LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 3


The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

 For further information concerning the plans and reports, contact the environmental cleanup program manager in the Department regional office under which the notice of the plan or report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office. L.P. submitted a Baseline Environmental Report concerning remediation of site soil and groundwater contaminated with VOC's and SVOC's and metals. In order to obtain cleanup liability protection, the person undertaking the reuse of a Special Industrial Area shall enter an agreement with the Department, based on the approved Baseline Environmental Report which outlines cleanup liability of the property. The Report was approved by the Department on November 7, 2013.

KU Resources, Inc., 22 South Linden Street, Duquesne, PA 15110, on behalf of Transtar/Union Railroad Company, 1200 Penn Avenue, Suite 300, Pittsburgh, PA 15222 submitted a Final report concerning the remediation of site soil and groundwater contaminated with lead, manganese, arsenic, molybdenum, iron and aluminum. The Final Report attained combined statewide health and site specific non-residential standard for soil and groundwater and was approved by the Department on November 12, 2013.

 The project serves to expand the current wet operations at the facility, which were previously exempted from Plan Approval and Operating Permit requirements under Request for Determination of Changes of Minor Significance and Exemption from Plan Approval/Operating Permit (''RFD'') No. 2895, by increasing the quantity and capacities of process tanks (and consequently, production) for, and the strength of the acids used in, the lines.

 The (pre-control) potential emission rates of HCl (a hazardous air pollutant (''HAP'')) and HNO3 from the lines are approximately 4.3 tons/yr and 6.3 tons/yr, re- spectively. Packed tower wet scrubbers will be installed, with a vendor's guarantee to achieve a minimum acid gas removal efficiency of 99%, to reduce the acid gas emissions from the facility. Nitric oxide (''NO'') and nitrogen dioxide (''NO2'') are also emitted from the HNO3 line, and the second associated scrubber will also achieve some NO2 control.

 The Plan Approval will include emission concentration restrictions for HCl, HNO3, NO, and NO2 of 0.1 ppmv, 0.1 ppmv, 3.0 ppmv, and 7.0 ppmv, respectively. The Department reserves the right to review these restrictions based on the results of stack testing required under the Plan Approval.

 The Plan Approval will include monitoring, recordkeeping, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.

65-00778: Three Rivers Marine & Rail Terminal—Gibsonton Yard (17 Arentzen Boulevard, Suite 206 Charleroi, PA 15022) on November 12, 2013, to issue a State Only Operating Permit renewal for the operation of a barge and truck unloading and transferring operation in Rostraver Township, Westmoreland County. The subject facility consists of three barge docks with clam shells, two rail unloading areas, a receiving area for a bagging operation, and an assortment of storage piles. Barges are unloaded and material is either loaded into trucks or stockpiled until trucks are available. The facility provided potential emissions at 15.5 tons per year PM10. This includes the potential emissions from transferring material from barge to truck, haul roads, truck unloading, wind erosion and front loaders. The facility is required to maintain a daily log of material delivered to the facility, inventory on hand, and material shipped from the facility. All trucks carrying bulk material shall be tarped when leaving the terminal and handled in such a way to minimize track out onto the public road. The clam shell must be operated in such a way to minimize lose from the clam shell during transfer of material and minimize the drop height into the truck/barge. All roads shall be kept clean or watered as needed to minimize dust. The proposed authorization is subject to State and Federal Regulations. The permit includes additional operational requirements, monitoring requirements, and recordkeeping requirements.

10-00368: MarkWest Liberty Bluestone, LLC (440 Hartmann Road, Evans City, PA 16033) on November 6, 2013, for issuance of initial Synthetic Minor Operating Permit in the Jackson Township, Butler County. The facility is processing the natural gas and, transporting it to the consumers. The facility's emitting sources include: 1) Inlet Compressors (6), 2) Residue Compressors (4), 3) Refrigerant Compressors (2), 4) Dehydrators (2), 5) Emergency Generators (2), 6) Process Heaters, 7) Truck Loading, 8) Storage Tanks (2) and, 9) Gas processing plant. The emergency generators and compressors are subject to 40 CFR Part 60 Subpart JJJJ, IIII, OOOO and HH. The facility is synthetic minor because; the facility has taken a restriction of natural gas fuel usage in combustion sources not greater than, 1,120,000 MMBTU/year. This limit will control the emission of greenhouse gas, Carbon Di Oxide. Potential emissions of the pollutants after taking the limitations are: NOx: 56.71 Tons per year (TPY), CO: 77.50 TPY VOC: 38.62 TPY, PM-10: 5.96 TPY, HAPs: 10.41 TPY, CO2: 66,030 TPY.

