FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

The path will also cross over the Neshaminy Creek on the existing Bristol Road Bridge and the Upper State Road Bridge.
The site is located between Neshaminy Greenway Trail—Lenape Lane to Upper State Road (USGS Doylestown, PA Quadrangle Latitude 40.285193; Longitude -75.188861).

To construct and maintain approximately 6,750 feet-long shared use path along the Paoli Pike partially within the floodway/floodplain of the UNT to Ridley Creek (HQ-TSF, MF) associated with the Paoli Pike Shared Use Path Project. The pedestrian path will also cross over the UNT to Ridley Creek on the existing Paoli Pike Bridge.
The site is located around the existing Paoli Pike Bridge (USGS West Chester, PA Quadrangle Latitude 39.992470; Longitude -75.547408).
EA15-021. Pulte Homes of PA, Applecross County Club, 54 Mulligan Court, Downingtown, PA 19335, East Brandywine Township, Chester County, ACOE Philadelphia District. To remove a farm road culvert along approximately 70 linear feet of a UNT to Beaver Creek (Perennial, CWF, MF).
The site is located near the intersection of Bondsville Road and Locks Farm Lane in East Brandywine Township, Chester County (Wagontown, PA USGS Quadrangles, Latitude 40.028860 N"; Longitude −75.764356 W").
E46-1167. Pennsylvania Department of Transportation Engineering District 6-0, 7000 Geerdes Blvd., King of Prussia, Lower Gwynedd, Upper Gwynedd and Whitpain Townships, Montgomery County, ACOE Philadelphia District.
The Pennsylvania Department of Transportation (PennDOT) is proposing to perform the following listed water obstruction and encroachment activities with associated SR 0202, Section 65S Roadway Widening and Bridge Replacement Project:
1) To place and maintain fill within the floodway of an unnamed tributary to Wissahickon Creek (WC2—TSF, MF) associated with roadway widening, construction of a stormwater facility, construction of two (2) 24-inch outfalls and the replacement of a 36-inch RCP culvert with a 30-inch RCP culvert resulting in 9,278 square feet (0.213 acre) of permanent floodway impact and 1,742 square feet (0.040 acre) of temporary floodway impact. This activity also includes the permanent placement of riprap rock apron at two locations with permanent impacts of 47 linear feet (472 square feet) and 9 linear feet (33 square feet) within the watercourse.
2) To place and maintain fill within the floodway of an unnamed tributary to Wissahickon Creek (WC3—TSF, MF) associated with roadway widening and the construction of a 30-inch stormwater outfall resulting in 828 square feet (0.019 acre) of permanent floodway impact and 1,742 square feet (0.040 acre) of temporary floodway impact. This activity also includes the permanent placement of 24 linear feet (231 square feet) of riprap rock apron within the watercourse.
3) To place and maintain fill within wetland (W10a—POW) associated with roadway widening, construction of two (2) 12-inch HDPE stormwater outfalls and permanent placement of riprap rock apron resulting in 3,964 square feet (0.09 acre) of permanent wetland impact and 2,614 square feet (0.06 acre) of temporary impact.
4) To relocate a wetland (W10b—PFO) associated with placing fill for roadway widening within a portion of a wetland (W10b) resulting in temporary wetland impacts of 2,614 square feet (0.06 acre).
5) To remove the existing 23.83-foot and 17.26-foot double-arch stone bridge and in its place, construct and maintain a 74.25-foot single span composite pre-stressed concrete spread box beam bridge resulting in 230 linear feet (13,300 square feet, 0.305 acre) of permanent floodway impact and 132 linear feet (6,186 square feet, 0.142 acre) of temporary floodway impact.
6) To place two (2) cofferdams to facilitate the removal of the existing abutments resulting in temporary impacts of 115 linear feet (3,417 square feet).
7) To place fill within the floodplain of the Wissahickon Creek associated with roadway widening, bridge replacement and channel (W10b) relocation resulting in 35,763 square feet (0.821 acre) of permanent floodplain impact and 9,926 square feet (0.221 acre) of temporary floodplain impact.
8) To relocate 95 linear feet (1,287 square feet) an unnamed tributary to Wissahickon Creek (WC7—TSF, MF) and reconstruct and maintain an existing headwall for a 72-inch by 48-inch box culvert resulting in permanent floodway impacts of 4,134 square feet (0.095 acre) and 828 square feet (0.019 acre) of temporary floodway impacts. This activity also includes the permanent placement of 22 linear feet (215 square feet) of riprap rock apron within the watercourse.
9) To place and maintain fill within the floodway of an unnamed tributary to Wissahickon Creek (TSF, MF) to facilitate drainage for a roadside channel and the permanent placement of riprap rock apron within an unnamed tributary to Wissahickon Creek (WC9—TSF, MF) resulting in 10 linear feet (305 square feet, 0.007 acre) of permanent impact with no temporary impacts.
