THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
APPLICATIONS FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications concern, but are not limited to, discharges regarding industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFO). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 Individual Permits and Individual Stormwater Construction Permits in Sections IV and VI, the Department, based upon preliminary reviews, has made tentative determinations of proposed effluent limitations and other terms and conditions for the permit applications. In accordance with 25 Pa. Code § 92a.32(d), the proposed discharge of stormwater associated with construction activities will be managed in accordance with the requirements of 25 Pa. Code Chapter 102. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the United States Environmental Protection Agency (EPA) Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).
Persons wishing to comment on NPDES applications are invited to submit statements to the contact office noted before the application within 30 days from the date of this public notice. Persons wishing to comment on WQM permit applications are invited to submit statements to the office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests for public hearings on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

Hamilton Farms LLC has submitted an application for an Individual NPDES permit for a new CAFO known as Hamilton Farm LLC CAFO, located in Adams Township, Snyder County.
The CAFO is situated near Unnamed Tributary of North Branch Middle Creek (CWF, MF) in Watershed 6-A, which is classified for Cold Water Fishes and Migratory Fishes. The CAFO is designed to maintain an animal population of approximately 756.74 animal equivalent units (AEUs) consisting of 5,400 finishing swine. Manure is collected in separate reception pits that are located underbarn which ultimately feed the manure to the HDPE lagoon outside of the barns. A release or discharge to waters of the Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 100-year, 24-hour storm event.
The Department has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations, the Department has made a tentative determination to issue an NPDES permit for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the permit.

The Environmental Protection Agency (EPA) permit waiver provision under 40 CFR 123.24(e) does not apply to this NPDES permit.
STATE CONSERVATION COMMISSION
PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.
Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. These NMPs are published as proposed plans for comment prior to taking final actions. The NMPs are available for review at the CCD office for the county where the agricultural operation is located. ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995
PREAMBLE 1
Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).
Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office. This major permit modification application proposes several modifications at the Envirowaste, LLC Municipal Solid Waste (MSW) and Construction/Demolition Waste (C&D) Transfer Facility, located at 13 Pattison Avenue, City and County of Philadelphia. Proposed modifications include the following: a) increase the total daily waste limit for direct transfer and processing from 1,000 tons per day to 1,400 tons per day; b) restrict the daily limit for C&D waste processed under General Permit No. WMGM043SE001 to 200 tons per day; c) allow acceptance of up to 1,200 tons per day of either MSW received from private collectors or C&D for direct transfer only; d) expand and improve the transfer/processing building to accommodate the increase in the daily volume and provide additional storage; and e) reduce the DEP authorized permit boundary, eliminating outside storage of processed materials under WMGM043SE001. AIR QUALITY
PLAN APPROVAL AND OPERATING
PERMIT APPLICATIONSThe Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.
The Department received applications for Plan Approvals or Operating Permits from the following facilities.
Copies of the application, the Department's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate Department Regional Office. Appointments for scheduling a review must be made by calling the appropriate Department Regional Office. The address and phone number of the Regional Office is listed before the application notices.
Persons wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the Department's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.
A person wishing to request a hearing may do so during the 30-day comment period. 28-05015C: Blue Ridge Landfill Co. (P.O. Box 399, Scotland, PA 17254-0399) for the Blue Ridge Landfill in Greene Township, Franklin County. Plan Approval No. 28-05015C will authorize installation of a new enclosed landfill gas flare. The estimated potential emissions from the new flare, at the gas flow rate of 2,500 scfm, will be NOx 19.7 tpy, CO 65.7 tpy, SOx 32.2 tpy, VOC 0.7 tpy, 5.6 tpy of PM10, and 1.4 tpy HAPs. Review by DEP of the information submitted by the applicant indicates that the air contamination sources as constructed or modified will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirement (BAT) of 25 Pa. Code §§ 127.1 and 127.12. The plan approval will include provisions derived from 40 CFR Subpart XXX—Standards of Performance for Municipal Solid Waste Landfills That Commenced Construction, Reconstruction, or Modification After July 17, 2014, and 40 CFR Part 63, Subpart AAAA—National Emission Standards for Hazardous Air Pollutants: Municipal Solid Waste Landfills. Based on these findings, the Department proposes to issue a plan approval for the proposed construction. If, after the project has been implemented, the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and the specification of the application for plan approval, the requirements established in the plan approval will be incorporated into Title V Operating Permit pursuant to the administrative amendment provisions of 25 Pa. Code § 127.450.

