COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

 Applications under the Surface Mining Conservation and Reclamation Act (52 P.S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P.S. §§ 3301—3326); The Clean Streams Law (35 P.S. §§ 691.1—691.1001); the Coal Refuse Disposal Control Act (52 P.S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P.S. §§ 1406.1—1406.20a). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P.S. §§ 4001—4015); the Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27); and the Solid Waste Management Act (35 P.S. §§ 6018.101—6018.1003).

 The following permit applications to conduct mining activities have been received by the Department. A copy of the application is available for inspection at the district mining office indicated before each application. Notices of requests for 401 Water Quality Certifications are included in individual application notices, as noted.

 Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application and request for Section 401 water quality certification application may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the address of the district mining office indicated before each application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34.

 Written comments or objections regarding a mining permit application should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.

 A request for an informal conference or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 or § 86.34, must contain the name, address and telephone number of the requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

 When an NPDES number is listed, the mining activity permit application was accompanied by an application for an individual NPDES permit. A separate notice will be provided after the draft NPDES permit is prepared.

Coal Applications Received

 A settleable solids instantaneous maximum limit of 0.5 ml/l applied to surface runoff resulting from a precipitation event of less than or equal to a 10-year 24-hour event. If coal will be extracted incidental to the extraction of noncoal minerals, at a minimum, the technology-based effluent limitations identified under coal applications will apply to discharges of wastewater to streams.

MINING ACTIVITY NPDES DRAFT PERMITS

 This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.

Effluent Limits for Coal Mining Activities

 For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

 The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

*The parameter is applicable at all times.

 A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

 Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

 The limits for noncoal mining activities as provided in 25 Pa. Code Chapter 77 are pH 6 to 9 and other parameters the Department may require.

 Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

 In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.

 More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).

 The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES) Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.

 Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.

 Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

 The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public notice and contain the name, address, telephone number and the interest of the party filing the request, and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.

Noncoal NPDES Draft Permits

Cambria District Mining Office: 286 Industrial Park Road, Ebensburg, PA 15931, 814-472-1900.

NPDES No. PA0212326 (Mining Permit No. 56920302), New Enterprise Stone & Lime Co., Inc., P.O. Box 77, New Enterprise, PA 16664, renewal of an NPDES permit for a sandstone quarry in Shade Township, Somerset County, affecting 214 acres. Receiving stream: Laurel Run, classified for the following use: cold water fishes. This receiving stream is included in the Kiski-Conemaugh TMDL. Application received: January 7, 2019.

 Unless otherwise noted for a specific outfall, the proposed effluent limits for all outfalls in this permit are the BAT limits previously described for noncoal mining activities.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

E39022-563. Jaindl Land Company, 3150 Coffeetown Road, Orefield, PA 18069, in Lower Macungie Township, Lehigh County, U.S. Army Corps of Engineers, Philadelphia District.

 To construct and maintain the following water obstructions and encroachments associated with the Orchard Road Stormwater Improvement project.

 1. To relocated approximately 170 linear feet of a UNT to Swabia Creek (HQ-CWF, MF) by constructing and maintaining a stream enclosure consisting of existing dual 48-inch diameter RCP pipes that are approximately 60-feet long and new dual 48-inch diameter RCP pipes that are approximately 125-feet long with junction boxes, endwalls, and a rip rap apron.

 2. To construct and maintain approximately 250 linear feet of a new watercourse channel which includes approximately 60 linear feet of channel lined with rip rap.

 3. To construct and maintain a roadway crossing of a UNT to Swabia Creek (HQ-CWF, MF) consisting of 42-foot long, 24-inch diameter RCP pipe depressed 6-inches below the existing streambed elevation with a headwall and a rip rap apron.

 The project is located approximately 0.06 mile north of the Orchard Road and Scenic View Drive intersection. (Allentown West, PA Quadrangle, Latitude: 40° 30` 45"; Longitude: -75° 34` 45").

E54022-373. Schuylkill County, 401 North 2nd Street, Pottsville, PA 17901, in Port Clinton Borough, Schuylkill County, U.S. Army Corps of Engineers, Philadelphia District.

 To remove the existing structure and to construct and maintain a 34.17-foot wide, dual-span, concrete I-beam, asphalt deck bridge with a concrete pier, abutments, wingwalls and riprap protection across the Little Schuylkill River (CWF, MF) having a 170-foot span and a minimum 13.9-foot underclearance. Additionally, a 15" stormwater outfall incidental to the project will be replaced. The project is located at the intersection of Broad Street and Dock Street. (Auburn, PA Quadrangle, Latitude: 40° 34` 48"; Longitude: -76° 1` 35").

E41-698. Pennsylvania Department of Conservation and Natural Resources, Rachel Carson State Office Building, Harrisburg, PA 17105-8451. Flood Repairs—DR 4292 Area 5, Site 13 & 14 in McIntyre Township, Lycoming County, ACOE Baltimore District (Barbours & Bodines, PA Quadrangles N: 41° 29` 43" W: -76° 51` 51").

