THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
APPLICATIONS FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications concern, but are not limited to, discharges regarding industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFO). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 Individual Permits and Individual Stormwater Construction Permits in Sections IV and VI, the Department, based upon preliminary reviews, has made tentative determinations of proposed effluent limitations and other terms and conditions for the permit applications. In accordance with 25 Pa. Code § 92a.32(d), the proposed discharge of stormwater associated with construction activities will be managed in accordance with the requirements of 25 Pa. Code Chapter 102. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the United States Environmental Protection Agency (EPA) Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).
Persons wishing to comment on NPDES applications are invited to submit statements to the contact office noted before the application within 30-days from the date of this public notice. Persons wishing to comment on WQM permit applications are invited to submit statements to the office noted before the application within 15-days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests for public hearings on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

AIR QUALITY
PLAN APPROVAL AND OPERATING
PERMIT APPLICATIONSThe Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.
The Department received applications for Plan Approvals or Operating Permits from the following facilities. Copies of the application, the Department's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate Department Regional Office. Appointments for scheduling a review must be made by calling the appropriate Department Regional Office. The address and phone number of the Regional Office is listed before the application notices.
Persons wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the Department's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.
A person wishing to request a hearing may do so during the 30-day comment period. A public hearing may be held, if the Department, in its discretion, decides that a hearing is warranted based on the information received. Persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper, the Pennsylvania Bulletin or by telephone, when the Department determines this type of notification is sufficient. Requests for a public hearing and any relevant information should be directed to the appropriate Department Regional Office.
Permits issued to the owners or operators of sources subject to 25 Pa. Code Chapter 127, Subchapter D or E, or located within a Title V facility or subject to 25 Pa. Code § 129.51(a) or permits issued for sources with limitations on their potential to emit used to avoid otherwise applicable Federal requirements may be submitted to the United States Environmental Protection Agency for review and approval as a revision to the State Implementation Plan. Final Plan Approvals and Operating Permits will contain terms and conditions to ensure that the sources are constructed and operating in compliance with applicable requirements in the Air Pollution Control Act (35 P.S. §§ 4001—4015), 25 Pa. Code Chapters 121—145, the Federal Clean Air Act (42 U.S.C.A. §§ 7401—7671q) and regulations adopted under the Federal Clean Air Act.

28-03068A: Pennsylvania Cherry, LLC (P.O. Box 269, Mercersburg, PA 17236) on March 23, 2020, for the installation of a lumber processing facility, located in Montgomery and Peters Townships, Franklin County. The Plan Approval authorizes installation of a wood fired boiler controlled by an electrostatic precipitator, and lumber trimming and grinding operations controlled by cyclone separators, and a wood drying kiln. The plan approval was extended, with a compliance schedule.

32-445A: Indiana County Humane Society (191 Airport Road, Indiana, PA 15701). The Department of Environmental Protection intends to issue a plan approval to the Indiana County Humane Society to provide authorization for the construction and initial operation of an animal crematory at their existing facility located in the White Township, Indiana County.
No air emission sources are currently authorized at this facility. The proposed source is not eligible for authorization under the GP-14 due to its limited function door interlocks. The operator also intends to open the crematory's door during operation in order to reposition remains and to reduce cremation cycle times. This crematory was not eligible for authorization under General Plan Approval 14 per the Department's instruction that those facilities which open their primary chamber's door during operation, could no longer use the general permit. Special conditions will be included in this plan approval which address door opening and its impact on emissions and operation. The crematory will be required to meet all emission and temperature requirements while the door is opened and will have additional recordkeeping and monitoring requirements.
This application proposes the installation of a new source at a non-Title V facility. Public notice is obligatory for sources required to obtain a Plan Approval in accordance with 25 Pa. Code § 127.44. The Plan Approval will contain testing, recordkeeping, emission restriction, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements. Potential emissions from the proposed source are estimated to be: less than 2.75 tons per year (tpy) of particulate matter and less than 1.0 tpy (each) of SOx, NOx, CO, VOC, and HAP.
In accordance with 25 Pa. Code § 127.44(f)(1), all the pertinent documents regarding this application (applications, review memos, and draft approvals) are also available for review from 8:00 a.m. to 4:00 p.m. at the Meadville Regional DEP Office (Air Quality). Appointments for scheduling a review must be made by calling the DEP at (814) 332-6940.
In accordance with 25 Pa. Code § 127.44(f)(2), a 30-day comment period, from the date of publication, will exist for the submission of comments. Any person(s) wishing to provide DEP with additional information, which they believe should be considered prior to the issuance of this permit, may submit the information to Regional Air Quality Program Manager, Pennsylvania Department of Environmental Protection, 230 Chestnut Street, Mead- ville, PA 16335-3494 and must contain the name, address and telephone number of the person submitting the comments, identification of the proposed plan approval [32-445A: Indiana County Humane Society] and a concise statement regarding the relevancy of the information or objections to the issuance of the permit.

