LAND RECYCLING AND

PREAMBLE 2
The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).
Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

37-00243: Inmetco, LLC, 1 Inmetco Drive, Ellwood City, PA 16117-6231, on December 21, 2021, the Department re-issued the Title V Operating Permit. Inmetco's facility is primarily used for the recovery and recycling of metals through the secondary smelting of non-ferrous metals from metal bearing wastes located in Ellwood City Borough, Lawrence County. The facility's air emission sources include a Rotary Hearth Furnace (RHF), Submerged Electric Arc Furnace (SEAF), material handling equipment, miscellaneous natural gas fired process and combustion units, an emergency generator, and a parts washer. The facility is a major stationary source as defined in Title I, Part D of the Clean Air Act Amendments due to the facility's potential to emit Nitrogen Oxide (NOx), Volatile Organic Compounds (VOC), and Carbon Monoxide (CO) emissions. The facility is therefore subject to the Title V Operating Permit requirements adopted in 25 Pa. Code Chapter 127, Subpart G. The 2020 actual emissions reported from the facility were 388 TPY CO, 0.02 TPY lead, 61.5 TPY NOx, 9.9 TPY PM-10, 46.8 TPY SOx, and 22.5 TPY VOC.

10-00062: PA State System of Higher Education, Slippery Rock University, Maintenance Center, Slippery Rock, PA 16057-1313. The Department, on January 3, 2022 issued the State Only Operating Permit for the boilers, emergency engines, and parts washer located in Slippery Rock Borough, Butler County. The sources at the facility include three (3) bituminous coal/gas fired boilers, two (2) natural gas fired boilers, emergency engines, and a parts washer. The facility was previously a Title V facility. The coal fired boilers meet the definition of limited use with an annual capacity factor of 10 percent. The facility requested an elective emission restriction for the coal of 1.6% by weight. The emissions were verified via stack test. With the limited amount of coal and the fuel restriction, the SO2 emissions are less than 93.7 TPY on a 12-month rolling basis and therefore the facility is no longer considered a major source of SOx emissions. The permit contains emission restrictions, testing, monitoring, recordkeeping, reporting, work practice, and additional requirements from the previous plan approvals to ensure compliance with the Clean Air Act and the Air Pollution Control Act. The emergency engines built after January 1, 2009 are subject to 40 CFR 60 Subpart JJJJ pertaining to NSPS for Reciprocating Internal Combustion Engines. The boilers are subject to the NESHAPs in 40 CFR 63 Subpart JJJJJJ. The particulate emissions from the coal fired boilers are controlled by fabric collectors.
32-00387: Rosebud Mining Company, Crooked Creek Coal Preparation Plant, 301 Market Street, Kittanning, PA 16201, on January 11, 2022, the Department issued an initial State Only Operating Permit for operating of a coal preparation plant located in Washington Township, Indiana County. The subject facility consists of stockpiles, conveyors, screens, a crusher, transfer points, magnetite storage, wet coal preparation plant, raw feed, clean coal, coarse and filter cake refuge storage, load-in and load-out truck, load-out for rail and an emergency generator for the mine. Emissions from the facility are based on the coal throughput limit, hours of operating, and AP-42 emission factors. The facility has the potential to emit 167.8 TPY PM, 53.83 TPY PM-10, and less than 1 TPY for all other criteria pollutants. The facility is a natural minor and is subject to State and Federal Regulations (40 CFR Part 60 Subpart Y and IIII). This request, received January 19, 2022, is entitled Major Amendment Request Marsh Creek Sediment Remediation, Upper Uwchlan Township, Chester County. This amendment was submitted as required under the terms of the Consent Order and Agreement entered into between the Pennsylvania Department of Environmental Protection, the Pennsylvania Department of Conservation and Natural Resources, and SPLP dated December 6, 2021.
This Major Amendment is requested to support the dewatering of sediment dredged from a predetermined area of Marsh Creek Lake. The sediment dredging plan is detailed in the submitted Marsh Creek Lake Impact Assessment and Restoration Plan dated December 3, 2021, and approved by the Department on December 6, 2021.
Hydraulically dredged sediments will be pumped to an upland sediment management area (SMA) to be passively dewatered using geotextile tubes. Following completion of sufficient dewatering, sediment will be loaded onto trucks for transportation off-site for disposal at an approved disposal facility. All facilities will be temporary, and all upland areas will be restored back to existing conditions, grades, and elevations following completion of sediment load-out work. Access to the workspace will utilize a rock construction entrance off Lakeview Road.
An increase to the limits of disturbance (LOD) of 4.06 acres is being requested. This includes 1.37 acres of proposed bulk earthwork where areas will be topsoiled and graded for the purposes of installing the rock construction entrance, temporary construction road and the preparation of the SMA where the geotubes will be placed. The remaining 2.69 acres will be used for the temporary storage of materials, products or equipment associated dredging and dewatering activity and will not be topsoiled or graded. Utilization of these areas is not proposed to result in earth disturbance but will include erosion and sedimentation (E&S) controls and have been included as part of the LOD.
