LAND RECYCLING AND ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995
PREAMBLE 1
Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).
Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.
For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office listed before the notice. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Fred Diehl, Bluestone Environmental, Inc., 196 Beach Lake Highway, Honesdale, PA 18431 on behalf of Laura Sperratore, Sperr's Fuel and Heating Company, 421 Smith Bridge Road, Suite 2, Glen Mills, PA 19342 submitted a Notice of Intent to Remediate. The site was found to be contaminated with heating oil which impacted soil under the basement floor. The proposed future use of the property will be an active residence. The Notice of Intent to Remediate was published in The News & Press Newspaper of Delaware County on August 22, 2018.

Colleen Costello, GHD Services, Inc., 1140 Welsh Road, Suite 120, North Wales, PA 19454 on behalf of Tom Estock, Quad/Graphics, Inc., N61 W23044 Harry's Way, Sussex, WI 53089-3995 submitted a Notice of Intent to Remediate. The site has been found to be contaminated with toluene, benzene, trichloroethylene, arsenic, chromium, and lead which is suspected to have contaminated groundwater on the site. The proposed future use of the property will be non-residential use. The Notice of Intent to Remediate was published in The Chester County Press on August 24, 2018.

The site has been found to be impacted with PAHs, PCBs, pesticides, lead and other metals in the soil on the site. A release of petroleum occurred at the site with impacted to site shallow soil. The current and proposed use of the Shup and Bergery site is residential. Natalie Griffith, REPSG, Inc., 6901 Kingsessing Avenue, Suite 201, Philadelphia, PA 19142 on behalf of Stephen Giannascoli, Triad Realty, Inc., 306 South Street, Philadelphia, PA 19147 submitted a Notice of Intent to Remediate. A site investigation identified the presence of fuel oil No. 2/4/5/6 and unleaded gasoline in soil and groundwater. The Notice of Intent to Remediate was published in The Philadelphia Daily News on August 23, 2018.

The site is a commercial property formerly occupied by Yale Electric Business. The Notice of Intent to Remediate was published in the Times Chronicle/Public Spirit on August 26, 2018.
MUNICIPAL WASTE GENERAL PERMITS
Application(s) Received Under the Solid Waste Management Act (35 P.S. §§ 6018.101—6018.1003); the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P.S. §§ 4000.101—4000.1904); and Residual Waste Regulations for a General Permit to Operate Residual Waste Processing Facilities and the Beneficial Use of Residual Waste other than Coal Ash.

General Permit Application No. WMGM042SC001 and General Permit No. WMGM042 Base. Reinford Farms, Inc., 505 Cedar Grove Road, Mifflintown, PA 17059. The application submitted by Reinford Farms requests a major modification to the base General Permit No. WMGM042, as well as Reinford Farm's coverage under the general permit, WMGM042SC001.
General Permit No. WMGM042 authorizes the processing of animal manure mixed with grease trap waste, pre- and post-consumer food waste from commercial and institutional establishments by anaerobic digestion on a farm and the beneficial use of the following:
(1) Methane gas produced by the anaerobic digestion for use as fuel, including in the production of electricity;
(2) Waste solids removed from the digester as animal bedding material at the farm; and
(3) Liquid waste and solids removed from the digester as a soil additive for agricultural purposes.
The proposed modifications would add the processing of packaged food waste using a de-packaging machine to separate the packaging from the food waste to the base general permit. Reinford Farms is also proposing to modify its coverage under WMGM042SC001 to add a second anaerobic digester that would operate in conjunction with the existing anaerobic digester. The application was determined to be administratively complete on October 4, 2018.

AIR QUALITY
PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.
The Department received applications for Plan Approvals or Operating Permits from the following facilities.
Copies of the application, the Department's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate Department Regional Office. Appointments for scheduling a review must be made by calling the appropriate Department Regional Office. The address and phone number of the Regional Office is listed before the application notices.
Persons wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the Department's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.
A person wishing to request a hearing may do so during the 30-day comment period. A public hearing may be held, if the Department, in its discretion, decides that a hearing is warranted based on the information received. Persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper, the Pennsylvania Bulletin or by telephone, when the Department determines this type of notification is sufficient. Requests for a public hearing and any relevant information should be directed to the appropriate Department Regional Office.
Permits issued to the owners or operators of sources subject to 25 Pa. Code Chapter 127, Subchapter D or E, or located within a Title V facility or subject to 25 Pa. Code § 129.51(a) or permits issued for sources with limitations on their potential to emit used to avoid otherwise applicable Federal requirements may be submitted to the United States Environmental Protection Agency for review and approval as a revision to the State Implementation Plan. Final Plan Approvals and Operating Permits will contain terms and conditions to ensure that the sources are constructed and operating in compliance with applicable requirements in the Air Pollution Control Act (35 P.S. §§ 4001—4015), 25 Pa. Code Chapters 121—145, the Federal Clean Air Act (42 U.S.C.A. §§ 7401—7671q) and regulations adopted under the Federal Clean Air Act.