43-390A: Sherman Funeral Home and Crematory, LLC (2201 Highland Road, Sharpsville, PA 16148). The Department of Environmental Protection intends to issue a plan approval to Sherman Funeral Home and Crematory to provide authorization for the construction and initial operation of a human crematory at their existing facility located in Sharpsville Borough, Mercer County.
No air emission sources are currently authorized at this facility. The proposed source is not eligible for authorization under the GP-14 due to its limited function door interlocks. The City of Philadelphia, Air Management Services (AMS) intends to issue a Plan Approval for installation of air pollution sources at the following facility:
IP20-000032: Amtrak 30th Street Station (2955 Market Street, Philadelphia, PA 19104) for the installation of boilers and air handling units at a railroad station, in the City of Philadelphia, Philadelphia County. The following significant stationary air emission sources are part of the Plan Approval: two (2) boilers firing No. 2 oil rated 0.31 MMBtu/hr and 3.50 MMBtu/hr, three (3) boilers firing natural gas each rated less than or equal to 1 MMBtu/hr, and one (1) air handling unit firing natural gas rated 3.025 MMBtu/hr. Additionally, two (2) insignificant boilers firing No. 2 Oil each rated less than 0.25 MMBtu/hr are also included in the Plan Approval for facility-wide emission calculation, and they are required to follow the applicable requirements in the Plan Approval. The potential emission from the installation are as follows: (1) 5.03 tons per year (tpy) of Nitrogen Oxides (NOx), (2) 2.65 tpy of Carbon Monoxide (CO), (3) 0.45 tpy of Particulate Matter (PM), (4) 0.175 tpy of Volatile Organic Compound (VOC), and (5) 0.043 tpy of Sulfur Oxides (SOx). The plan approval will contain operating, monitoring, recordkeeping, and reporting requirements to ensure operation within all applicable requirements.
The plan approval will be issued under 25 Pa. Code, Philadelphia Code Title 3 and Air Management Regulation XIII. Permit copies and other supporting information are available for public inspection at AMS, 321 University Avenue, Philadelphia, PA 19104. Persons wishing to file protest, comments, or request a public hearing on the previously listed plan approval must submit the protest, comments or request for a public hearing within 30 days from the date of this notice. Any protests or comments filed with AMS must include a concise statement of the objections to the permit issuance and the relevant facts upon which the objections are based. Based upon the information received during the public comment period, AMS may modify the plan approval or schedule a public hearing. The hearing notice will be published in the Pennsylvania Bulletin and a local newspaper at least thirty days before the hearing.
OPERATING PERMITS

