Federal Consistency under the Coastal Zone Management Act; Maintenance Dredging in the Schuylkill River

 This notice is published under section 306(d)(14) of the Federal Coastal Zone Management Act of 1972 (16 U.S.C.A. § 1455(d)(14)), regarding public participation during consistency determinations. The Department of Environmental Protection (Department), Coastal Resources Management Program has received notice that the United States Army Corps of Engineers (USACE) is proposing to conduct maintenance dredging activities in portions of the Schuylkill River in Philadelphia, above Fairmount Dam.

 USACE is proposing to dredge the Nationally significant Schuylkill River rowing racecourse. This maintenance dredging project will remove accumulated sediment shoals at a maximum of four locations in the vicinity of the Strawberry Mansion Bridge downstream to the Fairmount Dam. These areas include portions of the racecourse in the vicinity of Peter's Island and the Strawberry Mansion Bridge, an area around existing docks in front of Boathouse Row, and an adaptive rowing access point to the river for use by persons with disabilities. Dredging will be to a maximum depth of 4 feet NAVD 88 plus 1 foot of allowable overdredge. USACE will either use a hydraulic cutterhead dredge or a mechanical bucket dredge to conduct the maintenance dredging activities. USACE estimates that this proposed maintenance dredging will remove an estimated 60,000 cubic yards of material from the four sites. The dredged material will be transported by means of a floating pipeline or barges, depending on dredge type, from the dredge downstream to Fairmount Dam. The dredged material will be transferred over the dam into barges and then transported downstream, where it will be hydraulically unloaded into the Fort Mifflin Confined Disposal Facility (CDF). Decant water will be drained from the Fort Mifflin CDF back into the Schuylkill River. The proposed dredging schedule has an early start of August 2019 and will continue during the fall, with potential to extend into winter months pending weather. The project is anticipated to take 3 to 4 months to complete.

 This project is subject to Department review for Federal consistency because it is a Federal agency activity and will have reasonably foreseeable effects on the Commonwealth's coastal resources or uses.

 In accordance with National Oceanic and Atmospheric Administration (NOAA) regulations at 15 CFR Part 930, Subpart C (relating to consistency for Federal agency activities), USACE has determined that the proposed activity will be conducted in a manner consistent with the applicable enforceable policies of the Commonwealth's NOAA-approved Coastal Resources Management Program (Program). Interested parties may request a copy of the Federal Consistency Determination from the Department contact listed as follows.
