FEDERAL WATER POLLUTION
CONTROL ACT, SECTION 401The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.
Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

To authorize the following water obstructions and encroachments associated with bridge replacement project along Interstate 0084 Section 282:
1. To remove the existing Northbound-Westbound structure and to construct and maintain a 4-span composite steel plate girder bridge having a span of 63-foot and an underclearance of 76.3-foot over Roaring Brook (HQ-CWF, MF) (waterway WW-232; NB/WB Sta 637+70.74).
2. To remove the existing Southbound-Eastbound structure and to construct and maintain a 4-span composite steel plate girder bridge having a span of 63-foot and an underclearance of 76.3-foot over Roaring Brook (HQ-CWF, MF) (waterway WW-232; SB/EB Sta 637+42.15).
3. To remove the existing slope pipe and construct and maintain a slope pipe conveying 471 l.f. of a tributary Roaring Brook (HQ-CWF, MF) (waterway WW-230; SB/EB Sta 634+00).
4. To remove the exsting structure and restore approximately 194 l.f. of natural channel of a tributary Roaring Brook (HQ-CWF, MF) (waterway WW-239; NB/WB Sta 640+50 Rt).
5. To remove the existing structure and to construct and maintain a 31 l.f. of 30" RCP stream crossing carrying Northbound-Westbound I-84 over a tributary Roaring Brook (HQ-CWF) and to extend the existing stream enclosure an additional 69 l.f. of 30" RCP pipe for a total enclosure length of approximately 175 l.f. (WW-239; NB/WB Sta 639+95- SB/EB Stat 638+04).
6. The project also proposes to install rock apron outlet protection in various locations impacting approximately 50 l.f. of tributary Roaring Brook (HQ-CWF, MF) (waterways WW-238, WW-249, WW-236).

The project also includes the impacts to PEM EV wetlands totaling 0.12 acre. The Permittee is required to provide 0.12 acre(s) of replacement wetlands.
The project is located along Interstate 84 Section 282 (Olyphant, PA Quadrangle, Latitude: 41° 23` 33.7"N; Longitude: -75° 35` 1.9"W) in Dunmore Borough & Roaring Brook Township, Lackawanna County.

E0804119-008 PA DOT Engineering District 3-0, 715 Jordan Ave., Montoursville, PA 17754. SR 0706, Section 034, Segment 0250, Offset 2539 through Segment 0260, Offset 0252, Slope Failure Restoration, Stevens Township, Bradford County, Baltimore ACOE (LeRaysville, PA Quadrangle N: 41° 46` 41"; W: -76° 08` 38").
PA DOT proposes to restore a roadway slope failure adjacent to Wyalusing Creek. The roadway failure will result in approximately 495 L.F. of R-8 Rip Rap Slope. The 1.5:1 side slope will be grouted to above the 100 year water surface elevation of Wyalusing Creek. The Rip Rap slope will restore the roadway side slope to Pre-Flood location. Approximately 304 L.F. of Wyalusing Creek will be shifted approximately 5 Ft. East. The project will utilize approximately 606 L.F. of temporary diversion to construct the Rip Rap slope. Approximately 400 L.F. of Temporary Access road will be constructed along the SR 0706 roadway side slope. The project will also replace 52 L.F. of 42 inch smooth lined plastic pipe with 54 L.F. of 48 inch corrugated metal pipe. The pipe is located within an Unnamed Tributary to Wyalusing Creek and has a drainage area of 163 acres. The area downstream of the pipe will be incorporated into the Rip Rap slope repair. A detour will be utilized to convey traffic during construction. The project not impact any jurisdictional wetlands. Wyalusing Creek is classified as a Warm Water Fishery by Title 25, Chapter 93 Water Quality Standards.
E1204219-002, DCNR Bureau of Forestry, District 13, Lumber Township, Cameron County, U.S. Army Corps of Engineers Baltimore District (Lock Haven Quadrangle; Latitude 41° 31` 29.569"N; 78° 8` 7.1421"W).
The applicant proposes to construct and maintain a pedestrian bridge across McNuff Branch (HQ-CWF) on the Bucktail Path State Forest hiking trail. The trail will have a permanent watercourse impact 240 square feet.
E1704219-001: Lori A. Snyder, Sandy Township, Clearfield County, U.S. Army Corps of Engineers Pittsburgh District (Sandy Quadrangle; Latitude 41° 10` 25"N; 78° 43` 57"W).
The applicant is proposing to construct a new house along Treasure Lake in Sandy Township. The project will result in 0.06 acre of permanent wetland impact. The wetland is not considered exceptional value and no known threatened or endangered species inhabit the resource. Mitigation for the impact will be accomplished through a contribution to the National Fish and Wildlife Foundation.