09-00124: Edgewater Generation Holdings LLC (aka Fairless Energy, LLC) (50 Energy Drive, Fairless Hills, PA 19030) for renewal of a Title V Operating Permit in Falls Township, Bucks County. There have been no source changes at the facility since the operating permit was last amended in 2017. Sources at the facility include four (4) combined cycle natural-gas fired combustion turbines with duct burners, two (2) natural-gas pipeline heaters, four (4) mechanical draft cooling towers, an auxiliary boiler, and an emergency diesel fire pump. The diesel fire pump engine is subject to 40 CFR Part 60, Subpart ZZZZ. Fairless Energy, LLC is a major facility for NOx, VOC, CO, and PM. The renewal of this operating permit does not authorize any increase in air emissions of any regulated pollutants above previously approved levels. The permit includes monitoring, recordkeeping, and reporting requirements designed to address all applicable air quality requirements.
09-00077: Exelon Generation Company, LLC (1 Industrial Highway, Eddystone, PA 19022) for renewal of the Title V Operating Permit for its Pennsbury Power Plant located in Falls Township, Bucks County. The facility is a peaking power plant, containing two land fill gas fired simple cycle combustion turbines, with a maximum capacity of 48 MMBtu/hr each. One of the turbines has been inactive since October 2018 and will require a Plan Approval to become operational, pursuant to 25 Pa. Code § 127.11a.
As a result of potential emissions of NOx the facility is classified as Title V. The company has estimated emissions in tons per year as: carbon monoxide (CO)—30.88; nitrogen oxides (NOx)—40.33; sulfur dioxide (SO2)—1.35; particulate matter (PM)—5.87; volatile organic compounds (VOC)—2.3 and hazardous air pollutants (HAP)—0.02.
The turbines are subject to the Federal regulation 40 CFR Part 60 Subpart GG—Standard of Performance for Stationary Gas Turbines. The proposed renewed Title V Operating Permit does not authorize any increase in air emissions of regulated pollutants above previously approved levels. The renewal contains all applicable requirements including monitoring, recordkeeping and reporting.
Upon final approval, the permit will be renewed for a period of five (5) years.

41-00001: Transcontinental Gas Pipe Line Company, LLC (P.O. Box 1396, Houston, TX 77251-1396) to issue a renewal Title V Operating Permit for their Compressor Station 520 located in Mifflin Township, Lycoming County. The facility is currently operating under Title V Operating Permit 41-00001. The facility's main sources include five reciprocating internal combustion engines and three combustion turbines which are used to drive the compressors at the facility. The facility has potential emissions of 569 tons per year (TPY) of nitrogen oxides, 279 TPY of carbon monoxide, 10 TPY of particulate matter less than 2.5 microns in diameter, 69 TPY of volatile organic compounds, 2 TPY of sulfur oxides, 35 TPY of hazardous air pollutants, and 165,000 TPY of greenhouse gases (CO2 equivalent). No emission or equipment changes are being proposed by this action. The emission limits, throughput limitations and work practice standards along with testing, monitoring, recordkeeping and reporting requirements have been included in the operating permit to ensure the facility complies with all applicable Federal and State air quality regulations. These operating permit conditions have been derived from the applicable requirements of 40 CFR Parts 60 and 63 and 25 Pa. Code Article III, Chapters 121—145. All pertinent documents used in the evaluation of the application are available for public review during normal business hours at the Department's Northcentral Regional Office, 208 West Third Street, Suite 101, Williamsport, PA 17701. 46-00174: Montgomery County SPCA (19 E. Ridge Pike, Conshohocken, PA 19428-0222), located in White- marsh Township, Montgomery County, for a renewal of State Only (Natural Minor) Operating Permit No. 46-00174. The Montgomery County SPCA operates and maintains an animal crematory unit, from which the main pollutants emitted are nitrogen oxides (NOx) and particulate matter (PM). The actual emission rates ofNOx and PM from the crematory unit are each less than one ton per year. No significant changes have occurred at the facility since the State Only Operating Permit (SOOP) was previously renewed in 2014. The renewed SOOP will continue to include monitoring, recordkeeping, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.
46-00244: ACME Corrugated Box Inc. (2700 Turnpike Dr., Hatboro, PA 19040) for the renewal of a Natural Minor Operating Permit in Upper Moreland Township, Montgomery County. The source of emissions at this facility is a dual fired boiler, which burns natural gas as the primary fuel. The boiler is subject to 40 CFR Part 60 Subpart Dc. The permit contains monitoring, recordkeeping, reporting, and work practice standards designed to keep the facility operating within all applicable air quality requirements.
FEDERAL WATER POLLUTION
CONTROL ACT, SECTION 401The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341), requires the State to certify that the involved projects will not violate the applicable provisions of sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30-days of the date of this notice, as well as any questions to the office noted above the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed, and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between the hours of 8:00 AM and 4:00 PM on each working day at the office noted above the application.