46-00048: Wyeth Pharmaceuticals (500 Arcola Road, Collegeville, PA 19426) for renewal of the Title V Operating Permit for its corporate, subsidiary, and regional management offices in Upper Providence Township, Montgomery County. Wyeth Pharmaceuticals is a major facility for nitrogen oxide (NOx) emissions. The facility is comprised of five (5) dual-fired boilers and nine (9) diesel-fired emergency electric generators. There have been no changes to any of the existing sources at the facility. There have been no new sources added. The renewal does not authorize any increase in air emissions of regulated pollutants above previously approved levels. The permit will include monitoring, record keeping, and reporting requirements designed to address all applicable air quality requirements.

25-00783: Haysite Reinforced Plastics, LLC (5599 Perry Highway, Erie, PA 16509). In accordance with 25 Pa. Code §§ 129.96—129.100, the Pennsylvania Department of Environmental Protection (the Department) has made a preliminary determination to approve an alternate Reasonably Available Control Technology (RACT II) plan and seeks approval of an amendment to the State Implementation Plan (SIP) for the plastics manufacturing facility owned and operated by Haysite Reinforced Plastics, LLC, in Millcreek Township, Erie County. And in accordance with 25 Pa. Code § 127.521, the Department of Environmental Protection intends to re-issue a Title V Operating Permit for the facility. The facility is located at 5599 Perry Highway, Erie, PA 16509. The facility's representative to contact concerning this application is Heather Ravenscroft, Environmental Compliance Manager.
The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT II approval for the facility, which are intended to satisfy the requirements for the 1997 National Ambient Air Quality Standard (NAAQS) and the 2008 NAAQS for ozone.
The proposed amendments to the RACT II determination, if finally approved, will be incorporated into the revised operating permit for the facility. The relevant RACT II requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's SIP and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded from the SIP submittal; this includes the provisions of the Department's presumptive RACT II requirements in accordance with 25 Pa. Code § 129.97, as they apply to existing sources at this facility.
The facility is a major stationary source as defined in Title I, Part D of the Clean Air Act Amendments due to its potential to emit VOC and HAP. The facility is therefore subject to the Title V Operating Permit requirements adopted in 25 Pa. Code Chapter 127, Subchapter G.
The facility's emission sources include two 4 million Btu/hr natural gas fueled boilers; 10 natural gas fueled space heaters and 5 natural gas fueled furnaces, all rated 250,000 Btu/hr or less; 9 flat sheet molding presses; 14 compression molding machines; 5 pultrusion molding machines and saws; a sheet molding compound machine; a mix room; and a sheet sander and a panel saw. The facility is a major facility due to its potential to emit Styrene, both a HAP and a VOC. Actual 2018 emissions are as follows: 24.15 tons VOC, 24.07 tons HAPs, 1.52 ton NOx, 0.01 ton SOx, 1.28 ton CO, and 0.12 ton PM-10. This facility is subject to 40 CFR Part 63 Subpart WWWW, NESHAPs for Reinforced Plastic Composites Production. The facility also has a 30 hp natural gas fueled emergency generator subject to 40 CFR Part 63 Subpart ZZZZ.
The following is a summary of the proposed amendments to the RACT II determination for this facility that will be submitted to the EPA as a SIP revision:

• Emissions shall not exceed 21.50 # of VOC/ton product for Puller 3 & 4.