Intent to Issue Plan Approvals and Intent to Issue or Amend Operating Permits under the Air Pollution Control Act (35 P.S. §§ 4001—4015) and 25 Pa. Code Chapter 127, Subchapter B. These actions may include the administrative amendments of an associated operating permit.

46-0026J: Global Packaging Inc. (209 Bower Avenue, Oaks, PA 19456) to install and operate one (1) ten-station flexographic printing press, with the VOC-laden eshaust routed through a permanent total enclosure to one of the two permitted regenerative thermal oxidizers at an existing State-Only facility located in Upper Providence Township, Montgomery County. The project does not trigger applicability toward the Federal PSD regulation or the Department's NSR regulation. The potential emissions increase (in tons per year) from this project will be as follows: NOx—0.44; VOC—8.8; PM/PM10/PM2.5—0.04; CO—0.39; SO20.004; and HAPs0.17. The plan approval will include monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.
23-0225: Adelphia Pipeline Company, LLC (1111 West Ridge Road, Linwood, PA 19061) for the construction and operation of a new natural gas compressor station (with a design throughput of 250 million cubic feet per day) at its Marcus Hook facility, which is located in Lower Chichester Township, Delaware County. The main air pollutant emission sources at the facility will include three natural gas-fired reciprocating compressor engines, one natural gas-fired emergency generator, and miscellaneous sources of fugitive emissions (i.e., pigging chambers, small storage tanks, connectors, flanges, valves, etc.). The proposed emissions of carbon monoxide (CO), formaldehyde (HCHO), hazardous air pollutants (HAPs), nitrogen oxides (NOx), and volatile organic compounds (VOCs) from the facility are as follows:
• CO: 10.78 tons/yr
• HCHO: 2.22 tons/yr
• HAPs: 5.92 tons/yr
• NOx: 17.07 tons/yr
• VOCs: 16.69 tons/yr
As these emission rates are less than the major facility thresholds for the Southeast Pennsylvania air basin (i.e., 100 tons/yr for CO; 25 tons/yr for total HAPs, NOx, and VOCs; 10 tons/yr for an individual HAP), the facility will be considered a non-Title V facility.
The facility is subject to the Standards of Performance for New Stationary Sources (NSPS) for Stationary Spark Ignition Internal Combustion Engines [40 CFR Part 60, Subpart JJJJ] and Crude Oil and Natural Gas Facilities for which Construction, Modification, or Reconstruction Commenced after September 18, 2015 [40 CFR Part 60, Subpart OOOOa]. In addition, the compressor engines are subject to the additional NOx requirements specified in 25 Pa. Code §§ 129.203—129.205. The plan approval will include monitoring, recordkeeping, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.
A public comment period, beginning November 3, 2018, and ending December 14, 2018, will exist for the submission of written comments, suggestions, objections, or other information regarding the proposed Plan Approval. Pursuant to 25 Pa. Code §§ 127.44, 127.45 and 127.48, the Pennsylvania Department of Environmental Protection (DEP) will hold a public hearing on Tuesday, December 4, 2018, at the Lower Chichester Township Municipal Building, 1410 Market Street, Linwood, PA 19061, from 7:00—9:00 p.m. The public hearing will be held to receive oral and written testimony regarding DEP's intent to issue Air Quality Plan Approval No. 23-0225. All comments, whether submitted to DEP in writing or delivered orally at the hearing, shall merit equal consideration.

The proposed emissions of carbon monoxide (CO), formaldehyde (HCHO), hazardous air pollutants (HAPs), nitrogen oxides (NOx), and volatile organic compounds (VOCs) from the facility are as follows:

As these emission rates are less than the major facility thresholds for the Southeast Pennsylvania air basin (i.e., 100 tons/yr for CO; 25 tons/yr for total HAPs, NOx, and VOCs; 10 tons/yr for an individual HAP), the facility will be considered a non-Title V facility.
The facility is subject to the Standards of Performance for New Stationary Sources (NSPS) for Stationary Spark Ignition Internal Combustion Engines [40 CFR Part 60, Subpart JJJJ] and Crude Oil and Natural Gas Facilities for which Construction, Modification, or Reconstruction Commenced after September 18, 2015 [40 CFR Part 60, Subpart OOOOa]. In addition, the compressor engines are subject to the additional NOx requirements specified in 25 Pa. Code §§ 129.203—129.205. The plan approval will include monitoring, recordkeeping, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.

