THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
APPLICATIONS FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications concern, but are not limited to, discharges regarding industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFO). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 Individual Permits and Individual Stormwater Construction Permits in Sections IV and VI, the Department, based upon preliminary reviews, has made tentative determinations of proposed effluent limitations and other terms and conditions for the permit applications. In accordance with 25 Pa. Code § 92a.32(d), the proposed discharge of stormwater associated with construction activities will be managed in accordance with the requirements of 25 Pa. Code Chapter 102. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the United States Environmental Protection Agency (EPA) Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).
Persons wishing to comment on NPDES applications are invited to submit statements to the contact office noted before the application within 30 days from the date of this public notice. Persons wishing to comment on WQM permit applications are invited to submit statements to the office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests for public hearings on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

The proposed effluent limits for the operation/activity include: Except for the chronic or catastrophic rainfall events defined as over the 25-year/24-hour rain storms, the CAFO general permit is a non-discharge NPDES permit. Where applicable, compliance with 40 CFR Federal effluent limitation guidelines is required. The general permit requires no other numeric effluent limitations and compliance with the Pennsylvania Nutrient Management Act and the Clean Stream Law constitutes compliance with the State narrative water quality standards.

PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.
Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907)
Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

This application is for the determination of applicability (DOA) under General Permit No. WMGR028SE007 for the beneficial use of asphalt plant baghouse fines at H&K Material Asphalt Plant (Naceville Materials JV Skunk Hollow Quarry) located at 300 Skunk Hollow Road, in Hilltown Township, Bucks County. The application for determination of applicability was accepted as administratively complete by the Southeast Regional Office on February 16, 2017.

AIR QUALITY
PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.
The Department received applications for Plan Approvals or Operating Permits from the following facilities.
Copies of the application, the Department's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate Department Regional Office. Appointments for scheduling a review must be made by calling the appropriate Department Regional Office. The address and phone number of the Regional Office is listed before the application notices.
Persons wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the Department's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.
A person wishing to request a hearing may do so during the 30-day comment period. A public hearing may be held, if the Department, in its discretion, decides that a hearing is warranted based on the information received. Persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper, the Pennsylvania Bulletin or by telephone, when the Department determines this type of notification is sufficient. Requests for a public hearing and any relevant information should be directed to the appropriate Department Regional Office.
Permits issued to the owners or operators of sources subject to 25 Pa. Code Chapter 127, Subchapter D or E, or located within a Title V facility or subject to 25 Pa. Code § 129.51(a) or permits issued for sources with limitations on their potential to emit used to avoid otherwise applicable Federal requirements may be submitted to the United States Environmental Protection Agency for review and approval as a revision to the State Implementation Plan. Final Plan Approvals and Operating Permits will contain terms and conditions to ensure that the sources are constructed and operating in compliance with applicable requirements in the Air Pollution Control Act (35 P.S. §§ 4001—4015), 25 Pa. Code Chapters 121—145, the Federal Clean Air Act (42 U.S.C.A. §§ 7401—7671q) and regulations adopted under the Federal Clean Air Act.

15-0086B: Darling Ingredients Inc. dba Bakery Feeds (97 Westbrook Drive, Honey Brook, PA 19344) for an increase in permitted carbon monoxide (CO) limits for its Rotary Dryer with BioMass Burner at an existing facility located in Honey Brook Township, Chester County. The increase is from 1.1 lb/hr and 4.8 tons per consecutive 12-month period to 2.2 lb/hr and 9.6 tons per consecutive 12-month rolling period. The company has requested the increase pursuant to stack testing results for its new replacement regenerative thermal oxidizer (RTO) (Model CCS&ES -35k scfm), which dominantly controls volatile organic compound (VOC) emissions from the dryer. Emissions limits are unchanged for the remainder of the pollutants regulated (nitrogen oxides, particulate matter and VOC). Only Statewide regulations are applicable.
The company will maintain the monitoring, recordkeeping and work practice conditions in its Operating Permit SMOP 15-00086 to assure optimum operation and minimization of pollutants.

