THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS The Department has taken the following actions on previously received applications for new, amended, and renewed NPDES and WQM permits, applications for permit waivers, and NOIs for coverage under General Permits, as listed in the following tables. This notice of final action is published in accordance with 25 Pa. Code Chapters 91, 92a, and 102 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376). The official file for each listed action can be reviewed at the DEP or delegated county conservation district (CCD) office identified in the table for the action. DEP/CCD office contact information is listed as follows for Section I and is contained within the table for Section II. Additional information for permits issued under 25 Pa. Code Chapters 91 and 92a, including links to Individual NPDES and WQM Permits, may be reviewed by generating the ''Final Actions Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice.

Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

The proposed collection and conveyance system will include capacity to serve 668 additional EDU's of commercial flow from a proposed 350-acre business park, as well as 20 potential future residential EDU's. The proposed pump station and forcemain will convey the sewage to the City of Dubois' sewer system via one of two potential routes. The City of DuBois' recently approved Act 537 Plan, as well as the inter-municipal agreement between Sandy Township and the City of DuBois includes the flow generated by this project. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF

PUBLIC NOTICE OF PROPOSED CONSENT ORDER AND AGREEMENT
North Penn Area 7 Superfund Site, Lansdale Borough, North Wales Borough, and Upper Gwynedd Township, Montgomery County.
The Department of Environmental Protection (Department), under the authority of the Pennsylvania Hazardous Sites Cleanup Act (HSCA), 35 P.S. § 6020.1113, has entered a Consent Order and Agreement with VVChurch, LLC, for its purchase of the property located at 1180 Church Road in Lansdale, PA 19446. This Site is located within the larger North Penn Area 7 Superfund Site (the North Penn 7 Site) which consists of approximately 650 acres of impacted properties in Upper Gwynedd, North Wales and Lansdale, Montgomery County, PA. Five industrial facilities are the primary sources of groundwater contamination including volatile organic compounds which have affected properties in the North Penn 7 Site. VVChurch, LLC, will develop the Site for commercial uses such as a hotel, light industrial facilities and other ancillary businesses.
Hazardous substances within the meaning of Section 103 of the Hazardous Sites Cleanup Act, 35 P.S. § 6020.103, were released and threatened to be released on the Site. Pursuant to Section 501(a) of HSCA, 35 P.S. § 6020.501(a), the Department has incurred past response costs and may incur future response costs associated with remediation of the Site. VVChurch, LLC, has represented to the Department that it did not cause or contribute to the contamination impacting the Site or the larger North Penn 7 Site, and that it is not otherwise responsible for any releases or threatened releases of hazardous substances at these Sites. The Department is not aware of any information to the contrary which would indicate such liability.
VVChurch, LLC, signed a Consent Order and Agreement to resolve its potential liability as an owner of the Site where there has been a release and threatened release of hazardous substances. Pursuant to the Consent Order and Agreement, VVChurch shall pay a de minimus share of liability in the amount of Five Thousand Dollars ($5,000) and in consideration of this payment, VVChurch will receive contribution protection, as well as a Covenant Not to Sue regarding its prospective purchase of the Site.
This notice is provided under Section 1113 of HSCA, 35 P.S. § 6020.1113, which states that,''settlement shall become final upon the filing of the Department's response to significant written comments.'' If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. Code § 127.449(i), this Pennsylvania Bulletin Notice is for de minimis emissions increases of 0.01 ton of NOx, 0.008 ton of VOC, 0.02 ton of CO, 0.005 ton of PM and 0.007 ton of SOx. The increases will result from a trial run of a new bark grinder and its associated Tier 4 diesel-fired internal combustion engine to grind bark from the wood chipping operation into small pieces to be burned in the # 3 Power Boiler.
