LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 3


The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

 For further information concerning the plans and reports, contact the environmental cleanup program manager in the Department regional office under which the notice of the plan or report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Siverly Residence, 1268 Seidersville Road, Lower Saucon Township, Northampton County. American Analytical & Environmental Inc., 738 Front Street, Catasauqua, PA 18032, on behalf of Mr. James R. Siverly, 1268 Seidersville Road, Bethlehem, PA 18015, submitted a Final Report. Heating oil was released from an aboveground storage tank. The proposed future use of the property will be residential, and the proposed cleanup standard for the site is the Statewide Health Standard for soil. The report was approved by the Department on April 10, 2015.

Shirley Altland Residence, 467 Capitol Hill Road, Dillsburg, PA 17019, Franklin Township, York County. Reliance Environmental, Inc., 235 North Duke Street, Lancaster, PA 17602, on behalf of Shirley Altland, 467 Capitol Hill Road, Dillsburg, PA 17019, submitted a Final Report concerning remediation of site soils contaminated with #2 fuel oil. The Final Report demonstrated attainment of the Residential Statewide Health Standard, and was approved by the Department on April 20, 2015.

Pennsylvania Department of Transportation York County Maintenance Facility, 1920 Susquehanna Trail North, York, PA 17404, Manchester Township, York County. Leidos Engineering, LLC, 180 Gordon Drive, Suite 109, Exton, PA 19341 on behalf of Pennsylvania Department of Transportation, P. O. Box 2957, Harrisburg, PA 17105, submitted a Remedial Investigation/Final Report concerning remediation of site soils and groundwater contaminated with petroleum hydrocarbons. The combined Report demonstrated attainment of a combination of Residential Statewide Health and Site Specific Standards, and was approved by the Department on April 20, 2015.

Southwest Region: Environmental Cleanup & Brown-field Development Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745

Mallet and Company, Inc., 51 Arch Street Extension, Rosslyn Farms Borough, Allegheny County. RPS Gaia Tech, Inc., 135 S. LaSalle Street, Suite 3500, Chicago, Illinois, 60603 on behalf of Mallet and Company, Inc., 51 Arch Street Extension, Carnegie, PA 15106 has submitted a Remedial Investigation Report/Cleanup Plan/Final Report concerning the remediation of site soils contaminated with 1,2,4-trimethylbenzene, antimony, arsenic, lead, manganese, and mercury and tetracholoethylene (PCE), dibenzo(a,h)anthracence, indeno(1,2,3-cd)pyrene, aluminum, antimony, arsenic, iron, lead, and manganese in groundwater. The RIR/CP/Final Report demonstrated attainment for both non-residential Statewide Health/Site Specific standards for the identified COC's in soils and groundwater and was approved by the Department on April 14, 2015.

09-0210A: Waste Management of Fairless, LLC (1000 New Ford Mill Rd, Morrisville, PA 19067) On April 14, 2015 for a new municipal landfill and landfill gas collection system in Falls Township, Bucks County. The proposed Fairless Landfill would occupy approximately 200 acres on the USX property complex, adjacent to Waste Management Disposal Services of Pennsylvania's existing GROWS Landfill. The GROWS and Fairless Landfills are considered a single facility for air quality permitting purposes. The aggregated facility is a Title V facility. GROWS operates under TVOP 09-00007. Emissions of volatile organic compounds (VOC) and hazardous air pollutants (HAPs) shall be controlled by both an interim and final landfill gas collection and control system (GCCS). Landfill gas collected by the GCCS will be routed to an off-site user. Use of a total of five flares, including three previously approved for the GROWS Landfill, are proposed to serve as back-up control devices in the event the landfill gas cannot be transmitted to the end users. The final GCCS shall be designed and operated according to the specifications and operational standards of the New Source Standards of Performance (NSPS) for Municipal Solid Waste Landfills 40 CFR Part 60, Subpart WWW. The interim and final GCCS comprise Best Available Technology (BAT) for the source. The facility is also subject to the requirements of National Emissions Standard for Hazardous Air Pollutants for Source Categories (Maximum Achievable Control Technology), Subpart AAAA: Municipal Solid Waste Landfills and will comply with all applicable requirements.

Their proposal included limiting the heat input of coal combustion at the facility located in Penn Township, Snyder County such that, the coal boilers meet the limited use provisions of Subpart JJJJJJ.