E4002220-021. Wyoming Valley Sanitary Authority, P.O. Box 33A, Hanover, PA 18706-1333, in Hanover Township, Luzerne County, U.S. Army Corps of Engineers, Baltimore District.
To construct and maintain a stream restoration project in a 600-foot reach of Spring Run (CWF, MF) using natural stream channel design techniques for the purpose of improving channel stability and stormwater management. Work will include re-grading of the channel to resolve eroded cut banks, regrading the floodway, removing sediment and debris, random boulder placement, installation of 2 log/root wad/boulder revetment areas, installation of 2 brush mattresses, live stake plantings, live fascine plantings and individual tree/brush plantings.
The project is located 0.35 mile west of the intersection of Hazle Street and West Liberty Street (Wilkes-Barre West, PA Quadrangle Latitude: 41° 13` 22.18"; Longitude: 75° 54` 11.65") in Hanover Township, Luzerne County. (Wilkes-Barre West, PA Quadrangle, Latitude: 41° 13` 22.18"; Longitude: 75° 54` 11.65").

To construct and maintain the following water obstructions and encroachments associated with the Capital Quarry Restoration Project:
1) To fill and maintain an existing, abandoned, 10.77-acre water-filled lacustrine slate quarry pit having permanent pool depths ranging from 60-ft to 150-ft for the purpose of eliminating a safety hazard and preparing the site for potential future development.
2) To fill a 2-ft wide, 83-ft long, intermittent UNT to Martins Creek (CWF, MF) for the purpose of site grading associated with Phase # 1 of the project.
3) To fill 0.006-acre of PEM wetlands for the purpose of site grading associated with Phase # 3 of the project.
4) To fill a 1-ft wide, 73-ft long, intermittent UNT to Martins Creek (CWF, MF) for the purpose of site grading associated with Phase # 3 of the project.
The project is located on the north side of West Central Avenue (S.R. 512), approximately 0.4-mile northwest of the intersection of West Central Avenue (S.R. 512) and North Broad Street (S.R. 1035), (Bangor and Stroudsburg, PA Quadrangle Latitude: 40° 52` 52"; Longitude: 75° 11` 31") in East Bangor Borough, Northampton County.

E5904220-021. PA Department of Conservation and Natural Resources, 262 Sizerville Road, Emporium, PA 15834. Owassee Road Slide Repair, in Shippen Township, Tioga County, ACOE Baltimore District (Tiadaghton, PA Quadrangle; Latitude: 41° 43` 47"; Latitude 77° 25` 56").
To construct and maintain 300 ft of streambank stabilization along Pine Creek in Shippen Township, Tioga County. The purpose of the project is to stabilize the roadway slope along Owassee Road, which is starting to fail. R-7 will be benched into the embankment. The road parallels Pine Creek, which is listed as a Keystone Select Trout Stocked and Special Regulation trout stream. It is also designated as a National Wild and Scenic Rivers as part of the Commonwealths Scenic River System. The total disturbed area along the embankment is 0.41 acre. Traffic will be detoured during construction. A PNDI search determined several species of concern to be potentially present. Coordination for clearances is being performed. A wetland delineation determined no wetlands at the project site.