10) To place and maintain riprap rock apron at the end wall of an existing 18-inch RCP culvert resulting in 8 linear feet (84 square feet) of permanent impact within an unnamed tributary to Wissahickon Creek (W9c—TSF, MF) and permanent floodway impact of 174 square feet (0.004 acre).
11) To place and maintain fill within the floodway of an unnamed tributary to Wissahickon Creek (WC9 —TSF, MF) associated with roadway widening and the construction of a stormwater facility resulting in 3,920 square feet (0.090 acre) of permanent impacts and 828 square feet (0.019 acre) of temporary impacts. This activity also includes the permanent placement of riprap rock apron at two locations with permanent impacts of 10 linear feet (52 square feet) and 12 linear feet (58 square feet) within the watercourse.
12) To place and maintain fill within an isolated wetland (W5—PFO) associated with roadway widening resulting in 4,879 square feet (0.11 acre) of permanent wetland impacts.
13) To place and maintain fill within an isolated wetland (W6—PSS) associated with roadway widening resulting in 1,307 square feet (0.03 acre) of permanent wetland impacts.
14) To mitigate for permanent stream and wetland impacts associated with SR 0202 Section 65S in addition to Sections 61S and 61N at Prophecy Creek Wetland Mitigation Site along Morris Road and breach dam removal located within the Wissahickon Creek. Both mitigation sites are located within Upper Dublin Township.
The proposed project will have 417 linear feet (5,488 square feet) of permanent waterway impact, 115 linear feet (3,417 square feet) of temporary waterway impact and 15,247 square feet (0.35 acre) of permanent wetland impacts. A total of 3,903 cubic yards of fill is proposed.
Construction on the project is anticipated to commence in the Spring of 2019 and is located between Morris Rd. and Swedesford Rd. in Lower Gwynedd, Upper Gwynedd and Whitpain Townships.
E23-544. Hueber Launch Services, 45 E. Delaware Avenue, Marcus Hook, PA 19061, Marcus Hook Borough, Delaware County, ACOE Philadelphia District.
Hueber Launch Services is proposing to perform the following water obstruction and encroachment activity within the Delaware River (WWF):
1. To maintain the existing 250-foot by 35-foot Huebner Boat dock including maintenance dredging.
2. To perform mechanical dredging for the existing boat slip to 9 feet below Mean Diurnal Tide Level and place riprap revetment
3. To stockpile dredged materials in a dewatering zone that consists of either stacked sand bags or jersey barriers. Dewatering zone also includes the installation of an impervious liner to allow for materials to dry prior to on-site disposal.
Project is located adjacent to Municipal Park near E. Delaware St. and Church St. in Marcus Hook Borough. (Marcus Hook, PA USGS Quadrangle—Latitude 39.812821 N, Longitude 75.410078 W).
E15-899. Pennsylvania Department of Transportation Engineering District 6-0, 7000 Geerdes Boulevard, King of Prussia, PA 19406, Newlin Township, Chester County, ACOE Philadelphia District.
The Pennsylvania Department of Transportation (PennDOT) is proposing to perform the following listed water obstruction and encroachment activities associated with the SR 3095, Section BCR Brandywine Creek Road Slope Stabilization Project:
1) To place and maintain riprap rock channels in three (3) locations along the West Branch of the Brandy Wine Creek (WWF) associated with the construction of three (3) roadway drainage outfalls resulting in a total of 433 square feet of permanent floodway impact and 448 square feet of temporary floodway impacts. Stream impacts associated with this activity also include 30.2 linear feet (286 square feet) of permanent stream impact and 16 linear feet (274 square feet) of temporary stream impact.
2) To stabilize, protect and maintain rock slope stream bank protection and a series of rock vanes along and within the West Branch of the Brandy Wine Creek (WWF) resulting in 9,900 square feet of permanent floodway impacts and 16,053 square feet of temporary floodway impacts. Stream impacts associated with this activity include 345.35 linear feet (6,427 square feet) of permanent stream impacts and 471.15 linear feet (11,803 square feet) of temporary stream impacts.
The project is located on Brandywine Creek Road south of Harvey's Bridge Road in Newlin Township, Chester County; (USGS PA Coatesville; Unionville Quadrangle—Latitude 39.931968 N, Longitude 75.747761 W).
E15-900. Township of Kennett, 801 Burrows Run Road, Chadds Ford, PA 19317, Kennett Square Township, Chester County, ACOE Philadelphia District.
To construct and maintain a single span steel bridge across West Branch of Red Clay Creek (TSF, MF) having an approximate waterway opening of 43.32 feet wide by 3.2 feet high and measuring approximately 18.99 feet in length associated with the Rehabilitation of Chandler Mill Road Bridge. The site is located Chandler Mill Road over West Branch Red Clay Creek (Kennett Square Lat. 39° 48` 41"; Long. -75° 42` 48").