06-05040D: Approval of a Reasonably Available Control Technology 2 (RACT 2) plan, as a plan approval, for the East Penn Manufacturing Co., Inc. smelter facility, located in Richmond Township, Berks County.
In accordance with 25 Pa. Code §§ 129.91—129.100, the Pennsylvania Department of Environmental Protection has made a preliminary determination to approve a RACT 2 plan, as a plan approval, to be submitted as part of the State Implementation Plan (SIP) for the East Penn Manufacturing Company, Inc. smelter facility. The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the RACT 2 approval for the facility, which are intended to satisfy the requirements for the 1997 National Ambient Air Quality Standard (NAAQS) and the 2008 NAAQS for ozone.
The proposed RACT 2 plan, if approved by DEP, will be issued as a plan approval (06-05040D). The relevant RACT 2 requirements will also be submitted to the U.S. Environmental Protection Agency (EPA) for approval and incorporation into Pennsylvania's State Implementation Plan. Requirements that are not part of the RACT 2 approval will be excluded from the SIP submittal.
The following is a summary of the proposed RACT 2 requirements for this facility that will be submitted to the EPA as part of the SIP:
RACT 2 Case-by-Case Requirements
I. Sources 101/108
a. By no later than three years after issuance of Plan Approval No. 06-05040D, East Penn shall implement combustion system modifications to Sources 101/108 as proposed in its Alternative RACT and Compliance Proposal dated 10/24/16, and as clarified in its RACT Response Letter dated 1/5/18.
b. The current NOx limits in Title V Operating Permit 06-05040, Source Group SG01, Conditions # 002 and # 005 shall remain in effect until the limits in c. below become effective.
c. For the combined exhaust of Sources 101 and 108, the permittee shall limit emissions to the following, once the modifications in a. have been completed:
1. 0.6 lb NOx/MMBtu of heat input on a 30-day rolling average
2. 71.42 tons of NOx for any rolling consecutive 12-month period
d. The permittee shall limit the emissions from the furnaces to the following:
1. Total Hydrocarbons—20 ppmv as propane at 4% carbon dioxide (both furnaces)
2. Total Hydrocarbons—360 ppmv as propane at 4% carbon dioxide (blast furnace only)
3. Total Hydrocarbons—20 ppmv as propane at 4% carbon dioxide (reverberatory furnace only)
4. Volatile Organic Compounds (VOC)—28.61 tons
e. The permittee shall pass the exhaust of both furnaces through the afterburner.
f. Source 101/108 shall not exceed 7,680 hours of operation during any consecutive 12-month period (rolling basis). The hours of operation shall be recorded.
g. The permittee shall comply with the requirements of 40 CFR Part 63, Subpart X—National Emission Standards for Hazardous Air Pollutants from Secondary Lead Smelting, with regard to total hydrocarbon emissions, controls, testing, monitoring, recordkeeping, reporting and work practices.
h. The permittee shall conduct an initial source test for NOx and VOC on the combined exhaust of Sources 101/108 within 180 days of the first operation of the sources following the modifications described in a.
i. After the initial source test in d. has been completed, source tests for NOx and VOC shall be conducted once in each 5-year calendar period. Unless otherwise approved in writing by DEP, emission testing for VOC shall be conducted using EPA Methods 1—4, 18 and 25A, and the Method 25A results shall be corrected for non-VOC hydrocarbons using Method 18. Emission testing for NOx shall also be done using EPA methods.
j. The permittee shall monthly calculate and record the total NOx emissions from Sources 101/108 for the most recent 12-month period, based on stack test results or other methods approved by the Department.
k. The permittee shall employ good combustion practices when operating Source IDs 101 and 108 to limit NOx and VOC emissions.
l. The permittee shall keep records to demonstrate compliance with 25 Pa. Code §§ 129.96—129.100. In accordance with 25 Pa. Code § 129.100(i), the records shall be retained by the permittee for 5 years and made available to the Department upon receipt of a written request from the Department.
II. Source 115
a. Source 115 includes but is not limited to VOC emissions from miscellaneous chemicals like epoxy resin, spray painting with rattle cans and other painting. The permittee shall meet RACT 2 requirements for Source 115 by complying with the following:
1. Engaging in good operating practices to limit VOC emissions. Good operating practices include methods such as proper employee training, standard operating procedures, periodic inspections, good housekeeping and monitoring and recordkeeping.
2. VOC emissions from Source 115 shall not exceed 5 tons in any 12-month rolling period.

