Schedules of Controlled Substances;
Regulation No. 10-193 (#3099)On May 7, 2015, the Independent Regulatory Review Commission (Commission) received this regulation from the Department of Health (Department). This rulemaking amends 28 Pa. Code § 25.72. Notice of proposed rulemaking was omitted for this regulation; it will become effective upon publication in the Pennsylvania Bulletin.
This regulation redesignates the drug Clobazam from Schedule I to Schedule IV of controlled substances.
We have determined this regulation is consistent with the statutory authority of the Department (35 P. S. § 780-103(a)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Pennsylvania Liquor Control Board—
Conversion of Suspension to Fine;
Regulation No. 54-74 (#3026)On September 24, 2013, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Pennsylvania Liquor Control Board (Board). This rulemaking amends 40 Pa. Code § 7.10. The proposed regulation was published in the October 5, 2013 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on May 15, 2015.
This regulation increases the minimum amount of fines that may be imposed when the Board is asked to convert an unserved suspension into a fine in connection with a license transfer application.
We have determined this regulation is consistent with the statutory authority of the Board (47 P. S. §§ 2-207(i), 4-468(a)(4)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
