and malodor restrictions. Records of the weekly survey performed must be recorded. Monthly preventative maintenance inspections are to be performed on the control devices and recorded in an on-site log. Particulate matter emissions are not to exceed 0.04 gr/dscf. The proposed authorization is subject to State and Federal Regulations. The permit includes operation requirements, monitoring requirements, and recordkeeping requirements.
