FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483.  To 1) To install two 75-foot 36-inch culverts to carry an unnamed tributary to Centerville Creek (CWF, MF) beneath a private driveway, 2) to remove a failing culvert upstream of the driveway culvert and convert 200 feet of the channel into a natural open channel, 3) to remove approximately 650 cubic yards of sediment from the existing pond, 4) to create a 400-foot bypass channel around the existing pond impacting approximately 1,843 square feet of wetland, 5) to install a 60-foot by 30-inch culvert to carry the unnamed tributary beneath the driveway to the existing pond, and 6) to install two 30-inch culverts beneath the private driveway impacting approximately 46 square feet of wetland. The permit was issued on December 12, 2018.

E05-395: Bedford Township Municipal Authority, 1007 Shed Road, P.O. Box 371, Bedford, PA 15522 in Bedford Township, Bedford County, U.S. Army Corps of Engineers Baltimore District.

 To remove 1) the existing pump station and appurtenances and 2) relocate, replace, construct and maintain a new pump station with appurtenances, 60 linear feet of 8-inch PVC and 115 linear feet of 12-inch PVC gravity sewer line and gravel driveway within the 100-year floodplain of the Raystown Branch of the Juniata River (TSF, MF). The placement of fill for the pump station wet well will be above the 100-year floodplain elevation. The project purpose is to upgrade the pump control system, increase service to the public, handle a higher volume of flow, and eliminate frequent flooding issues. The limit of disturbance for construction is approximately 0.15 acre. No wetlands are located onsite. The Old Bedford Village pump station project is located along Sawblade Road, Bedford Township, Bedford County (Latitude: 40.040791, Longitude: -78.506860). The permit was issued on December 12, 2018.

The project purpose is to stabilize a hillslope and creating a new amusement attraction located near the intersection of Duquesne Boulevard and Hoffman Boulevard (Quadrangle: Braddock; Lat: 40° 23` 9"; Long: -79° 51` 37"; Sub-basin: 19A) located in the City of Duquesne.

 Place and maintain fill on the left bank of an Unnamed Tributary to Chartiers Creek (WWF), to operate and maintain the existing 4.0 foot diameter culvert in said stream and to construct and maintain two (2) outfall structures on the left bank of said stream for the purpose of constructing a new convenience store with five (5) automotive fueling stations, off-street parking and installation of underground utility lines and amenities.  The project involves the widening of McNany Road to accommodate additional heavy truck traffic associated with the construction of the Windy Oakland Well Pad and future drilling activities. The proposed project impacts in Clarion County include a total of 43 linear feet of permanent impacts to a UNT of Clarion River WWF. The project also has 0.03 acre of permanent impact to Palustrine Emergent (PEM) wetland(s). One floodway will be impacted having 0.105 acre of permanent impacts.

Revision to the Registered ERCs in the Commonwealth's ERC Registry

 The Department of Environmental Protection (Department) has approved the following Emission reduction credits (ERCs) and entered into ERC registry system. ERCs are surplus, permanent, quantified and Federally enforceable emission reductions used to offset emission increases of criteria pollutants. The Department maintains an ERC registry in accordance with the requirements of 25 Pa. Code § 127.209. Prior to registration of the credits, ERC Registry Applications are reviewed and approved by the Department to confirm that the ERCs meet the requirements of 25 Pa. Code §§ 127.206—127.208. Registration of the credits in the ERC registry system constitutes certification that the ERCs satisfy applicable requirements.

 The certified ERCs shown as follows, in tons per year (tpy), satisfy the applicable ERC requirements contained in 25 Pa. Code §§ 127.206—127.208. ERCs created from the curtailment or shutdown of a source or facility expires for use as offsets 10 years after the emission reduction occurs. ERCs generated by the over control of emissions by an existing facility do not expire for use as offsets. However, credits in the registry that are not used in a plan approval will be discounted if new air quality requirements are adopted by the Department or United States Environmental Protection Agency.