08-00052A: REV LNG, LLC (1002 Empson Road, Ulysses, PA 16948) on April 16, 2015, to construct two (2) 1,380 bhps Caterpillar G3516B LE 4-stroke, ultra-lean burn, natural gas-fired compressor engines, each equipped with 2-way oxidation catalysts for the production of liquefied natural gas, at the proposed Clark Facility located in Herrick Township, Bradford County. The facility will also include one (1) 402 bhp Cummins QSK19G lean burn, natural gas-fired generator engine equipped with a 2-way oxidation catalyst; one (1) 335 bhp Aggreko D146TIC rich burn generator engine equipped with a 3-way catalyst; liquid natural gas storage tanks; truck loading equipment; various fugitive emissions. If the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and the specifications of the application for Plan Approval 08-00052A, the applicant will subsequently apply for a State Only (Natural Minor) Operating Permit in accordance with 25 Pa. Code Subchapter F.

46-00279: West Laurel Hill Cemetery (215 Belmont Avenue, Bala Cynwyd, PA 19004) On April 14, 2015 for the initial issuance of a state only operating permit. The facility owns and operates a crematory unit, designated as Source ID 501. Facility-wide emissions for all criteria pollutants are below the threshold for major sources operating in the Philadelphia Metropolitan Area; therefore, the facility is classified as a Natural Minor. The renewal permit will include monitoring, recordkeeping, and reporting requirements designed to keep the facility within all applicable air quality requirements.

24-00146: National Fuel Gas Supply Corporation (6363 Main St., Williamsville, NY 14221) on April 7, 2015, renewed a State Only Operating Permit for the Boone Mountain Compressor Station located in Horton Township, Elk County. The facility is a Natural Minor. The primary sources at the facility include and two pipeline heaters with a combined rating of 1 million Btus/hr, two 150 hps compressor engines, a 280 hps compressor engine, and a 35 hps emergency generator, a dehydrator, and a 500,000 Btus/hr dehydrator reboiler. Potential Emissions are as follows: 71.60 tpy NOx, 10.35 tpy CO, 65.51 tpy PM, 1.59 tpy SOx, and 8.74 tpy VOC. The renewal permit contains emission restrictions, record-keeping, work practice, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

09-00064: CRC Industries, Inc. (885 Louis Drive, Warminster Township, Bucks County) On April 7, 2015 was amended to incorporate Plan Approval PA-09-0064A (to allow for an increase in volatile organic compounds (VOC) for the facility). The main emissions for this facility are VOC, of which the facility will be limited to less than 24.5 tons per year of emissions, and hazardous air pollutants, will remain at 10 tons per year for any single hazardous air pollutant and less than 25 tons per year for all of the hazardous air pollutants combined. The amended Operating Permit will contain monitoring, recordkeeping, and operating conditions designed to keep the facility operating within the allowable emissions and all applicable air quality requirements.

46-00001: JBS Souderton, Inc. (741 Souder Road, Souderton, PA 18964) On April 7, 2014 located in Fran-conia Township, Montgomery County, PA. The Title V facility is a meat-packing and rendering plant, which emits major levels of Nitrogen Oxides (NOx). The Minor Modification of Title V Operating Permit is issued under the Air Pollution Control Act (35 P. S. §§ 4001—4015) and 25 Pa. Code § 127.462. The modification addresses a change to the chemistry of the existing scrubbing system (Control Devices: C02—Batch Packed Tower 1, C03—Batch Packed Tower 2, C06—Continuous Packed Tower 1, C07—Continuous Packed Tower 2). The permit contains all applicable requirements including monitoring, recordkeeping and reporting. Sources at this facility are not subject to Compliance Assurance Monitoring (CAM) pursuant to 40 CFR Part 64 because the existing control devices are not used to reduce emissions for which the facility is major (NOx).

Permit No. 46-00035: Glaxosmithkline (709 Swede-land Road, Upper Merrion Township, Montgomery County) On February 2, 2015 submitted a Title V Operating Permit (TVOP) Minor Modification. The following changes were made to the permit:

 GSK voluntarily took a facility wide hazardous air pollutant (HAP) emission limit of 10 tons/year of a single HAP and 25 tons/year of combined HAP's both calculated on a 12-month rolling sum, in order to become an Area (Minor) HAP source. Removal of all Major Source Boiler MACT requirements codified in 40 CFR Part 63, Subpart DDDDD and replacing them with the Area Source Boiler MACT requirements codified in 40 CFR Part 63, Subpart JJJJJJ.

 The modified TVOP includes monitoring, recordkeeping, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.