 DCNR has applied for an Individual—Joint Permit to construct, operate and maintain a two (2) new permanent stream crossing over Short Run and Long Run along Pleasant Stream Road in McIntyre Township, Lycoming County. The proposed structures are a precast reinforced concrete rigid frame culvert placed approximately 500` north of the existing structure over Short Run and a precast reinforced concrete box culvert placed in the same location as the existing structure over Long Run. The proposed project involves bridge replacements caused by the October 2016 flood event.

 A total of six (6) permanent and four (4) temporary stream impacts are proposed to Short Run (HQ-CWF, EV) and Long Run (HQ-CWF, EV). Project watercourse impacts shall include and be limited to a total of 296 linear feet (4,345 square feet) of permanent stream impacts and 175 linear feet (4,270 square feet) of temporary stream impacts.

 A total of two (2) permanent wetland impacts are proposed. Project wetland impacts shall include and be limited to a total of 2,037 square feet (0.0468 acre) of permanent wetland impacts.

 The applicant proposes to:

 Remove the existing 20.3` wide two-span, closed spandrel arch culvert with an approximately 7` span and 7' under clearance carrying SR 4046 over Lutz Run (WWF) with a drainage area of 2.42 square miles; construct and maintain a 48.81` long single span aluminum box culvert with an approximately 17 foot span and 7 ft under clearance in the same location. The project will permanently impact 80` of Lutz Run (WWF) and temporarily impact 120` of Lutz Run (WWF). No compensatory mitigation is required.

 The project site is located approximately 200 feet east-southeast of the intersection of Connellsville Road and Rehoboth Road (Fayette City, PA USGS topographic quadrangle; N: 40°, 6`, 49.50"; W: -79°, 48`, 45.14"; Sub-basin 19C; USACE Pittsburgh District), in Washington Township, Fayette County.

ENVIRONMENTAL ASSESSMENTS

Southcentral Region: Waterways & Wetlands Program, 909 Elmerton Avenue, Harrisburg, PA 17110, Ed Muzic, Section Chief, 717.705.4802.

EA67-030: Izaak Walton League of America, York Chapter 67, 7131 Ironstone Hill Rd, Dallastown, PA 17313, in Codorus and Springfield Townships, York County, U.S. Army Corps of Engineers Baltimore District.

 The applicant proposes to restore and maintain 1,500 linear feet of South Branch Codorus Creek (WWF-MF) and its floodplain by use of channel relocations, J-hook rock vane deflectors, rock cross vanes, single log vane deflectors, toe wood protection, bank grading and floodplain grading. The project is located north of SR 616 in Codorus and Springfield Townships, York County (39.8065°, -76.7468°).

EA67-031: Codorus Creek Watershed Association, P.O. Box 2881, York, PA 17405, in Codorus and Springfield Townships, York County, U.S. Army Corps of Engineers Baltimore District.

 The applicant proposes to restore and maintain 1,600 linear feet of South Branch Codorus Creek (WWF-MF) and its floodplain by use of channel relocations, J-hook rock vane deflectors, rock cross vanes, single log vane deflectors, modified mud sills, toe wood protection, bank grading and floodplain grading. The project is located north of SR 616 in Codorus and Springfield Townships, York County (39.8076°, -76.7487°).

EA67-032: Izaak Walton League of America, York Chapter 67, in North Hopewell and Springfield Townships, York County, U.S. Army Corps of Engineers Baltimore District.

 The applicant proposes to restore and maintain 2,008 linear feet of East Branch Codorus Creek (WWF-MF) and 206 linear feet of an unnamed tributary to East Branch Codorus Creek and their floodplains by use of channel relocations, log vanes, J-hooks, cross vanes, channel grading and floodplain grading. The project is located immediately north of the intersection of Graydon Road and Swamp Road in North Hopewell and Springfield Townships, York County (39.8554°, -76.6557°).

EA67-033: Izaak Walton League of America, York Chapter 67, in Chanceford and Windsor Townships, York County, U.S. Army Corps of Engineers Baltimore District.

 The applicant proposes to restore and maintain 2,054 linear feet of Pine Run (CWF-MF) and its floodplain by use of channel relocations, log vanes, J-hooks, cross vanes, channel grading and floodplain grading. The project is located immediately south of the intersection of Brownton Road and Runkle Road in Chanceford and Windsor Townships, York County (39.8699°, -76.5629°).

EROSION AND SEDIMENT CONTROL PERMITS

 The following parties have applied for Erosion and Sediment Control Permits for earth disturbance activities associated with either road maintenance or timber harvesting operations.

 Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department proposes to issue a permit to discharge, subject to certain limitations in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices which restrict the rate and quantity of sediment discharged.

 A person wishing to comment on a proposed permit are invited to submit a statement to the appropriate Department regional office listed before the application within 30 days of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and relevant facts upon which it is based. A public hearing may be held after consideration of comments received by the appropriate Department regional office during the 30-day public comment period.

 Following the 30-day comment period, the appropriate regional office water management program manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board (Board).

 The application and related documents, including the erosion and sediment control plan for the earth disturbance activity, are on file and may be inspected at the appropriate regional office.