To construct and maintain a 6-foot long, 6-foot wide, and 5-foot high bulk water loading station on a concrete slab, gravel parking at grade, and fencing in the floodplain of the Juniata River (WWF, MF). The project is located within Huntingdon Borough off Ice Plant Road approximately 1-mile northwest of the intersection with S.R. 0026 and 4th Street; (Latitude: 40° 29` 13.9", Longitude: -78° 01` 9.7") in Huntingdon Borough, Huntingdon County. The purpose of the project is to construct a dog park on Huntingdon Borough Property. The permittee is not impacting wetlands, streams, or floodways on site.

The applicant proposes to:
Place and maintain fill in 1,279 linear feet of Tributary 36925 to Brush Run for the purpose of constructing a new 294,000 square foot high school. Permanent stream impacts will include 171 linear feet for the placement of a new culvert, 1,025 linear feet for the replacement of an existing culvert, and 83 linear feet for the placement of a culvert for a road crossing. Temporary stream impacts include 80 linear feet for the placement of a new culvert, and 40 linear feet for the placement of a new culvert for a road crossing.
The project site is located at the intersection of Center Church Road and East McMurray Road, Bridgeville, PA USGS topographic quadrangle; N: 40°, 16`, 39.45"; W: -80°, 06`, 16.44"; Sub-basin 20F; USACE Pittsburgh District), in Peters Township, Washington County.

Applicant proposes to extend natural gas, water, and sewer pipelines to service future development within the Jefferson County Business Park. Installation of the utility lines involves crossings of 2 EV wetlands resulting in temporary impacts of 0.0395 acre. Impacted wetlands will be restored upon completion of construction.
E43-368, Tri-County Industries. CNG Fueling Station, in Pine Township, Mercer County, ACOE Pittsburgh District (Mercer, PA Quadrangle N: 40°, 33`, 57.70"; W: -79°, 51`, 23.23").
The applicant proposes to construct a CNG fueling station located on the Tri County Waste Transfer Station property. The applicant will permanently fill 0.57 acre of an old mining pond, and temporarily impact an additional 0.48 acre of the mining pond during construction activities.

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.
Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service at (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483.