09-0007C: Waste Management Disposal Services of Pennsylvania, Inc. (1000 New Ford Mill Road, Morrisville, PA 19067) On April 20, 2015 for a minor modification to plan approval 09-0007C for the Grows North Municipal Solid Waste Landfill located in located in Falls Township, Bucks County. The plan approval was modified in order to remove an operating hour restriction for two enclosed flares and to replace it with an equivalent heat input limitation. The plan approval was also modified to remove a requirement to conduct separate NOx testing at a maximum operating temperature of 1,800° F for these two flares since previous tests have already demonstrated compliance with NOx standards and that NOx emissions show no significant increases when operating at a maximum temperature. SPECIAL NOTICES

Water Quality Certification under Section 401 of the Federal Clean Water Act for the Columbia Gas Transmission—East Side Expansion Project

EA15-012—On November 1, 2013, Columbia Gas Transmission, LLC (Columbia) filed an application with the Federal Energy Regulatory Commission (FERC) in Docket No. CP14-17-000 under Section 7(b) and (c) of the Natural Gas Act (NGA) seeking a Certificate of Public Convenience and Necessity (Certificate) to authorize the abandonment, construction, and operation of the Columbia Gas East Side Expansion Project located in Pennsylvania and other states. The proposed facilities (a.k.a. Line 1278 Loop) would consist of approximately 9.5 miles of 26-inch-diameter natural gas pipeline between the existing Eagle Compressor Station in West Vincent Township, Chester County and the existing Downingtown Compressor Station in Downingtown Borough, Chester County.

 The pipeline facility is a single 9.5 mile loop that, to the extent practicable, will be co-located parallel to existing pipelines or other existing rights-of-way. The project also includes a launcher/receiver on each end of the loop and one mainline valve on the loop. Additionally, Columbia proposes to construct modifications and upgrades at the existing Eagle Compressor station. The Environmental Assessment prepared by FERC may be viewed on FERC's website at www.ferc.gov under the Docket No. CP14-17-000.

 The Pennsylvania Department of Environmental Protection (PADEP) certifies that the construction, operation and maintenance of the Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317).  1. Discharge Permit—Columbia shall obtain and comply with a PADEP National Pollutant Discharge Elimination System (NPDES) permit for the discharge of water from the hydrostatic testing of the pipeline pursuant to Pennsylvania's Clean Streams Law (35 P. S. §§ 691.1—691.1001) and all applicable implementing regulations (including 25 Pa. Code Chapter 92a).

 2. Erosion and Sediment Control Permit—Columbia shall comply with its Chapter 102 ESCGP-2 Permit, No. ESG0002914001, for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment issued pursuant to Pennsylvania's Clean Streams Law and Storm Water Management Act (32 P. S. §§ 680.1—680.17) and all applicable implementing regulations (including 25 Pa. Code Chapter 102).

 3. Water Obstruction and Encroachment Permit—Columbia shall comply with its Chapter 105 Water Obstruction and Encroachment Permit, No. E15-846, for the construction, operation and maintenance of all water obstructions and encroachments associated with the project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P. S. §§ 693.1—693.27), Flood Plain Management Act (32 P. S. §§ 679.101—679.601), and all applicable implementing regulations (including 25 Pa. Code Chapter 105).

 4. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that the receiving water quality is not adversely impacted by any operational or construction process that may be employed by Columbia.

 5. Operation—For each Project under this Certification, Columbia shall at all times properly operate and maintain all Project facilities and systems of treatment and control (and related appurtenances) which are installed to achieve compliance with the terms and conditions of this Certification and all required permits and approvals. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Columbia.

 6. Inspection—The Project, including all relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of PADEP to determine compliance with this Certification, including all required permits and approvals, Pennsylvania's Water Quality Standards, and the conditions of this Certification. A copy of this Certification shall be available for inspection by the PADEP during such inspections of the Project.

 7. Transfer of Project—If Columbia intends to transfer any legal or equitable interest in the Project which is subject to this Certification, Columbia shall serve a copy of this Certification upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the PADEP Southeast Regional Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owner containing a specific date for transfer of Certification responsibility, coverage, and liability between them.

 8. Correspondence—All correspondence with and submittals to PADEP concerning this Certification shall be addressed to the Department of Environmental Protection, Southeast Regional Office, Domenic Rocco, P.E., Waterways and Wetlands Program Manager, 2 East Main Street, Norristown, PA 19401.

 9. Reservation of Rights—PADEP may suspend or revoke this Certification if it determines that Columbia has not complied with the terms or conditions of this Certification. PADEP may require additional measures to achieve compliance with applicable law, subject to Columbia's applicable procedural and substantive rights.

 10. Other Laws—Nothing in this Certification shall be construed to preclude the institution of any legal action or relieve Columbia from any responsibilities, liabilities, or penalties established pursuant to any applicable federal or state law or regulation.

 11. Severability—The provisions of this Certification are severable and should any provision of this Certification be declared invalid or unenforceable, the remainder of the Certification shall not be affected thereby.

Environmental Assessment

Description: The Pennsylvania Infrastructure Investment Authority, which administers the Commonwealth's State Revolving Fund, is intended to be the funding source for this project. Bell & Evans proposes upgrades to their existing wastewater treatment plant to comply with more stringent NPDES discharge limits. The Department's review of the project and the information received in the Environmental Report for the project has not identified any significant, adverse environmental impact resulting from this proposal. The Department hereby approves the Environmental Assessment.
