NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

LAND RECYCLING AND
ENVIRONMENTAL REMEDIATION

The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The proposed project will also include a diesel emergency generator, a diesel emergency fire pump and an evaporative cooling tower. The plan approval was extended.

09-00106: Univar USA Inc. (200 Dean Sievers Place, Morrisville, PA 19067) On July 17, 2019, for a renewal for a Non-Title V Facility, State-Only, Synthetic Minor Permit in Falls Township, Bucks County. Univar USA Inc. is a chemical and allied products merchant wholesaler. The sources of emissions include: a boiler, diesel fire pump, emergency generators, storage tanks and transfer stations. The facility voluntary took a total VOC HAP and total NOx emission limit of 24.9 tons per year and a 9.9-tons per year limit on individual HAPs calculated on a 12-month rolling sum. Monitoring, record keeping and reporting requirements have been added to the permit to address applicable limitations.

46-00253: Valley Forge, Inc. (450 E. Valley Forge Road, King of Prussia, PA 19406) On July 19, 2019, located in Upper Merion Township, Montgomery County, for a renewal of State Only Operating Permit (SOOP) No. 46-00253. Since the SOOP was last renewed in 2018, the only major physical change that has occurred at the facility is the removal of a trommel screen (former Source ID 104A) with associated engine.

 While the potential to emit nitrogen oxides (NOx) from the engines/facility exceeds 25 tons per year, Valley Forge, Inc., has elected to restrict the hours of operation for the engines to ensure that the NOx emissions from the facility will not exceed this level. Therefore, the status of the facility is Synthetic Minor.

 Based on a reinterpretation of the definition of the term ''nonroad engine'' in 40 CFR 1068.30, DEP no longer considers the engines associated with the tub grinder (Source ID 103) and soil screener (Source ID 105) at the facility to be stationary engines subject or potentially subject to the provisions of 40 CFR Part 60, Subpart IIII, or 40 CFR Part 63, Subpart ZZZZ. Accordingly, DEP will remove all references and requirements to these regulations from the renewal SOOP for the engines associated with the tub grinder and soil screener.

 The renewal SOOP will continue to include monitoring, recordkeeping, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.