• Emissions shall not exceed 8.60 # of VOC/ton product for Puller 5 & 6.Mix Room: • VOC emissions shall not exceed 17.19 tpy based on an emission factor of 10.26 # of VOC/ton product.
• Emissions shall not exceed 12.31 # of VOC/ton product.Public hearing. If requested by July 8, 2019, a public hearing will be held to accept oral comments on the proposed operating permit revision and the proposed SIP revision. If requested, the hearing will be held on July 15, 2019, at 10 a.m. at the DEP Northwest Regional Office, 230 Chestnut Street, Meadville, PA 16335. 09-00199: Mars Fishcare, N.A., Inc. (50 East Hamilton St., Chalfont, PA 18914) for a non-Title V, State Only, Natural Minor operating permit in Chalfont Borough, Bucks County. The permit is for the operation of an existing bulk material handling pneumatic conveying system, a dust collector and a vacuum filter receiver system. The system will emit 1.03 ton of particulate matter per year. The facility's potential to emit criteria pollutants is less than major thresholds; therefore the facility is a Natural Minor. This action is a second renewal of the State Only Operating Permit. The permit was initially issued on 9-4-2009 and renewed on 9-18-2014. The renewed permit will include monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.
09-00219: Premium Excavating, LLC (269 Canal Road, Fairless Hills, PA 19030) for operation of a crusher unit and a screener unit, and their associated diesel engines at Falls Township, Bucks County. This action is a renewal of a State Only Operating Permit (Natural Minor). The proposed renewal contains monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

The sources include one # 2 fuel oil-fired boiler and one propane-fired boiler. 28-03022: New Enterprise Stone & Lime Co., Inc. (169 Quarry Road, Chambersburg, PA 17201) for the operation of a sandstone crushing facility in Guilford Township, Franklin County. This is for renewal of the existing State-only permit. Potential air emissions from the facility are estimated at 23.45 tpy PM. The Operating Permit will include emission limits and work practice standards along with monitoring, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality regulations.
01-03030: Cargill, Inc. (1892 York Road, Gettysburg, PA 17325) for the operation of an animal feed processing mill in Straban Township, Adams County. This is for renewal of the existing state-only permit. Potential air emissions from the facility are estimated at 29.2 tpy PM, 5.31 tpy NOx, 1.33 tpy CO, 7.44 tpy SOx, and less than 1 tpy VOC and HAPs. The Operating Permit will include emission limits and work practice standards along with monitoring, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality regulations.
06-05114: Birchcraft Kitchens, Inc. (425 Richmond Street, Reading, PA 19605) for the wood cabinet manufacturing plant located in the City of Reading, Berks County. This is for renewal of the existing state-only permit. The actual emissions from the facility in 2017 are estimated at 7.92 tons of VOC and less than a ton of other pollutants. The Operating Permit will include emission limits and work practice standards along with monitoring, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality regulations. Among other items, the conditions include provisions derived from 25 Pa. Code § 129.52.
67-05111: Johnson Controls Inc., East York Plant (1499 East Philadelphia Street, York, PA 17403) for the operation of a spray coating operation in Spring Garden Township, York County. This is for renewal of the existing state-only permit. The 2018 air emissions from the facility were 11.67 tons VOC, 1.05 ton NOx and less than 1 ton each of CO, HAP, PM, and SOx. The Operating Permit will include emission limits and work practice standards along with monitoring, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality regulations.
28-05029: Fayetteville Contractors, Inc. (3185 Lincoln Way East, Fayetteville, PA 17222) for the operation of a batch asphalt plant in Antrim Township, Franklin County. This is for renewal of the existing state-only permit. Potential air emissions from the facility are estimated at 6.48 tpy PM, 28.8 tpy NOx, 96 tpy CO, 1.97 tpy VOC, 21.1 tpy SO2, and 3.6 tpy HAPs. The Operating Permit will include emission limits and work practice standards along with monitoring, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality regulations.
