FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of Sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), and that the construction will not violate applicable Federal and State Water Quality Standards.

 1. Remove 1,125 feet of an existing 36-inch by 48-inch corrugated metal stormwater pipe in an unnamed tributary (UNT) to the Monongahela River (WWF);

 2. Remove 402 feet of an existing 15-inch corrugated plastic stormwater pipe from the UNT, which parallels the downstream extent of the aforementioned stormwater pipe;

 3. Construct and maintain 1,000 feet of restored open channel with live stake plantings, in place of the aforementioned/removed stormwater pipes, including the excavation of a de minimus PEM wetland (0.02 acre) along this UNT;

 4. Construct, operate, and maintain a bottomless aluminum culvert, with a span of 14`-8", a rise of 4`-1", and length of 40`-6", to carry N. Redwood St. over the restored UNT, with wingwalls, the total stream impact will be 58 feet;

 5. Construct, operate, and maintain a replacement 36-inch by 48-inch corrugated metal stormwater pipe for 47 feet in the restored UNT, with a 5-foot by 14-foot by 4-foot concrete end wall;

 6. Operate and maintain an existing concrete bridge for 40 feet to carry River Ave. over the restored UNT;

 7. Construct, operate, and maintain an 18-inch diameter SDR-35 sanitary utility line crossing with a 30-foot Right-of-Way (RoW) across the restored UNT;

 8. Construct, operate, and maintain a 6-inch diameter PVC water utility line crossing with a 30-foot RoW across the restored UNT;

 9. Construct, operate, and maintain an 8-inch diameter SDR-35 sanitary utility line crossing with a 30-foot RoW across the restored UNT;

 10. Construct, operate, and maintain a 10-inch diameter PVC water utility line crossing with a 30-foot RoW across the restored UNT;

 11. Construct, operate, and maintain stream bank protection consisting of slope protection with R-5 riprap for 155 feet along both banks of another downstream reach of Watercourse B (UNT to the Monongahela River (WWF));

 12. Remove 110 feet of an existing gravel bar along the left descending bank of the UNT. The cumulative impact for stream bank protection and gravel bar removal along the UNT is 155 feet;

 13. Construct an open channel outfall into Watercourse B which will permanently impact 40 feet of Watercourse B; and

 14. Permanently impact 1.50 acres of floodway due to the aforementioned items.

 For the purpose of preventing flooding and preventing the stream banks from eroding. Cumulatively, the project will permanently impact 1,470 feet of the UNT. The project site is located at 218 River Avenue, Masontown, PA 15461 (Masontown, PA USGS topographic quadrangle; N: 39°, 50`, 54.5"; W: -79°, 54`, 49.5"; Sub-basin 19G; USACE Pittsburgh District), in Masontown Borough, Fayette County.

WATER MANAGEMENT

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the Regional Permit Coordination Office as noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates.

DRAFT STATE WATER QUALITY CERTIFICATION FOR A FERC REGULATED PIPELINE PROJECT


Proposed State Water Quality Certification Required by the Commonwealth of Pennsylvania, Department of Environmental Protection Pursuant to Section 401 of the Clean Water Act for the Perulack Compressor Units Replacement Project.

WQ3483220-001, Texas Eastern Transmission, LP, 890 Winter Street, Suite 320, Waltham, MA 02451. Perulack Compressor Units Replacement Project, in Lack Township, Juniata County, U.S. Army Corps of Engineers, Baltimore District. The proposed project is located at Perulack Compressor Station situated off Pumping Station Road (Latitude: 40.35583°; Longitude: -77.65389°).

 On January 15, 2021, Applicant filed an application with the Federal Energy Regulatory Commission (FERC) under Section 7 of the Natural Gas Act (15 U.S.C.A. § 717f) seeking a certificate of public convenience and necessity to construct and operate its Project (FERC Docket No. CP21-31-000).

