THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.
For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

PUBLIC WATER SUPPLY PERMITS The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).
Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

24-00131: SGL Carbon Corp. (900 Theresia St., Saint Marys, PA 15857-5030). On December 17, 2018, the Department issued a State Only Natural Minor Operating Permit for the graphite product manufacturing facility located in the City of Saint Marys, Elk County. The facility's primary emission sources include natural gas combustion sources, a 9.9 MMBtu/hr natural gas boiler, chemical vapor deposition reactors, machining operations, a maintenance shop, the special impregnation process, solvent degreasers, two (2) natural gas-fired emergency power generators, graphitization and purification furnaces, and a V.O.G. furnace. The potential emissions of the primary pollutants from the facility are as follows: 5.80 TPY (tons per year) NOx, 4.68 TPY CO, 25.98 TPY VOC, 1.26 TPY total HAPs, 0.79 TPY HCl, 0.10 TPY HF, 0.25 TPY Cl, 15.04 TPY PM-10 and PM-2.5, and 0.03 TPY SOx; thus, the facility is a natural minor. One emergency generator is subject to 40 CFR 63 Subpart ZZZZ, NESHAP for Stationary Reciprocating Internal Combustion Engines. The other emergency generator is subject to 40 CFR 60 Subpart JJJJ, Standards of Performance for Stationary Spark Ignition Internal Combustion Engines. The renewal permit contains emission restrictions, recordkeeping, work practices, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.
43-00309: Bucks Fabricating, Inc. (3547 Perry Hwy., Hadley, PA 16130), on December 13, 2018, the Department issued the renewal of the State-Only Operating Permit of a facility that manufactures detachable work truck bodies and roll-off containers located in Sandy Creek Township, Mercer County. Permitted sources at the facility include two paint booths, two dryers, hand-wiping operations, paint mixing and spray gun cleaning operations, an emergency generator, and miscellaneous heating emissions. The facility is subject to a VOC restriction of 30 tons per 12-month rolling period, which was established through a plan approval. In this renewal, 25 Pa. Code § 129.52d (Control of VOC emissions from miscellaneous metal parts surface coating processes, miscellaneous plastic parts surface coating processes and pleasure craft surface coating) is incorporated in the operating permit, replacing § 129.52 (Surface coating processes). The § 129.52d applies to the two paint booths, hand-wiping operations, and paint mixing and spray gun cleaning operations. Applicability determination showed that the newly promulgated 25 Pa. Code § 129.63a (Control of VOC emissions from industrial cleaning solvents) does not apply to the facility's hand-wiping operations. A previously permitted steam cleaning machine is removed from the operating permit.

(1824 Horseshoe Pike, Honey Brook, PA 19344) for an Administrative Amendment to State Only (Synthetic Minor) Operating Permit No. 15-00046 for its Icedale Pump Station facility, which is located in West Brandywine Township, Chester County. The Administrative Amendment addresses Sunoco Pipeline, L.P.'s concerns regarding the applicability of certain provisions of 40 C.F.R. Part 63, Subpart BBBBBB, and corrects certain conditions and references in the recently-renewed State Only Operating Permit (SOOP) to make the requirements consistent for all of the storage tanks, including as follows:
• Clarification that the terms ''equipment'' and ''in gasoline service,'' as used in the SOOP, are as defined in 40 C.F.R. Part 63, Subpart BBBBBB, has been added.
• The requirement to fill the storage tanks to the point of refloating the floating roof has been revised to not apply when the storage tanks are storing petroleum distillates.
• Requirements to maintain records of information relating to periods when the internal floating roof of storage tank 4 is supported by its leg supports or other support devices have been added.
• A requirement to submit a report detailing any defect(s) observed during internal floating roof maintenance inspections for storage tank 4 each time the tank is emptied and degassed, or within 10 years of previous such inspections, has been added.
The Administrative Amendment is issued under the Air Pollution Control Act (35 P.S. §§ 4001—4015) and 25 Pa. Code § 127.450.
