LAND RECYCLING AND ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995
PREAMBLE 2
The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).
Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The proposed future use of the property will be residential, and the proposed cleanup standard for the site is the Statewide Health Standard for soil. The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).
Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

23-0038F: Delaware County Regional Water Quality Control Authority (DELCORA) (P. O. Box 999, Chester, PA 19016) On April 1, 2015 for a new air pollution control system and increase in sewage sludge throughput to 55 tons dry sludge per day for each of two incinerators located in the City of Chester, Delaware County. DELCORA is a major facility. The new air pollution equipment train for each incinerator includes a quench, multi-venturi scrubber, wet electrostatic precipitator and regenerative thermal oxidizer, which were determined to be Best Available Technology (BAT). Currently, the top hearth of each incinerator functions as an afterburner. The top hearth will be modified to accept the sludge feed, since the afterburner function has been located downstream. There will be a slight increase in the allowable emissions of particulate matter due to the higher throughput. Allowable emissions of other air pollutants will remain at the level of the current Title V permit or decrease due to the more efficient air pollution control equipment. Allowable emissions of the following air pollutants for both incinerators in tons/year are: particulate matter 26.2 and sulfur oxides 65.8. Allowable emissions of nitrogen oxides, carbon monoxide and volatile organic compounds will remain as stated in the facility's Title V Operating Permit, 23-00038. Emissions of beryllium, mercury, lead, arsenic, cadmium, nickel and chromium are limited by the provisions of 40 CFR Part 61 Subparts C and E (National Emission Standards for Beryllium and Mercury), and Part 503 Subpart E Standards for Use or Disposal of Sewage Sludge, Incineration), as currently provided by the facility's operating permit. The facility is subject to the requirements of 40 CFR Part 60 Subpart O (Standards of Performance for Sewage Treatment Plants), which regulates particulate matter.

Water Quality Certification under Section 401 of the Federal Clean Water Act for the Leidy Southeast Expansion Project
Natural Gas Pipeline Project and Related Mitigation; FERC Doc. No. CP13-551-000; PADEP File No. EA40-013, EA45-002 On April 6, 2015, the DEP issued Section 401 Water Quality Certification to Transcontinental Gas Pipe Line Company, LLC for the Leidy Southeast Expansion project. The Pennsylvania Department of Environmental Protection (PADEP) certifies that the construction, operation and maintenance of the Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The PADEP further certifies that the construction, operation and maintenance of the projects complies with Commonwealth water quality standards and that the construction, operation and maintenance of the projects does not violate applicable Commonwealth water quality standards provided that the construction, operation and maintenance of the projects complies with the conditions for this certification, including the criteria and conditions of the following permits:
1. Discharge Permit—Transcontinental Gas Pipe Line Company, LLC shall obtain and comply with a PADEP National Pollutant Discharge Elimination System (NPDES) permit for the discharge of water from the hydrostatic testing of the pipeline pursuant to Pennsylvania's Clean Streams Law (35 P. S. §§ 691.1—691.1001) and all applicable implementing regulations (25 Pa. Code Chapter 92a).
2. Erosion and Sediment Control Permit—Transcontinental Gas Pipe Line Company, LLC shall obtain and comply with PADEP's Chapter 102 Erosion and Sediment Control General Permit for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment issued pursuant to Pennsylvania's Clean Streams Law and Storm Water Management Act (32 P. S. §§ 680.1—680.17) and all applicable implementing regulations (25 Pa. Code Chapter 102).
3. Water Obstruction and Encroachment Permits—Transcontinental Gas Pipe Line Company, LLC shall obtain and comply with a PADEP Chapter 105 Water Obstruction and Encroachment Permits for the construction, operation and maintenance of all water obstructions and encroachments associated with the project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P. S. §§ 673.1—693.27), and Flood Plain Management Act (32 P. S. §§ 679.101—679.601.) and all applicable implementing regulations (25 Pa. Code Chapter 105).
4. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that the receiving water quality is not adversely impacted by any operational and construction process that may be employed by Transcontinental Gas Pipe Line Company, LLC.
5. Operation—For each Project under this certification, Transcontinental Gas Pipe Line Company, LLC shall at all times properly operate and maintain all Project facilities and systems of treatment and control (and related appurtenances) which are installed to achieve compliance with the terms and conditions of this Certification and all required permits. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Transcontinental Gas Pipe Line Company, LLC.
6. Inspection—The Projects, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of PADEP to determine compliance with this Certification, including all required permits required, and Pennsylvania's Water Quality Standards. A copy of this Certification shall be available for inspection by the PADEP during such inspections of the Projects.