E0306119-002, PADOT Engineering District 10-0, 2550 Oakland Ave., Indiana, PA 15701. S.R. 0028 Section 112, in Boggs Township, Armstrong County, ACOE Pittsburgh District (Distant, PA Quadrangle N: 40°, 54`, 17.2"; W: 79°, 22`, 15.9").
This highway safety improvement project proposes the widening and realignment of S.R. 0028, Section 112. The applicant proposes:
1. To remove the existing outfall and to construct and maintain 20-LF of new outfall along STR-02, UNT Scrubgrass Creek (CWF).
2. To construct and maintain 760-LF of fill along STR-02 and to remove the existing structure and to construct and maintain a 160-LF, 9-ft diameter reinforced concrete pipe on a new alignment.
3. To construct and maintain 76-LF of permanent fill along STR-03, UNT Scrubgrass Creek (CWF).
4. To construct and maintain 73-LF of permanent fill along STR-03A, UNT Scrubgrass Creek.
5. To permanently fill and maintain 2088-SF of wetland fill in WL-01 (PEM).
6. To temporarily impact 5-LF of STR-01A to facilitate the relocation of STR-02.
7. To construct and maintain 43-LF of permanent fill along STR-01B, UNT Scrubgrass Creek.
8. To construct and maintain 42-LF of permanent fill along STR-01, UNT Scrubgrass Creek.
9. To construct and maintain outfalls of various size resulting in 80-LF of impacts to STR-05, Scrubgrass Creek.
10. To remove the existing structure and to construct and maintain a 155-ft long concrete box culvert having a 16-ft wide by 7.5-ft high waterway opening and to construct and maintain 435-LF of fill along STR-05, Scrubgrass Creek (CWF).
11. To remove the existing structure and to construct and maintain a 421-ft long, 18-in diameter RCP carrying STR-04, UNT Scrubgrass Creek, under SR 0028.
12. To remove the existing structure and to construct and maintain a 221-ft long, 18-in diameter RCP carrying STR-06, UNT Scrubgrass Creek, under SR 0028.
13. To construct and maintain 1487-SF of permanent wetland fill in Wetland WL-02 (PEM).
14. To construct and maintain 3,324-SF of permanent wetland fill and 665-SF of temporary wetland impacts to Wetland WL-03 (PEM).
15. To remove the existing structure and to construct and maintain a two-span composite prestressed concrete PA bulb-tee bridge having two identical spans of 119.04-ft and a minimum underclearance of 32.2-ft on a new horizontal and vertical alignment over STR-07, Laurel Run (CWF). The existing culvert length of 75-ft is to be daylighted and the streambank restored.
16. To construct and maintain outfalls of various size along STR-07.
The applicant proposes to construct 0.191-ac of wetland onsite to mitigate for the loss of 0.158-ac of permanent wetland impacts. Various stream enhancements totaling 1,379-LF are proposed to offset the 1,304-LF of permanent stream loss/impact associated with the project.

