 Under section 2002 of The Administrative Code of 1929 (71 P.S. § 512) establishing the Department of Transportation (Department), the Director of the Bureau of Design and Delivery, as delegated by the Secretary of Transportation, makes the following written findings:

 The Department is planning the following listed projects. Environmental and Section 4(f) Documentation have been developed for the following identified projects to evaluate the potential environmental impacts caused by these projects. The Section 4(f) documents also serve as the Section 2002 Evaluation. The approved documents are available in the CE/EA Expert System at http://www.dotdom2.state.pa.us/ceea/ceeamain.nsf. The environmental, economic, social and other effects of the proposed projects have been considered. Based upon studies, there is no feasible and prudent alternative to the use of the Section 2002 resources for the proposed projects identified and all reasonable steps have been taken to minimize the effects.

• SR 4009, Section A01—Menno Township, Mifflin County.

Project Description: The project is the replacement of the existing bridge that carries SR 4009 (Waynesburg Road) over an unnamed tributary (UNT) to Kishacoquillas Creek.

Environmental Documents: ED Bridge and Roadway Programmatic Agreement (BRPA) Evaluation approved on January 13, 2023, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on January 12, 2023.

Proposed Use of Section 4(f)/2002 Resource: Approximately 0.04-acre of right-of-way (ROW) will be required from the Graybill Farm and approximately 0.08-acre of ROW will be required from the Yoder Farm, which are assumed to be contributing elements to the potentially eligible agricultural historic district.

• SR 0044, Section 064—Jersey Shore Borough, Lycoming County.

Project Description: The project is the replacement of the existing structure that carries SR 0044 over a UNT to West Branch of the Susquehanna River.

Environmental Documents: ED BRPA Reevaluation approved on March 1, 2023, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on September 16, 2022.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.092-acre of ROW will be required from the Jersey Shore Historic District, which was determined to be eligible for listing on the National Register of Historic Places (NRHP).

• SR 0087, Section 130—Hillsgrove Township, Sullivan County.

Project Description: The project is the rehabilitation of the existing bridge that carries SR 0087 over Ogdonia Creek.

Environmental Documents: Categorical Exclusion (CE) BRPA Evaluation approved on March 9, 2023, and Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on March 7, 2023.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.16-acre of ROW will be required from Camp Lycogis, which was determined to be eligible for listing on the NRHP.

• SR 0287, Section 158—Morris Township, Tioga County.

Project Description: The project is a slide repair and involves placing rock protection between Wilson Creek and SR 0287.

Environmental Documents: CE 1a Reevaluation approved on January 10, 2023, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Public Parks, Recreation Areas, Wildlife and/or Waterfowl Refuges, State Forest Land and State Game Land approved on January 10, 2023.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.25-acre of ROW will be required from the 161,890-acre Tioga State Forest, which qualifies as a Section 4(f)/2002 resource.

• SR 0011, Section 357—Hunlock Township, Luzerne County.

Project Description: The project is the superstructure replacement of the existing bridge that carries SR 0011 over Hunlock Creek.

Environmental Documents: CE BRPA Evaluation approved on March 22, 2023, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on May 16, 2022.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.11-acre of ROW will be required from the Delaware, Lackawanna and Western Railroad, which was determined to be eligible for listing on the NRHP.

• SR 4041, Section 651—Preston Township, Wayne County.

Project Description: The project is the superstructure replacement of the existing bridge that carries Rock Lake Drive (SR 4041) over Equinunk Creek.

Environmental Documents: CE 2 Evaluation approved on March 9, 2023, and a Nationwide/Programmatic Section 4(f) Evaluation for Projects that Necessitate the Use of Historic Bridges approved on February 1, 2023.

Proposed Use of Section 4(f)/2002 Resources: The existing Rock Lake Drive Bridge was determined to be eligible for listing on the NRHP.

• SR 2049, Section BLW—Middletown Township, Bucks County.

Project Description: The project is the improvement of Langhorne-Yardley Road (SR 2049) between Bridgetown Pike (SR 2010) and Woodbourne Road (SR 2033).

Environmental Documents: CE 2 Reevaluation approved on February 3, 2023, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Public Parks, Recreation Areas, Wildlife and/or Waterfowl Refuges, State Forest Land and State Game Land approved on March 30, 2020.

Proposed Use of Section 4(f)/2002 Resources: Approximately 2.91-acre of ROW will be required from the 1,185-acre Core Creek Park, which qualifies as a Section 4(f)/2002 resource.

• SR 1023, Section CB6—East Pikeland Township, Chester County.

Project Description: The project is the replacement of the existing bridge that carries Merlin Road Bridge (SR 1023) over Pigeon Run.

Environmental Documents: ED BRPA Reevaluation approved on January 12, 2023, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on March 9, 2021.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.004-acre of ROW will be required from the Middle Pickering Rural Historic District, which was determined to be eligible for listing on the NRHP.