07-05003E: Norfolk Southern Railway, Co. (200 N. 4th Avenue, Altoona, PA 16601) for the construction and temporary operation of a new 2,500 kW (3,674 BHP) diesel fired emergency generator and associated 5,100 gallon—aboveground diesel storage tank at the Juniata Locomotive Shop facility located in Logan Township, Blair County. The expected increase in facility emissions as a result of the changes proposed are: 9.02 tons per year of NOx; 1.36 ton per year of CO; 1.00 ton per year of VOCs; and less than one ton each of SO2, PM and combined HAPs. The facility is a Title V facility. DEP's review of the information submitted by the applicant indicates that the air contamination sources as constructed or modified will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirement (BAT) of 25 Pa. Code §§ 127.1 and 127.12, and 40 CFR Part 60, Subpart IIII—Standards of Performance for Stationary Compression Ignition Internal Combustion Engines. Based on these findings, the Department proposes to issue a plan approval for the proposed construction. If, after the project has been implemented, the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and the specification of the application for plan approval, the requirements established in the plan approval will be incorporated into an Operating Permit pursuant to the administrative amendment provisions of 25 Pa. Code § 127.450.
28-03068A: Pennsylvania Cherry, LLC (P.O. Box 269, Mercersburg, PA 17236) for the installation of a lumber processing facility, located in Montgomery and Peters Townships, Franklin County. The Plan Approval will authorize to install a wood fired boiler controlled by an electrostatic precipitator, and lumber trimming and grinding operations controlled by cyclone separators. Maximum emissions from the operation are estimated at 64.61 tons CO; 24.41 tons NOx; 7.89 tons PM; 6.73 tons PM-10; 6.13 tons PM-2.5; 2.67 tons SOx; 8.16 tons VOC; and 3.93 tons HAP. The facility is a State-only facility. DEP's review of the information submitted by the applicant indicates that the air contamination sources as constructed or modified will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirement (BAT) of 25 Pa. Code §§ 127.1 and 127.12. Based on these findings, the Department proposes to issue a plan approval for the proposed construction. Title V Operating Permit No. 46-00035 is being split into three (3) separate Title V facilities due to a change in ownership with portions of the existing plant. This specific permit is for the East location. The facility remains as a major source for Nitrogen Oxide (NOx) emissions and an area source for Volatile Organic Compound (VOC) emissions and Hazardous Air Pollutants (HAP). All three (3) sites will be aggregated for New Source review (NSR) and Prevention for significant Deterioration (PSD) purposes only. The requirements of 25 Pa. Code §§ 129.96—129.100 do not apply to sources at GSK; facility-wide potential to emit NOx emissions are restricted to less than 100 tons per year and facility-wide potential to emit VOC emissions is less than 25 tons per year.
There are no new sources at this facility. The sources addressed in this permit are three (3) Cleaver Brooks boilers located in Building 3 fire natural gas as the primary fuel and No. 6 fuel oil as the secondary fuel, and several engines that fire non-road No. 2 fuel oil. The sources at this facility are not subject to Compliance Assurance Monitoring (CAM) pursuant to 40 CFR Part 64 because there are no control devices on the sources at this facility. The source is not a major source for Greenhouse Gases (GHG).
The permit contains all applicable requirements including monitoring, recordkeeping and reporting.