 On November 16, 2020, the Applicant requested a state water quality certification (SWQC) from the Pennsylvania Department of Environmental Protection (PADEP), as required by Section 401 of the Clean Water Act (33 U.S.C.A. § 1341), to ensure that the construction, operation and maintenance of the Project will protect water quality in Pennsylvania consistent with the requirements of State law and the Clean Water Act.

 The Project, as proposed, includes replacement of four existing compressor units and related facilities with two new gas turbine units and associated facilities to comply with future air emission reduction requirements. The Project also includes the construction of a new compressor building to house the two new compressor units. The existing compressor units are in two separate compressor buildings, one of which will be removed from service but remain in place and the other will be removed. Additional facilities to be updated or installed include a generator building, an electrical control building with battery extension, a service entrance building, and an auxiliary building, as well as the installation of four filter separators. In addition, the project will result in the installation of a new, lined stormwater retention basin. The Project, as proposed, will require approximately 30.6 acres of earth disturbance and impacts to 1.04 acres of floodway.

 PADEP, by this notice, is proposing to issue a SWQC to Texas Eastern Transmission, LP for the Perulack Compressor Units Replacement Project. PADEP is proposing to certify that construction, operation and maintenance of the Perulack Compressor Units Replacement Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The PADEP is proposing to further certify that the construction, operation and maintenance of the Perulack Compressor Units Replacement Project complies with Pennsylvania water quality standards and will maintain and protect applicable Commonwealth water quality standards provided that the construction, operation and maintenance of the project complies with the following PADEP water quality permitting programs, criteria and conditions established pursuant to Pennsylvania law:

 1. Discharge of Hydrostatic Test Water—Applicant shall obtain and comply with a National Pollutant Discharge Elimination System (NPDES) permit(s) for the discharge of water from the hydrostatic testing of the pipeline associated with the Project pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001), 25 Pa. Code Chapter 92a (relating to NPDES permitting, monitoring and compliance), and all other applicable regulations.

 2. Erosion and Sediment Control and Stormwater Management—All projects proposing earth disturbance must implement best management practices (BMPs) to protect and maintain water quality pursuant to Pennsylvania's Clean Streams Law (35 P.S. §§ 691.1—691.1001) and Storm Water Management Act (32 P.S. §§ 680.1—680.17), 25 Pa. Code Chapter 102 (relating to erosion and sediment control), and all other applicable regulations. Applicant shall obtain and comply with an Erosion and Sediment Control Permit(s) for earth disturbance associated with the Project as provided in 25 Pa. Code § 102.5.

 3. Water Obstruction and Encroachment Permits—Applicant shall obtain and comply with a Water Obstruction and Encroachment Permit(s) for the construction, operation and maintenance of all stream and wetland crossings associated with the Project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27), and Flood Plain Management Act (32 P.S. §§ 679.101—679.601), 25 Pa. Code Chapter 105 (relating to dam safety and waterway management), 25 Pa. Code Chapter 106 (relating to floodplain management) and all other applicable regulations.

 4. Other Water Quality Requirements—Applicant shall obtain any other permits, authorizations or approvals required to construct, operate, and maintain the Project from any interstate or international agency as required by an interstate compact or international agreement that has established water quality standards applicable to surface waters of this Commonwealth, including wetlands.

 5. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that water quality in the receiving waters associated with the Project is not adversely impacted by any operational and construction process that may be employed by Applicant.

 6. Operation—At all times, Applicant shall properly operate and maintain all Project facilities and systems of treatment and control (and related appurtenances) installed to achieve compliance with the terms and conditions of this SWQC and all required permits, authorizations and approvals. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Applicant.

 7. Inspection—The Project, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of PADEP or the delegated County Conservation District to determine compliance with this SWQC, including all permits, authorizations or approvals issued to ensure the project shall maintain and protect state water quality standards as required by this SWQC. The Applicant shall provide a copy of this SWQC to an authorized representative conducting an inspection of the Project.