WQ05-022, National Fuel Gas Supply Corporation (Applicant), 1100 State Street, Erie, PA 16501. Line N to Monaca Pipeline Project (Project), in Center and Potter Townships, Beaver County and Buffalo Township, Washington County, Pittsburgh ACOE District. The proposed project starts at Applicant's existing Line N pipeline in Center Township (Aliquippa, PA Quadrangle N: 40° 36` 58.39"; W: 80° 18` 8.94") and ends at the Shell Chemical Appalachia, LLC (Shell) Pennsylvania Chemical Project facility (Shell Facility) (Beaver, PA Quadrangle N: 40° 39` 45.88"; W: 80° 20` 20.23"). Additional work is located at Applicant's existing Buffalo Compressor Station in Buffalo Township, Washington County (Washington West, PA Quadrangle N: 40° 9` 25.47"; W: 80° 20` 38.92").

 On March 23, 2018, Applicant filed an application with the Federal Energy Regulatory Commission (FERC) under the prior notice provisions set forth in 18 CFR 157.205, 157.208, 157.210, and 157.211 for authorization to construct and operate its Project (FERC Docket No. CP18-135-000). The Applicant's submission may be viewed on FERC's website at www.ferc.gov (search eLibrary; Docket Search; Docket No. CP18-135-000).

 On March 26, 2018, Applicant requested a State water quality certification from the Department of Environmental Protection (Department), as required by Section 401 of the Clean Water Act (33 U.S.C.A. § 1341), to ensure that the construction, operation and maintenance of the Project will protect water quality in this Commonwealth through compliance with State water quality standards and associated State law requirements, which are consistent with the requirements of the Clean Water Act.

 The Project includes an approximately 4.5 mile-long, 12-inch diameter pipeline for the purpose of transporting natural gas from Applicant's existing Line N transmission pipeline in Center Township at the proposed interconnect to a proposed metering and regulating (M&R) station located at the Shell Facility in Potter Township. The Project also includes installation of a new mainline valve adjacent to the interconnect in Center Township; and installation of a pipeline heater, pressure control worker monitor setup (single run with manual bypass), measurement, and a regulation building at Applicant's existing Buffalo Compressor Station in Buffalo Township. The Project will require approximately 80.5 acres of earth disturbance, and impacts to 770 linear feet of streams classified as Warm Water Fishes (WWF), including unnamed tributaries (UNTs) to Raccoon Creek, Shafers Run, UNTs to Shafers Run, and UNTs to Poorhouse Run; 1.65 acre of floodway; 0.03 acre of temporary palustrine emergent wetland impacts.

 The Department published notice of its proposed State water quality certification in the Pennsylvania Bulletin on June 9, 2018 (Vol. 48 Pa.B. No. 23) and received 0 comments from the public.

 The Department certifies to Applicant that the construction, operation and maintenance of the Project will not violate applicable State water quality standards set forth in 25 Pa. Code Chapter 93, provided Applicant complies with the permitting programs, criteria and conditions established pursuant to State law and specifically Permits No. GP050417242-53, GP080417246-60, GP070417201, ESG00-007-17-0004, ESG00-007-17-0005, and PAG10-9616 and all modifications and/or amendments thereto:

 1. Discharge Permit—Applicant shall comply with the existing Department National Pollutant Discharge Elimination System (NPDES) permit for the discharge of water from the hydrostatic testing of the pipeline and any modifications and/or amendments thereto under Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001), and all applicable implementing regulations (25 Pa. Code Chapter 92a).

 2. Erosion and Sediment Control Permit—Applicant shall comply with the Department's existing Chapter 102 Erosion and Sediment Control General Permits for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment and any modifications and/or amendments thereto issued under Pennsylvania's Clean Streams Law and Storm Water Management Act (32 P.S. §§ 680.1—680.17), and all applicable implementing regulations (25 Pa. Code Chapter 102).

 3. Water Obstruction and Encroachment Permits—Applicant shall comply with Department Chapter 105 Water Obstruction and Encroachment Permits for the construction, operation and maintenance of all water obstructions and encroachments associated with the project and any modifications and/or amendments thereto under Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P.S. §§ 673.1—693.27), and Flood Plain Management Act (32 P.S. §§ 679.101—679.601.), and all applicable implementing regulations (25 Pa. Code Chapter 105).

 4. Water Quality Monitoring—The Department retains the right to specify additional studies or monitoring to ensure that the receiving water quality is not adversely impacted by any operational and construction process that may be employed by Applicant.