• SR 0000, Section BCP—Whitemarsh Township and Plymouth Township, Montgomery County.

Project Description: The project is reconstruction of Ridge Pike (County owned) from Harmon Road (just west of Butler Pike) to Crescent Avenue.

Environmental Documents: CE 1b Evaluation approved on February 8, 2023, and two Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on October 26, 2022.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.007-acre of ROW will be required from the Bellfield property, which was determined to be eligible for listing on the NRHP. Approximately 0.008-acre of ROW will be required from the Plymouth Meeting Historic District, which is listed on the NRHP.

• SR 7046, Section 027—Lower Moreland Township and Bryn Athyn Borough, Montgomery County.

Project Description: The project is rehabilitation of the existing bridge that carries Fetters Mill Road over Pennypack Creek.

Environmental Documents: CE BRPA Reevaluation approved on March 30, 2023, and two Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on February 28, 2023.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.10-acre of ROW will be required from the Fetters Mill property, which is listed on the NRHP. Approximately 0.11-acre of ROW will be required from the Fetters Mill Village Historic District, which was determined to be eligible for listing on the NRHP.

• SR 7412, Section NNA—Narberth Borough and Lower Merion Township, Montgomery County.

Project Description: The project is the replacement of the existing bridge that carries North Narberth Avenue over Amtrak's Harrisburg Line.

Environmental Documents: CE 2 Reevaluation approved on February 1, 2023, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on July 1, 2013.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.104-acre of highway easement and 0.079-acre of aerial easement will be required from the Pennsylvania Railroad (PRR) Main Line (Philadelphia to Harrisburg), which was determined to be eligible for listing on the NRHP.

• SR 3010, Section 014—Swatara Township and Harrisburg City, Dauphin County.

Project Description: The project is improvements to the existing intersection of Paxton Street (SR 3010) and Sycamore Street (SR 0441).

Environmental Documents: CE 1b Evaluation approved on February 23, 2023, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on December 22, 2022.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.1864-acre of ROW will be required from Paxton Street Home, which was determined to be eligible for listing on the NRHP.

• SR 3022, Section 005—Harrisburg City, Dauphin County.

Project Description: The project is the replacement of the existing bridge that carries SR 3022 (Maclay Street) over the Norfolk Southern Railroad.

Environmental Documents: CE 2 Evaluation approved on March 1, 2023, a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on December 21, 2022, and a Nationwide/Programmatic Section 4(f) Evaluation for Projects that Necessitate the Use of Historic Bridges approved on December 14, 2022.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.070-acre of ROW will be required from the approximately 88-acre Pennsylvania Farm Show Complex and Exposition Center, which was determined to be eligible for listing on the NRHP. Maclay Street Bridge is a contributing resource to the PRR Main Line (Harrisburg to Pittsburgh), which was determined to be eligible for listing on the NRHP.

• SR 1019, Section 013—Caernarvon Township, Lancaster County.

Project Description: The project is the replacement of the existing bridge that carries SR 1019 (California Road) over UNT to Conestoga River.

Environmental Documents: CE 2 Evaluation approved on January 26, 2023, a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on October 14, 2022, and a Nationwide/Programmatic Section 4(f) Evaluation for Projects that Necessitate the Use of Historic Bridges approved on October 14, 2022.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.038-acre of ROW will be required from the approximately 990-acre Caernarvon Agricultural Historic District, which was determined to be eligible for listing on the NRHP. California Road Bridge is a contributing resource to the Caernarvon Agricultural Historic District, which was determined to be eligible for listing on the NRHP.

• SR 0850, Section 015—Carroll Township, Perry County.

Project Description: The project is the replacement of the existing bridge that carries SR 0850 over UNT to Sherman Creek.

Environmental Documents: ED BRPA Evaluation approved on February 22, 2023, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on August 19, 2022.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.037-acre of ROW will be required from the approximately 113-acre Dromgold Farm property, which was determined to be eligible for listing on the NRHP.

• SR 7422, Section 24S—Windber Borough, Somerset County.

Project Description: The project is the replacement of the existing bridge that carries 24th Street over Seese Run.

Environmental Documents: CE BRPA Evaluation approved on March 6, 2023, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on December 6, 2022.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.029-acre of ROW will be required from the Windber Historic District, which is listed on the NRHP.

• SR 7421, Section FSB—Borough of North Irwin, Westmoreland County.

Project Description: The project is the replacement of the existing bridge that carries Fourth Street over the Norfolk Southern Railroad.

Environmental Documents: CE 2 Evaluation approved on February 14, 2023, a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on November 8, 2022, and a Nationwide/Programmatic Section 4(f) Evaluation for Projects that Necessitate the Use of Historic Bridges approved on November 4, 2022.

Proposed Use of Section 4(f)/2002 Resources: Approximately 0.163-acre of ROW will be required from the PRR, which was determined to be eligible for listing on the NRHP. The Fourth Street Bridge is a contributing feature of the PRR, which was determined to be eligible for listing on the NRHP.