21-03049: Pyrotek, Inc. (1285 Claremont Road, Carlisle, PA 17013) for the operation of a refractory machining facility in Middlesex Township, Cumberland County. This is for renewal of the existing State-only permit. Potential air emissions from the facility are estimated at 46.24 tpy PM and less than 1 tpy CO, NOx, VOC, SO2 and HAPs. 10-00374: Three Rivers Aggregates, LLC, Black Run Plant (144 Brandon Road, Slippery Rock, PA 16057), the Department intends to issue the renewal of the State-Only Operating Permit of a nonmetallic mineral processing plant that produces sand and gravel located in Worth Township, Butler County. Permitted air contamination sources at the facility are crushing operations, screening operations, conveying systems, stockpiles, roadways, and truck load-out. The facility is subject to 3,000-hour/year operating hours restriction and 400 tons/hour and 1,000,000 tons/year throughput restrictions established through PA 10-374A. Crushing and screening operations at the facility are subject to 40 CFR 60 Subpart OOO pertaining to Standards of Performances (NSPS) for Nonmetallic Mineral Processing Plants. In this renewal, a work practice condition on water spray operation has been added pursuant to 40 CFR 60 Subpart OOO.
25-01025: Erie Cemetery Association (2116 Chestnut St., Erie, PA 16502-2617). The Department is providing notice that they intend to renew a State Only Natural Minor Operating Permit for operation of the cremation facility located in the City of Erie, Erie County. The facility's primary emission sources consist of two human cremators and their secondary chambers. The potential emissions of the primary pollutants from the facility are as follows: 2.102 TPY (tons per year) NOx, 1.766 TPY CO, 0.116 TPY VOC, 0.001 TPY Pb, 0.06 TPY filterable PM-10 and PM-2.5, and 0.013 TPY SOx; thus, the facility is a natural minor. The crematories are subject to Plan Approval 25-1025A which includes opacity limitations, monitoring, recordkeeping, and work practice requirements. The renewal permit will contain emission restrictions, recordkeeping, work practices, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.
33-00175: Matson Lumber Corsica (1065 Route 322, Brookville, PA 15825). The Department is providing notice that they intend to renew a State Only Natural Minor Operating Permit for the lumber processing facility located in Union Township, Jefferson County. The facility's primary emission sources include two (2) natural gas-fired stand-by boilers, the 400 hp wood-fired boiler, and a boiler feed system through a cyclone. The potential emissions of the primary pollutants from the facility are as follows: 23.05 TPY (tons per year) NOx, 53.79 TPY CO, 2.33 TPY VOC, 19.84 TPY filterable PM-10, 12.59 TPY PM-2.5, and 2.13 TPY SOx; thus, the facility is a natural minor. The wood boiler is subject to 40 CFR 60 Subpart Dc, Standards of Performance for Small Industrial-Commercial-Institutional Steam Generating Units, and 40 CFR 63 Subpart JJJJJJ, NESHAP for Industrial, Commercial, and Institutional Boilers Area Sources. The renewal permit will contain emission restrictions, recordkeeping, work practices, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.
42-00215: Kane Area School District—Kane Area High School (400 West Hemlock Avenue, Kane, PA 16735-1644) the Department intends to re-issue the Natural Minor Operating Permit for this educational facility in Wetmore Township, McKean County. The facility's primary emissions are from a Wood Fired Boiler (7.1 MMBtu/hr) controlled by a multicyclone and (2) Natural Gas Fired Boilers (2.79 MMBtu/hr each) used to provide comfort heat and hot water to the school. There is also an Emergency Power Generator (125 HP) powered by a natural gas engine to provide limited power in the event of a power outage. The generator was installed in Summer 2018 and is subject to the requirement of 40 CFR Part 60 Subpart IIII pertaining to Standards of Performance for Stationary Spark Ignition Internal Combustion Engines. The engine is an EPA certified engine.