 8. Transfer of Projects—If Applicant intends to transfer any legal or equitable interest in the Project or any portion(s) thereof, the Applicant shall provide a copy of this SWQC and copies of any permits, authorizations or approvals obtained to comply with the SWQC upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the appropriate PADEP Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owners containing a specific date for transfer of responsibility, coverage, and liability under the SWQC and any permits, authorizations and approvals obtained to comply with the SWQC. The new owner shall submit to PADEP a new application form for the SWQC and any permits, authorizations and approvals required to comply with the SWQC signed by the new owner.

 9. Correspondence—All correspondence with and submittals to PADEP concerning this SWQC shall be addressed to the Department of Environmental Protection, Regional Permit Coordination Office, Domenic Rocco, P.E., Director, 400 Market Street, Harrisburg, PA 17101, RA-EPREGIONALPERMIT@pa.gov.

 10. Reservation of Rights—PADEP may modify, suspend or revoke this SWQC if (i) PADEP becomes aware of new facts about the Project that warrant such action; or (ii) PADEP determines that the Applicant has not complied with the terms and conditions of this SWQC. PADEP may require additional measures to achieve compliance with any applicable law or regulation.

 11. Other Laws—Nothing in this SWQC shall be construed to preclude the institution of any legal action or to relieve Applicant from any responsibilities, liabilities, or penalties established pursuant to any applicable law or regulation.

 12. Severability—The provisions of this SWQC are severable and should any provision of this SWQC be declared invalid or unenforceable, the remainder of the SWQC shall not be affected thereby.

EROSION AND SEDIMENT CONTROL

 The following parties have applied for Erosion and Sediment Control Permits for earth disturbance associated with oil and gas exploration, production, processing, or treatment operations or transmission facilities.

 Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department proposes to issue a permit to discharge, subject to certain limitations in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices which restrict the rate and quantity of sediment discharged.

The Department of Environmental Protection (Department) provides notice of receipt of an application for a Chapter 102, Erosion and Sediment Control General Permit for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment Operations or Transmission Facilities. The application is currently under technical review for Perulack Units Replacement Project, which will involve replacement of the existing compressor units and related facilities. The project is located in Lack Township, Juniata County.

 This authorization is required for earth disturbance activities associated with oil and gas exploration, production, processing or treatment operations or transmission facilities when earth disturbance is five acres or greater. Review of this application is being coordinated among the Department and the associated county conservation districts.

PUBLIC COMMENTS FOR STATE WATER QUALITY CERTIFICATION AND EROSION AND SEDIMENT CONTROL

 A person wishing to comment on a proposed permit are invited to submit a statement to the appropriate Department office listed before the application within 30 days of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and relevant facts upon which it is based. A public hearing may be held after consideration of comments received by the appropriate Department office during the 30-day public comment period.

 Following the 30-day comment period, the program manager from the appropriate Department office will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to United States Court of Appeals for the 3rd Circuit, 21400 U.S. Courthouse, 601 Market Street, Philadelphia, PA 19106-1790.

Proposed Total Maximum Daily Loads (TMDLs) for the Licking Creek Subwatershed in Franklin County.

 The Department of Environmental Protection will accept comments on the proposed ''TMDLs'' developed for a subwatershed of Licking Creek in Franklin County under Section 303(d) of the Clean Water Act. The Pennsylvania Integrated Water Quality Monitoring and Assessment Report included stream segments impaired for aquatic life in the subwatershed. The impairments addressed by this document were caused by excessive siltation due to agriculture.

 There currently are no state or Federal in-stream numerical water quality criteria for sediment. Therefore, the Department utilized a reference watershed approach to implement the applicable narrative criteria. The proposed TMDL document sets allowable loading of sediment in the Licking Creek Subwatershed. The ''TMDLs'' included allocations for nonpoint sources, reserves for existing and future point sources, as well as margin of safety factors. Nonpoint source load allocations were made for cropland, hay/pasture land, and streambank source sectors present in the subwatershed. Data used in establishing the TMDL were primarily generated using a water quality analysis model (Model My Watershed) made available through the Stroud Water Research Center.