33-00025: Punxsutawney Area Hospital (81 Hillcrest Drive, Punxsutawney, PA 15767) on November 5, 2013, renewed a State Only Operating Permit for their hospital in Young Township, Jefferson County. The primary sources at the facility are an oil-fired emergency generator, a parts washer, and 2 dual-fueled 10.5 million Btu/hr boilers using natural gas as primary fuel and capable of firing oil in the event of a natural gas curtailment. Potential Emissions for the site are less than the Title V thresholds. The facility is a Natural Minor. The emergency generator is subject to 40 CFR Part 63 Subpart ZZZZ, the NESHAP for Stationary RICE. The permit contains emission restrictions, recordkeeping, and work practice requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

(4 Steel Road East, Morrisville, PA 19067) On November 5, 2013, for the installation of 10 Above Ground Acid Storage Tanks with the Associated Air Pollution Control Devices (storage tanks) and throughput revisions for additional existing storage tanks at the Univar USA, Inc., chemicals manufacturing facility located at 4 Steel Road East, Falls Township, Bucks County. The control devices include two scrubbers to control five of ten storage tanks. The installation and throughput revision of storage tanks may result in the emissions of: 24.90 tons per year of Hazardous Air Pollutants and 24.90 tons per year of Volatile Organic Compounds from the Univar USA, Inc, Morrisville facility located on 4 Steel Road East. The Operating Permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

15-00061: Phoenixville Hospital Company, LLC (140 Nutt Road, Phoenixville, PA 19460) on November 5, 2013, located in Phoenixville Borough, Chester County, for operation of boilers and emergency generators at the existing hospital. The permit is for a non-Title V (State only) facility. Facility wide criteria pollutant emissions are restricted to less than the major facility thresholds; therefore, the facility is classified as a Synthetic Minor facility. Administrative Amendment of the Synthetic Minor Operating Permit issued under the Air Pollution Control Act (35 P. S. §§ 4001—4015) and 25 Pa. Code § 127.450. The Administrative Amendment incorporates terms and conditions of Plan Approval No. 15-0061A, which allows for the installation of a new boiler (Source ID 038—12.247 MMBtu/hr Cleaver Brooks Boiler). The boiler is not subject to the requirements of 40 CFR Part 63 Subpart JJJJJJ. The amended permit will include monitoring, recordkeeping, and reporting requirements designed to keep the facility within all applicable air quality requirements.

09-00024: Waste Management of Pennsylvania, Inc. (1000 New Ford Mill Road, Morrisville, PA 19067) on November 6, 2013, for the major (Title V) Operating Permit for the Tullytown Resource Recovery facility, in Tullytown Borough, Bucks County. The Operating Permit was administratively amended to incorporate the conditions of Plan Approval 09-0024F for a landfill expansion, known as the Eastern Expansion, and its associated landfill gas collection system.

46-00060: Norristown State Hospital (1001 East Sterigere Street, Norristown, PA 19401) on November 7, 2013, to incorporate three natural gas #2 fuel-fired boilers that were issued under GP1-46-0235 in Norristown Borough, East and West Norriton Townships, Montgomery County.

23-00105: Hanson Aggregates PA, LLC—Glen Mills HMA Plant (523 West Forge Rd., Glen Mills, PA 19342) on November 8, 2013, to incorporate the conditions from the previously-issued Plan Approval 23-0105 for the replacement and upgrade of the Fabric Filter Baghouse used to control particulate matter emissions at the Hot Mix Asphalt Plant in Middletown Township, Delaware County. This facility is a non-Title V facility. The re- placement/upgrade will not result in a net increase in particulate matter emissions. The State Only Operating Permit will contain recordkeeping requirements and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

19-00006: Del Monte Corporation (6670 Low Street, Bloomsburg, PA 17815) on October 31, 2013, issued a revision of the Title V operating permit for their Blooms- burg facility located in South Centre Township, Columbia County. This Title V operating permit revision was authorized for the increase of ink usage for their dry line packaging operations. There will be an increase of volatile organic compound (VOC) emissions of 0.21 ton in a year as a result of this change. The increase was authorized under the Department's de minimis emission increase pursuant to 25 Pa. Code Section 127.449. The revised operating permit contains all applicable regulatory requirements, including monitoring, recordkeeping and reporting conditions.