 5. Operation—Applicant shall at all times properly operate and maintain all Project facilities and systems of treatment and control (and related appurtenances) which are installed to achieve compliance with the terms and conditions of this State Water Quality Certification and all required permits, authorizations and approvals. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Applicant.

 6. Inspection—The Project, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of the Department to determine compliance with this State Water Quality Certification, including all required State water quality permits and State water quality standards. A copy of this certification shall be available for inspection by the Department during such inspections of the Project.

 7. Transfer of Projects—If Applicant intends to transfer any legal or equitable interest in the Project which is affected by this State Water Quality Certification, Applicant shall serve a copy of this certification upon the prospective transferee of the legal and equitable interest at least 30 days prior to the contemplated transfer and shall simultaneously inform the Department Regional Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owner containing a specific date for transfer of certification responsibility, coverage, and liability between them.

 8. Correspondence—All correspondence with and submittals to PADEP concerning this State Water Quality Certification shall be addressed to the Department of Environmental Protection, Program Manager, Waterways and Wetlands Program, 400 Waterfront Drive, Pittsburgh, PA 15222.

 9. Reservation of Rights—The Department may suspend or revoke this State Water Quality Certification if it determines that Applicant has not complied with the terms and conditions of this certification. The Department may require additional measures to achieve compliance with applicable law, subject to Applicant's applicable procedural and substantive rights.

 10. Other Laws—Nothing in this State Water Quality Certification shall be construed to preclude the institution of any legal action or relieve Applicant from any responsibilities, liabilities, or penalties established pursuant to any applicable Federal or State law or regulation.

 11. Severability—The provisions of this State Water Quality Certification are severable and should any provision of this certification be declared invalid or unenforceable, the remainder of the certification shall not be affected thereby.

 12. Seasonal Restriction—Where disturbance is necessary, the United States Fish and Wildlife Service advises that clearing natural or semi-natural habitats (e.g. forests, woodlots, reverting fields, shrubby areas) and maintenance activities (e.g. mowing) occur between September 1 and March 31, which is outside the nesting season for most native bird species.

 13. Archaeological Artifacts—The permittee and his/her agents will be watchful for archaeological artifacts and will assure that ground disturbance activities will cease immediately upon discovery of archaeological artifacts, and immediately notify the Department Regional Office and the Pennsylvania Historical and Museum Commission at P.O. Box 1026, Harrisburg, PA 17120-1026, telephone (717) 783-8947.

 Any person aggrieved by this action may file a petition for review pursuant to Section 19(d) of the Federal Natural Gas Act (15 U.S.C.A. § 717r(d)), with the Office of the Clerk, United States Court of Appeals for the Third Circuit, 21400 United States Courthouse, 601 Market Street, Philadelphia, PA 19106-1790 within 30 days of publication of this notice, or within 30 days of receipt of written notice of this action, whichever occurs first. Public Hearing on Intent to Issue NPDES Permit to Specialty Granules, LLC

Receiving streams: unnamed tributary to/and Toms Creek, classified for the following uses: High Quality, Cold Water Fishes and Migratory Fishes. The NPDES permit facilitates two NPDES outfalls identified as outfall 001 and 002. Outfall 001 is located at 39° 46` 9.23" N, 77° 26` 37.99" W on the right-hand side of Toms Creek along Gum Springs Road. Outfall 002 is located at 39° 46` 04.80" N, 77° 26` 09.11" W on the left-hand side of Unnamed Tributary to Toms Creek along Iron Springs Road. A public hearing will be held on Wednesday, January 30, 2019 at the Fairfield Fire and EMS Building, 106 Steelman Street, Fairfield, PA 17320. The purpose of the public hearing is to discuss the mining permit application and associated NPDES permit. The hearing will address topics identified by the public in previous comments including the following: Social or Economic Justification submitted by the applicant to justify lower water quality discharges, naturally occurring asbestos, historically significant features and any other aspects of the permit application. An open house will be conducted between 6:30 PM to 7:00 PM, during which time Department representatives will be available to answer questions concerning the permit application. Beginning at 7:00 PM, formal comments regarding the permit application will be accepted. Those interested in making a formal comment will have the option of voicing their comment for the official record during the public hearing or submitting a written comment within two weeks of the public hearing. Attendees who choose to voice their comment will be called upon one at a time and allotted five minutes to speak.