7. Transfer of Projects—If Transcontinental Gas Pipe Line Company, LLC intends to transfer any legal or equitable interest in the Projects which is affected by this Certification, Transcontinental Gas Pipe Line Company, LLC shall serve a copy of this Certification upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the PADEP Regional Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owner containing a specific date for transfer of Certification responsibility, coverage, and liability between them.
8. Correspondence—All correspondence with and submittals to PADEP concerning this Certification shall be addressed to the Department of Environmental Protection, Northeast Regional Office, Waterways and Wetlands Program, 2 Public Square, Wilkes-Barre, PA 18701-1915.
9. Reservation of Rights—PADEP may suspend or revoke this Certification if it determines that Transcontinental Gas Pipe Line Company, LLC has not complied with the terms and conditions of this Certification. Water Quality Certification under Section 401 of the Clean Water Act for the National Fuel Gas West Side Expansion and Modernization Project On February 6, 2014, National Fuel Gas Supply Corporation (National Fuel Gas) filed an application with the Federal Energy Regulatory Commission (FERC) under Section 7 of the Natural Gas Act (15 U.S.C. § 717f) seeking a certificate of public convenience and necessity to construct and operate its West Side Expansion and Modernization Project (Project) in Washington, Allegheny, Beaver, Venango, and Mercer Counties, Pennsylvania (FERC Docket No. CP14-70). The FERC Environmental Assessment for the Project, which was issue on December 8, 2014, may be viewed on FERC's website at www.ferc.gov (search eLibrary; Docket Search; CP14-70).
The proposed Project would replace about 23 miles of the existing 20-inch-diameter Line N (referred to as Sections 1, 2, and 3) which were built in 1947, with new 24-inch-diameter pipeline located in Washington, Allegheny, and Beaver Counties. The replacement section is proposed to be constructed at an approximately 25-foot offset from the existing pipeline where feasible.
The Project also consists of the installation of additional compression at the existing Mercer Compressor Station in Mercer County and miscellaneous piping modifications at the existing Henderson Compressor Station in Venango County. The modifications at the Henderson Compressor Station are necessary to meet the changing pipeline operating conditions with the addition of the new service. National Fuel Gas currently owns the land required to construct and operate the additional compression and station modifications.
Pursuant to Section 401 of the Clean Water Act (33 U.S.C. § 1341), the Pennsylvania Department of Environmental Protection (PADEP), by this notice, proposes to certify that the construction, operation and maintenance of the Project complies with the applicable provisions of the Clean Water Act, through compliance with the following State water quality permitting programs, criteria and conditions established pursuant to Pennsylvania's Clean Stream Law (35 P. Water Quality Certification under Section 401 of the Clean Water Act for the Equitrans, L.P. TP-7911 Pipeline Replacement Project On February 19, 2015, Equitrans, L.P. (Equitrans) filed a prior notice application with the Federal Energy Regulatory Commission (FERC) pursuant to Section 7(b) of the Natural Gas Act (NGA) (15 U.S.C. § 717f) and Sections 157.205, 157.208, 157.210, and 157.216 of the FERC's regulations under the NGA, and Equitrans' blanket certificate issued in Docket No. CP96-352-000, seeking authorization of its TP-7911 Pipeline Replacement Project (Project) in Cambria County, Pennsylvania (FERC Docket No. CP15-92). The Commission's Notice of Request Under Blanket Authorization for the Project was issued on February 27, 2015 and may be viewed on the FERC's website at www.ferc.gov (search eLibrary; Docket Search; CP15-92).
To allow for the modernization of the TP-7911 pipeline for integrity assessment through the use of in-line inspection, Equitrans is proposing the replacement of approximately 3.0 miles of 12-inch diameter pipeline with 20-inch diameter pipeline within the existing right-of-way. The replacement pipeline will be offset 10 to 15 feet from the existing pipeline. The existing 20" pipeline will be abandoned in place. Approximately 2.6 miles of the project will be installed on Pennsylvania Department of Conservation and Natural Resource (DCNR) property. The new pipeline will utilize portions of the existing right-of-way during construction. A pig launcher to originate from the Ranger Mountain Compressor Station, a pig launcher receiver at the end of the line located near the Vinco Station, and a cathodic protection ground bed will also be installed as part of this project. The project will also utilize horizontal directional drilling techniques for 2 locations. A total of 5.1 miles of access roads (ARs) are proposed to provide access to the existing right-of-way. AR-1 is existing and Equitrans plans to maintain the current condition for the majority of this AR. The southern portion of AR-1 is existing and Equitrans plans to utilize existing culverts for crossing features on this road. The culverts on the southern portion of AR-1 will be replaced in kind if required during construction. Once construction is complete AR-1 and an existing shale work area will be top dressed with gravel as required by DCNR. ARs 2, 3, 4, and 5 are proposed temporary ARs to be utilized during construction and will be returned approximately to their original conditions once construction is complete. AR-6 already exists.