To construct a raised walkway at the Edinboro Lake Resort over Edinboro Lake. The walkway will be approximately 3 feet above ordinary pool elevation of the lake and approximately 437 feet long and extend approximately 8 feet over the lake.
E3306120-023, PADOT, Engineering District 10-0, 2550 Oakland Ave., Indiana, PA 15701. SR 0028, Section 554, in Rose Township, Jefferson County, ACOE Pittsburgh District (Brookville, PA Quadrangle N: 41°, 08`, 46"; W: 79°, 06`, 46").
To remove the existing structure and to construct and maintain a 131.75-ft long single-cell precast concrete box culvert having a 12.0-ft wide by 10.0-ft high waterway opening on SR 0028, Section 554, Segment 0170, Offset 0000 over Clement Run (CWF) and to temporarily install and maintain a temporary roadway immediately upstream of the existing structure to maintain traffic during construction of the proposed structure. Adjustments to the proposed culvert length and alignment will result in the permanent loss of 39.0-ft of stream channel. Additionally, the project will result in the slight relocation of a 95-ft section of Clement Run downstream of the proposed structure, for which the applicant proposes stream mitigation and enhancements to offset the loss of stream length. The project will result in a total of 188-ft of permanent stream impacts and 450-ft of temporary stream impacts to Clement Run. No wetland impacts are proposed.
E1006120-021, PA Department of Transportation, District 10-0, 2550 Oakland Ave., Indiana, PA 15701. SR 0228-270 Balls Bend, in Middlesex Township, Butler County, ACOE Pittsburgh District (Valencia, PA Quadrangle N: 40.699353°, W: 79.948779°).
To conduct the following activities associated with the widening and realignment of approximately 1.6 mile of SR 0228-270 extending west from its intersection with SR 8:
1. Construct and maintain a 228-foot long, 18-foot wide by 8-foot high (7-foot effective w/ invert depression and baffles) single cell pre-cast concrete box stream enclosure in a tributary to Glade Run at Station 287+80 and to realign a total of 228 feet of the stream channel extending approximately 140 feet upstream and 88 feet downstream of the structure.
2. Construct and maintain an 88.7-foot wide steel plate girder bridge on integral abutments providing a normal span of 165.15 feet and minimum underclearance of 15.65 feet across Glade Run at station 294+40 and to realign approximately 130 feet of the channel of Glade Run at approximately station 291+30 LT associated with the construction of the approach fill to the bridge.
3. Construct and maintain a 207-foot long, 14-foot wide by 10-foot high (9-foot effective w/ invert depression and baffles) single cell pre-cast concrete box stream enclosure in a tributary to Glade Run at station 326+10 and to realign a total of 906 feet of the channel extending approximately 125 feet upstream and 781 feet downstream of the structure.
4. To construct and maintain a 89-foot long, 24-foot wide by 10-foot high (9-foot effective w/ invert depression and baffles) single cell pre-cast concrete box culvert in a tributary to Glade Run on Park Road and to realign a total of approximately 544 feet of the channel of a tributary to Glade Run extending 419 downstream and 125 feet upstream from the structure.
5. To place fill within the floodplain of tributary to Glade Run to maintain private driveway access from Park Road starting at station 104+20.
6. To remove the existing structure and to construct and maintain a 120-foot long, 36-inch diameter reinforced concrete pipe carrying tributary to Glade Run (Stream 13) at Station 344+90, with an outfall and rock apron discharging to tributary to Glade Run (UNT 7) and to place fill within the floodplain of UNT 7 as part of the proposed roadway fill slope.
7. To permanently fill a 0.23-acre pond at station 203+50 along a relocated section of Harbison Road to accommodate the new roadway alignment.
8. To remove the existing concrete arch from a tributary to Glade Run at station 154+10 on the existing S.R. 228 alignment.
9. To remove the existing concrete slab bridge across Glade Run at station 184+50 on the existing S.R. 228 alignment.
10. To permanently impact a total of 1.216 acre of wetlands.
11. To temporarily impact a total of 0.137 acre of wetlands.
The project will result in a total of 3,311-feet of permanent impacts to existing stream channel, which includes 613-feet of proposed structure length. The applicant proposes 1,813-feet of stream relocation and 2,602-feet of stream improvements within the corridor as stream mitigation. A total of 721-feet of temporary stream impacts are proposed during construction. Existing structures will be removed, and areas of existing roadway not required for the new alignment will be restored to vegetated conditions. The applicant proposes to create a total of 2.35 acres of wetland onsite to mitigate the permanent wetland impacts.

To install a 63.0-inch, polyethylene pipe liner within the existing 72.0-inch corrugated metal pipe carrying a UNT to French Creek under SR 1001 in Woodcock Township, Crawford County. The project is located on Park Avenue (SR 1001) approximately 0.15 mile north of its intersection with Hogue Road. The project will permanently impact approximately 150 linear feet of the UNT to French Creek. No wetland impacts are proposed.