E4129-130. NFG Midstream Trout Run, LLC, 1100 State Street, Erie, PA 16501. Alta Pipeline in McIntyre Township, Lycoming County, ACOE Baltimore District (Bodine, Liberty, Ralston & Trout Run, PA Quadrangles N: 41° 29` 43" W: -77° 0` 1°).
NFG has applied for an Individual—Joint Permit to construct, operate and maintain 5.6-miles (21,376 ft) of one (1) 8-inch diameter and one (1) 12-inch flex steel natural gas pipeline in McIntyre Township—Lycoming County. Additionally, a 16-inch diameter temporary above ground waterline (TAGWL) will be installed aerially. The pipeline will be placed via open cut trenching.
This project crosses thirteen (13) watercourses and twenty-one (21) wetlands. Eight (8) stream crossings would qualify for the Chapter 105.12(a)(2) waiver since they have drainage areas of 100 acres or less.
A total of thirteen (13) temporary stream and twelve (12) permanent stream impacts are proposed to Frozen Run (HQ-CWF), UNT to Frozen Run (HQ-CWF) and UNT to Red Run (CWF). Project watercourse impacts shall include and be limited to a total of 6,006 SF (743 LF) of temporary stream impacts and 758 SF (64 LF) of permanent stream impacts.
A total of thirteen (13) temporary floodway and thirteen (13) permanent floodway impacts are proposed to Frozen Run, UNT to Frozen Run and UNT to Red Run. Project floodway impacts shall include and be limited to a total of 66,384 SF (1.5240 ac) of temporary floodway impacts and 7,835 SF (0.1799 ac) of permanent floodway impacts.
A total of twenty-one (21) temporary wetland and fifteen (15) permanent wetland impacts are proposed. Project wetland impacts shall include and be limited to a total of 20,675 SF (0.4746 acre) of temporary wetland impacts and 3,013 SF (0.0692 acre) of permanent wetland impacts.

Project proposes to remove the Intake Dam to eliminate a threat to public safety and to restore approximately 120 feet of stream channel to a free-flowing condition. The project is located across Brush Creek (WWF, MF) (Frankstown, PA Quadrangle, Latitude: 40.4655; Longitude: -78.3637).
EROSION AND SEDIMENT CONTROL PERMITS The following parties have applied for Erosion and Sediment Control Permits for earth disturbance activities associated with either road maintenance or timber harvesting operations.
Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department proposes to issue a permit to discharge, subject to certain limitations in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices which restrict the rate and quantity of sediment discharged.
A person wishing to comment on a proposed permit are invited to submit a statement to the appropriate Department regional office listed before the application within 30 days of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and relevant facts upon which it is based. A public hearing may be held after consideration of comments received by the appropriate Department regional office during the 30-day public comment period.
Following the 30-day comment period, the appropriate regional office water management program manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board (Board).
The application and related documents, including the erosion and sediment control plan for the earth disturbance activity, are on file and may be inspected at the appropriate regional office.

To construct a 24-foot-wide by 1,700 long access road to access the Holt Well Pad. The access road will include the installation of a bridge across a UNT to Clawson Run, a Warm Water Fisheries, and permanent placements of fill within wetlands on site. The project is located within Gilmore Township, Greene County, Pittsburgh USACE District, (Wadestown Quadrangle, Latitude N 39.742343, Longitude W -80.313121). The installation of the bridge and access road permanently impacts approximately 0.04 acre of wetland, 0.208 acre of floodway, and 25 LF of stream.

Chevron Appalachia is proposing a 286-foot by 418 foot well pad extension and tank pad reclamation for oil and gas activity at the existing Basista—Dermotta Well Pad B (40.269439, -79.780153). The well pad expansion area and tank pad reclamation will result in the impact to wetlands found on the site. Three (3) Palustrine Emergent (PEM) wetlands, totaling 0.28 acre, will be filled due to the reclamation of the existing tank pad. Wetland mitigation is required for this project. Onsite mitigation will consist of approximately 0.3 acre of PEM wetland.
The project is located within the McKeesport USGS 7 1/2 Minute Quadrangle Map.