The pipeline shall be installed using a typical 75-foot wide limit of disturbance (LOD) for pipeline construction with areas of temporary work space adjacent to the LOD, and a typical 25-foot LOD for the ARs to allow access to the pipeline. Areas adjacent to stream or wetland crossings will maintain a 75-foot LOD unless otherwise depicted on the plans. The permanent ROW will be reduced to 50 feet after construction. There is no anticipated permanent increase in impervious area or in stormwater runoff due to the construction of the pipeline.
The abandonment and/or replacement of ancillary facilities such as taps, regulators, and valves will also take place as part of the Project. The Project is located in Jackson Township, Cambria County, PA.
Pursuant to Section 401 of the Clean Water Act (33 U.S.C. § 1341), the Pennsylvania Department of Environmental Protection (PADEP), by this notice, proposes to certify that the construction, operation and maintenance of the Project complies with the applicable provisions of the Clean Water Act, through compliance with the following State water quality permitting programs, criteria and conditions established pursuant to Pennsylvania's Clean Stream Law (35 P. S. §§ 691.1—691.1001), which ensure the Project does not violate applicable water quality standards set forth in 25 Pa. Code Chapter 93:
1. Discharge Permit—Equitrans shall obtain and comply with a PADEP National Pollutant Discharge Elimination System (NPDES) permit for the discharge of water from the hydrostatic testing of the pipeline pursuant to Pennsylvania's Clean Streams Law, and all applicable implementing regulations (25 Pa. Code Chapter 92a).
2. Erosion and Sediment Control Permit—Equitrans shall obtain and comply with PADEP's Chapter 102 Erosion and Sediment Control General Permit for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment (ESCGP-2) issued pursuant to Pennsylvania's Clean Streams Law and Storm Water Management Act (32 P. S. §§ 680.1—680.17), and all applicable implementing regulations (25 Pa. Code Chapter 102).
3. Water Obstruction and Encroachment Permits—Equitrans shall obtain and comply with a PADEP Chapter 105 Water Obstruction and Encroachment Permits for the construction, operation and maintenance of all water obstructions and encroachments associated with the project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P. S.§§ 673.1—693.27), and Flood Plain Management Act (32P. S. §§ 679.101—679.601), and all applicable implementing regulations (25 Pa. Code Chapter 105).
4. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that the receiving water quality is not adversely impacted by any operational and construction process that may be employed by Equitrans.
5. Operation—Equitrans shall at all times properly operate and maintain all Project facilities and systems of treatment and control (and related appurtenances) which are installed to achieve compliance with the terms and conditions of this Section 401 Water Quality Certification and all required permits. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Equitrans.
6. Inspection—The Project, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of PADEP to determine compliance with this Section 401 Water Quality Certification, including all required State water quality permits and water quality standards. A copy of this certification shall be available for inspection by the PADEP during such inspections of the Project.
7. Transfer of Projects—If Equitrans intends to transfer any legal or equitable interest in the Project which is affected by this Section 401 Water Quality Certification, Equitrans shall serve a copy of this certification upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the PADEP Regional Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owner containing a specific date for transfer of certification responsibility, coverage, and liability between them.
8. Correspondence—All correspondence with and submittals to PADEP concerning this Section 401 Water Quality Certification shall be addressed to the Department of Environmental Protection, Southwest Regional Office, Rita A. Coleman, Waterways and Wetlands Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.
9. Reservation of Rights—PADEP may suspend or revoke this Section 401 Water Quality Certification if it determines that Equitrans has not complied with the terms and conditions of this certification. PADEP may require additional measures to achieve compliance with applicable law, subject to Equitrans' applicable procedural and substantive rights.
10. Other Laws—Nothing in this Section 401 Water Quality Certification shall be construed to preclude the institution of any legal action or relieve Equitrans from any responsibilities, liabilities, or penalties established pursuant to any applicable federal or state law or regulation.
11. Severability—The provisions of this Section 401 Water Quality Certification are severable and should any provision of this certification be declared invalid or unenforceable, the remainder of the certification shall not be affected thereby.
Prior to issuance of the final Section 401 Water Quality Certification, PADEP will consider all relevant and timely comments, suggestions or objections submitted to PADEP within 30 days of this notice. Comments should be directed to Ms. Rita A.