06-05002N: Lehigh Cement Company, LLC (537 Evansville Road, Fleetwood, Pennsylvania 19522-8541) for the ability to combust anthracite at their facility in Maidencreek Township, Berks County. Plan Approval No. 06-05002N is for the authorization to combust anthracite as a fuel in the facility's two (2) long dry kilns (Source IDs 121 & 122). The facility will be permitted to combust up to 15 tons per hour anthracite in each kiln. The project does not include the installation of any new equipment nor will it increase the clinker production capacity of the kilns. The plan approval will contain emission limits, monitoring, recordkeeping & work practice standards designed to keep the facility operating within all applicable air quality requirements. Among other items, the conditions include provisions derived from 40 CFR 63, Subpart LLL—National Emission Standards for Hazardous Air Pollutants from the Portland Cement Manufacturing Industry. DEP's review of the information submitted by the applicant indicates that the air contamination sources as constructed or modified will comply with all regulatory requirements pertaining to air contamination sources and 127.12. Based on these findings, the Department proposes to issue a plan approval for the proposed project. If, after the project has been implemented, the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and the specification of the application for plan approval, the requirements established in the plan approval will be incorporated into the facility's Title V operating permit pursuant to the administrative amendment provisions of 25 Pa. Code § 127.450.
36-05015H: Dart Container Corporation of PA (60 East Main Street, Leola, PA 17540) for the construction of new extrusion and thermoforming lines and construction of new equipment for the recycling of consumer EPS scrap at the facility located in Upper Leacock Township, Lancaster County. The maximum expected emissions as a result of the project are: 31.1 TPY VOCs, 6.57 NOx; 0.50 TPY PM10/PM2.5; 5.52 TPY CO; and 0.04 TPY SO2. The facility is a Title V facility. The Department's review of the information submitted by the applicant indicates that the air contamination source as constructed or modified will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology (BAT) requirements of 25 Pa. Code §§ 127.1 and 127.12, and the New Source Review requirements of 25 Pa. Code §§ 127.201—127.210. As part of this approval the facility will reduce their allowable emissions from printing operations associated with Source ID # 106, # 107, and # 109A from 17.5 TPY of VOCs to 15.0 TPY. Based on these findings, the Department proposes to issue a plan approval for the proposed construction. If, after the project has been implemented, the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and the specifications of the application for plan approval, the requirements established in the plan approval may be included in the facility's Title V Operating Permit pursuant to the provisions of 25 Pa. Code §§ 127.441 and 127.443.
The plan approval will also contain the following provisions regarding emission reduction credits:
Condition 001:
(a) Pursuant to 25 Pa. Code §§ 127.205(4) and 127.210, the permittee shall offset the VOC potential-to-emit (PTE) of the sources addressed by this plan approval at an emissions offset ratio of 1.15:1 for VOC (flue emissions), and 1.3:1 for VOC (fugitive emissions).
(b) The permittee shall not operate any of the above Group G13 sources until the required ERCs are provided to and processed through the ERC Registry in accordance with 25 Pa. Code § 127.206(d) and the Department certifies and registers the required emissions reductions.
(c) The permittee shall obtain the following VOC ERCs based on the facility's VOC PTE of the Group G13 sources and using the emissions offset ratios described in part (a), above:
(1) VOCs = 80.7 tpy
(d) If the amount of required ERCs increases, the company shall secure emission offsets according to a schedule determined by the Department.
(e) The ERCs shall be obtained in accordance with the requirements of 25 Pa. Code § 127.208.
Condition 001:
(1) In accordance with 25 Pa. Code § 127.208(2), the Department authorizes the transfer and use of 17.0 TPY of VOC emission reduction credits (ERCs) for offset purposes from AES Beaver Valley, LLC to Dart Container Corporation of PA. The 17.0 TPY of VOC ERCs previously registered to AES Beaver Valley, LLC were generated from the shutdown of a sources # 032, # 033, # 034, & # 035 from the Cogen Plant in Potter Township, Beaver County, Pennsylvania, on June 30, 2015. The Department certified and registered the 17.0 TPY of VOC ERCs on August 29, 2016.
(2) In accordance with 25 Pa. Code § 127.208(2), the Department authorizes the transfer and use of 44.0 TPY of VOC ERCs for offset purposes from Quad Graphics, Inc. (QGI) to Dart Container Corporation of PA. Of the 44.0 Tons of VOC ERCs, 30.11 tons were generated from the shutdown of sources at the QGI facility located in East Greenville, PA in Montgomery County on January 3, 2016, and 13.89 tons were generated from the shutdown of sources at the QGI facility located in Atglen, PA in Chester County on March 4, 2016. The Department certified and registered the ERCs on February 7, 2017.
(3) In accordance with 25 Pa. Code § 127.208(2), the Department authorizes the transfer and internal use of 20.0 TPY of VOC emission reduction credits (ERCs) that were generated by Dart Container Corporation of PA. The 20.0 TPY of VOC ERCs were generated from the over control of emissions from a four color flexographic press (Source ID # 110) at the Leola facility in Upper Leacock Township, Lancaster County, PA, on October 15, 1999. The Department certified and registered the 20.0 TPY of VOC ERCs on April 17, 2002.
(4) The offsetting VOC ERCs are approved for use by Dart Container Corporation of PA to comply with the Section E (Group G13), Condition # 001, above. This approval is in accordance with the requirements of 25 Pa. Code Chapter 127, Subpart E (relating to New Source Review) including 25 Pa. Code §§ 127.205(4) and 127.210.
(5) In accordance with 25 Pa. Code § 127.208(2), the VOC ERCs described in parts (1), and (2), above, are no longer subject to the 10-year expiration date under 25 Pa. Code § 127.206(f) except as specified in 25 Pa. Code § 127.206(g). If any of the VOC ERCs described in paragraph (1) or (2) above, are not used and are subsequently re-entered into the ERC Registry System, the applicable 10-year expiration date will not be extended.
