 The Independent Regulatory Review Commission met publicly at 10 a.m., Thursday, May 22, 2014, and announced the following:

 Board of Coal Mine Safety #7-482: Requirements for High-Voltage Continuous Mining Machines (adds 25 Pa. Code §§ 208.81—208.93)

Action Taken—Regulations Approved:

Department of Labor and Industry—
Prohibition of Excessive Overtime in Health Care Act Regulations; Regulation No. 12-91 (#2957)

 On June 26, 2012, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Department of Labor and Industry (Department). This rulemaking amends 34 Pa. Code by adding Chapter 225. The proposed regulation was published in the July 14, 2012 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on January 16, 2014. At its February 27, 2014 public meeting, the Commission voted to disapprove the final-form regulation. On April 28, 2014, the Department submitted its report containing the revised final-form regulation to the Commission.

 This regulation establishes complaint and investigation procedures as well as administrative penalty provisions related to violations of the Prohibition of Excessive Overtime in Health Care Act of 2008 (43 P. S. §§ 932.1—932.6).

 We have determined this regulation is consistent with the statutory authority of the Department (43 P. S. § 932.5) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Amending Regulations Regarding Disclosure Statement for Residential and Small Business Customers and the Provision of Notices of Contract Expiration or Changes in Terms for Residential and Small Business Customers; Regulation No. 57-305 (#3053)

 On April 8, 2014, the Independent Regulatory Review Commission (Commission) received this regulation from the Pennsylvania Public Utility Commission (PUC). This rulemaking amends 52 Pa. Code Chapter 54. Notice of proposed rulemaking was omitted for this regulation; it will become effective upon publication in the Pennsylvania Bulletin.

 This final-omitted regulation amends customer notice regulations in the competitive retail electricity market.

 We have determined this regulation is consistent with the statutory authority of the PUC (66 Pa.C.S. § 501 (b)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Amending Regulations Regarding Standards for Changing a Customer's Electricity Generation Supplier; Regulation No. 57-306 (#3054)

 On April 8, 2014, the Independent Regulatory Review Commission (Commission) received this regulation from the Pennsylvania Public Utility Commission (PUC). This rulemaking amends 52 Pa. Code Chapter 57. Notice of proposed rulemaking was omitted for this regulation; it will become effective upon publication in the Pennsylvania Bulletin.

 This regulation accelerates the process for a customer to switch electric generation suppliers.

 We have determined this regulation is consistent with the statutory authority of the PUC (66 Pa.C.S. § 501(b)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