The facility is currently operating under State Only ''Synthetic Minor'' Operating Permit 55-00012. The facility's main sources include sanding and milling equipment as well as a coating operation. The facility has potential emissions of 16.9 tons per year (TPY) of particulate matter, 4.5 TPY of nitrogen oxides, 2.7 TPY of carbon monoxide, 3.8 TPY of sulfur oxides, 49.9 TPY of volatile organic compounds, 24.9 TPY of hazardous air pollutants, and 5,229 TPY of greenhouse gases (carbon dioxide equivalents). No emission or equipment changes are being proposed by this action. The emission limits and work practice standards along with monitoring, record keeping and reporting requirements have been included in the operating permit to ensure the facility complies with all applicable Federal and State air quality regulations. These operating permit conditions have been derived from the applicable requirements of 25 Pa. Code Chapters 121—145, including section 129.52 pertaining to surface coating processes and sections 129.101—129.107 pertaining to wood furniture manufacturing operations. Code §§ 127.424, 127.425 and 127.521, the Department of Environmental Protection (DEP) is providing notice that it intends to issue a renewal State Only Operating Permit (SOOP-65-00914) to Preform Specialties Inc. to authorize the continued operation of manufacturing of high-strength tungsten carbide preforms at their Powder Processing Plant located in Derry Township, Westmoreland County.
The facility's main sources and controls include; three (3) attritors, two (2) vacuum dryers, two (2) hammer mills, seventeen (17) wet grinders, one (1) dry grinder, two (2) extrudes, sixteen (16) 55-gallon heptane drums, one (1) boiler rated at 0.2 MMBtu/hr, one (1) small part washer, and one (1) chiller to capture heptane. Emissions from the facility are controlled by twenty-five (25) Torit dust collectors each rated at 500 scfm, and one (1) Torit Dryflo DM6 oil mister collector rated at 8,800 scfm.
This facility has the potential to emit the following type and quantity of air contaminants (on an annual basis): 47.0 tons of VOC, 4.0 tons of PM10, and 1.5 ton of HAP. NOx emission from the boiler rated at 0.2 MMBtu/hr is negligible and not included. The emission restriction, testing, monitoring, recordkeeping, reporting and work practice conditions of the operating permit have been derived from the applicable requirements of 25 Pa. Code Chapters 121—145.

43-00309: Bucks Fabricating, Inc. (3547 Perry Hwy., Hadley, PA 16130), the Department intends to issue the renewal of the State-Only Operating Permit of a facility that manufactures detachable work truck bodies and roll-off containers located in Sandy Creek Township, Mercer County. Permitted sources at the facility include two paint booths, two dryers, hand-wiping operations, paint mixing and spray gun cleaning operations, steam cleaning machine, an emergency generator, and miscellaneous heating emissions. The facility is subject to a VOC restriction of 30 tons per 12-month rolling period, which was established through a plan approval. In this renewal, 25 Pa. Code § 129.52d (Control of VOC emissions from miscellaneous metal parts surface coating processes, miscellaneous plastic parts surface coating processes and pleasure craft surface coating) is incorporated in the operating permit, replacing § 129.52 (Surface coating processes). The § 129.52d applies to the two paint booths, hand-wiping operations, and paint mixing and spray gun cleaning operations. Applicability determination showed that the newly promulgated 25 Pa. Code § 129.63a (Control of VOC emissions from industrial cleaning solvents) does not apply to the facility's hand-wiping operations.
61-00218: Tennessee Gas Pipeline Company Station 303 (1001 Louisiana Street, Suite 1000, Houston, TX 77002-5089) the Department intends to issue a renew of the Natural Minor Operating Permit for the natural gas transmission station located in Cranberry Township, Venango County. The facility's primary emission sources include a 14,721 hp natural gas compressor turbine, a 578 hp emergency generator fueled by a natural gas engine, miscellaneous natural gas fired sources and minor fugitive emissions. The turbine is subject to 40 CFR 60 Subpart KKKK pertaining to the NSPS for Stationary Combustion Turbines. The emergency engine is subject to 40 CFR 60 Subpart JJJJ pertaining to the Standards of Performance for Stationary Spark Ignition Internal Combustion Engines. The potential emissions from the facility are 31 TPY NOx; 68 TPY CO; 5 TPY VOC; 2 TPY SOx; 4 TPY PM-10; 2 TPY formaldehyde; 2TPY HAPs; and 65,910 TPY GHG CO2e. The conditions of the plan approval were incorporated into the operating permit.
COAL AND NONCOAL MINING ACTIVITY APPLICATIONS Applications under the Surface Mining Conservation and Reclamation Act (52 P.S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P.S. §§ 3301—3326); The Clean Streams Law (35 P.S. §§ 691.1—691.1001); the Coal Refuse Disposal Control Act (52 P.S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P.S. §§ 1406.1—1406.20a). Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application and request for Section 401 water quality certification application may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the address of the district mining office indicated before each application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34.
Written comments or objections regarding a mining permit application should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.
A request for an informal conference or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 or § 86.34, must contain the name, address and telephone number of the requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

MINING ACTIVITY NPDES DRAFT PERMITS This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).
The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.
Effluent Limits for Coal Mining Activities
For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).
The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Effluent Limits for Noncoal Mining Activities
The limits for noncoal mining activities as provided in 25 Pa. Code Chapter 77 are pH 6 to 9 and other parameters the Department may require.
Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.
In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.
More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).
The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES) Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.
Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.
Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public notice and contain the name, address, telephone number and the interest of the party filing the request, and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.
