PUBLIC WATER SUPPLY PERMITS The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. Construction of a gravity sewer line from Nagle Road along Iroquois Avenue and East Lake Road to the City of Erie connection at Franklin Avenue is proposed. This will convey up to 5 MGD from the 5 Mile Pump Station service area south of Route 20. A second project consists of the construction of a new 6 Mile Pump Station with 0.75 million gallon of equalization storage capacity. Upon completion of these two projects, an evaluation of the need for upgrades to the 5 Mile Pump Station will be completed. Following the sanitary sewer overflow elimination projects, Harborcreek Township will initiate five sewer extensions. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.
NOTICE OF PROPOSED INTERIM RESPONSE UNDER THE HAZARDOUS SITES CLEANUP ACT
Former Erie Rail Yard Site
Susquehanna Depot Borough, Susquehanna County The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act, 35 P. S. § 6020.101 et seq. (HSCA), is proposing an interim response action at the Former Erie Rail Yard Site (Site). This response will be undertaken pursuant to Sections 505(b) and (c) of HSCA, 35 P. S. § 6020.505(b) and (c). The Site is located in Susquehanna Depot Borough, Susquehanna County, Pennsylvania.
The Site was used as a rail yard for over 125 years, from the 1840's through the 1960's as a major rail hub between Chicago and New York City. During the peak of operations, it covered about 40 acres, contained dozens of buildings and employed over 2,000 workers. Activities at the Site included engine and railcar repair, engine refueling, rail line service and repair, painting, foundry operations, and manufactured gas and oil production and processing. These processes used heavy metals as well as petroleum-based products and other contaminants of concern.
Rail demand declined between 1967 and 1972 due to the growth of air and truck transportation. The Erie Rail Yard, along with five other major U. S. railroads, went bankrupt. Eventually most of the buildings at the Site were razed or destroyed by fires. The Site now includes several commercial businesses, municipal government buildings, a municipal wastewater treatment plant, a railroad right-of-way, and a wooded area northwest of the railroad tracks.
The Department's investigation of the Site has determined that several heavy metals, including lead, antimony, and arsenic, are present in soils on Site in excess of applicable standards. Direct contact with the soils on Site, via dermal contact and/or direct ingestion, is the primary concern for the Site.
The Department considered four alternatives to address the threats at the Site: 1) no action; 2) environmental covenants and institutional controls; 3) soil excavation; and 4) surface barrier.
The Department has chosen the following actions because they are in compliance with applicable or relevant and appropriate requirements (ARARs) and are cost effective:
• Limited soil excavation upstream of the Veterans Memorial Bridge, in areas where soil samples showed the highest contamination;
• Installation and maintenance of a surface barrier of clean fill in contaminated areas; and
• Implementation of environmental covenants on several properties to restrict future land uses and remove the potential for harm to the implemented remedy.
This notice is being provided pursuant to Section 506(b) of HSCA. The Administrative Record, which contains the information that forms the basis and documents the selection of this response, is available for public review and comment at the Department's Northeast Regional Office, 2 Public Square, Wilkes-Barre, and at the Susquehanna Depot Borough Municipal Building, 83 Erie Boulevard, Susquehanna Depot. It is available for review at the Regional Office Monday through Friday from 8 a.m. to 4 p.m. and at the Borough Office Monday through Thursday from 8 a.m. to 4 p.m.
The Administrative Record will be open for comment through May 5, 2016. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The Baseline Environmental Report was approved by the Department on January 21, 2016.

1. As a soil additive or soil substitute;
2. As an agricultural liming material;
3. As a horticultural amendment;
4. As a fertilizer for utilization in normal farming operations or land applied on disturbed lands to facilitate re-vegetation for land reclamation purposes; or
5. As an ingredient or a component of the value-added topsoil material produced off-site provided that all requirements below are met.
a. There is market or disposition for the material;
b. The value-added material shall be transferred in good faith as a commodity in trade for use in lieu of a commercially available product; and
c. The processing (i.e., blending, combining) of value-added topsoil material is authorized under a separate municipal waste processing permit issued by the Department unless:
i. The amount of exceptional quality biosolids-derived material received for the production of value-added topsoil does not exceed 1,000 cubic yards;
ii. The finished value-added material produced and stored by the processing operation does not exceed 7,500 cubic yards; and
iii. The pre- and post-processing of value-added topsoil material is not accumulated speculatively.
The general permit was issued by Central Office on January 27, 2016.
