THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
APPLICATIONS FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS UNDER THE CLEAN STREAMS LAW AND FEDERAL
CLEAN WATER ACTThis notice provides information about persons who have applied to the Department of Environmental Protection (DEP) for a new, renewed, or amended NPDES or WQM permit, or a permit waiver for certain stormwater discharges, or have submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications and NOIs concern, but are not limited to, effluent discharges from sewage treatment facilities and industrial facilities to surface waters or groundwater; stormwater discharges associated with industrial activity (industrial stormwater), construction activity (construction stormwater), and municipal separate storm sewer systems (MS4s); the application of pesticides; the operation of Concentrated Animal Feeding Operations (CAFOs); and the construction of sewage, industrial waste, and manure storage, collection and treatment facilities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376). More information on the types of NPDES and WQM permits that are available can be found on DEP's website (visit www.dep.pa.gov and select Businesses, Water, Bureau of Clean Water, Wastewater Management, and NPDES and WQM Permitting Programs).
Section Category I Individual and General WQM Permit Applications/NOIs Received, General NPDES Permit NOIs Received, and All Transfer and Minor Amendment Applications/NOIs Received II Individual NPDES Permits—New, Renewal, and Major Amendment Applications and Draft Permits for Discharges Relating to Sewage, Industrial Waste, Industrial Stormwater, MS4s, Pesticides and CAFOs III Individual NPDES Permit Applications for Discharges of Stormwater Associated with Construction Activity Section I identifies the following applications and NOIs that have been received by DEP:
• Individual and General WQM Permit Applications Received—DEP provides a 15-day public comment period for Individual WQM Permit Applications for new and reissued permits. There is no public comment period for General WQM Permit NOIs.
• General Chapter 92a NPDES Permit NOIs Received—There is no public comment period for General NPDES NOIs received.
• All Transfer and Minor Amendment Applications/NOIs Received—Transfer and Minor Amendment Applications/NOIs received for Individual and General WQM Permits and Individual and General NPDES Permits, excluding PAG-01 and PAG-02, are identified but do not have public comment periods. DEP provides a 15-day public comment period for Individual WQM Permit Applications for amendments.

Section II identifies individual NPDES permit applications received and draft permits indicating DEP's tentative determination relating to sewage, industrial waste, industrial stormwater, MS4s, pesticides and CAFOs. A 30-day public comment period applies to these applications and draft permits, except when a site-specific water quality criterion is used to establish effluent limitations, in which case a 45-day public comment period applies. The period for comment may be extended at the discretion of DEP for one additional 15-day period. Additional information, including links to draft permits and fact sheets that explain the basis for DEP's tentative determinations may be reviewed by generating the ''Applications Received with Comment Periods Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice. Notification of 15-day extensions for comment will be provided in the ''Applications Received with Comment Periods Report'' (Comments column).
Section III identifies individual NPDES permit applications received and draft permits indicating DEP's tentative determination relating to stormwater discharges associated with construction activities. A 30-day public comment period applies to these applications and draft permits. The period for comment may be extended at the discretion of the Department for one additional 15-day period. Additional information may be reviewed by generating the ''Applications Received with Comment Periods Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice.
Applications, NOIs and draft permits, where applicable, may be reviewed at the DEP office that received the application or NOI. Members of the public are encouraged to use DEP's website to obtain additional information as discussed previously.
Comments received within the appropriate comment periods for WQM and NPDES permit applications will be retained by DEP and considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform DEP of the exact basis of a comment and the relevant facts upon which it is based.

DEP will also accept requests or petitions for public hearings on applications. The request or petition must indicate the interest of the party filing and the reasons why a hearing is warranted. A hearing will be held if DEP determines that there is a significant public interest. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. DEP will postpone its final determination until after a public hearing is held.

Description of Existing Activity: The application is for a renewal of an NPDES permit for an existing discharge of treated sewage.
The receiving stream(s), Lehigh River (TSF, MF), is located in State Water Plan watershed 2-C and is classified for Trout Stocking and Migratory Fishes, aquatic life, water supply and recreation. The discharge is not expected to affect public water supplies.

Any such permit amendment would be considered a formal major DEP permitting action subject to applicable permit modification procedures.
• An option for the permittee to collect and submit to DEP site-specific data to verify or refine the new Water-Quality Based Effluent Limits for 14 parameters which are scheduled to take effect following a three-year compliance schedule, subject to the permittee's input during the draft permit's comment period.
• A requirement to conduct a Toxics Reduction Evaluation, commencing 120 days from the final permit's effective date, for the 14 parameters with new Water-Quality Based Effluent Limits.
• A requirement for the permittee to submit progress reports every six months towards achieving the final limits for the 14 parameters with new Water-Quality Based Effluent Limits.
• A requirement for the permittee to continue to report separately the volume of groundwater discharged at outfall 001; the volume of on-site leachate discharged; the volume of other industrial wastewater generated on-site and discharged; and the volume and source of leachate from off-site introduced to the treatment plant. The permittee is required to report these items on a monthly basis on the Daily Effluent Monitoring Supplemental Reporting Form or as an attachment to the Supplemental DMR forms.
• A requirement to notify DEP in writing at least 30 days before introducing to the treatment plant any leachate that is not generated on-site. DEP retains the right to not authorize the acceptance of said leachate, or to request additional information if needed.
• Compliance with the requirements of the facility's DEP-issued waste permit.
• Notification requirements for Chemical Additives to be used by the permittee and restrictions on their usage.
• A requirement to electronically submit DEP's Annual Chesapeake Bay Spreadsheet to record nutrient concentrations and loads, any credits purchased, and any offsets applied.
• Requirements to conduct semi-annual inspections for stormwater management; follow Best Management Practices to keep pollutants out of stormwater discharges; maintain a Preparedness, Prevention, and Contingency Plan; and submit to DEP a Stormwater annual report.

Wesley Burkholder has submitted an application for an Individual NPDES permit for a new CAFO known as Wesley Burkholder Turkey Farm, located in Hamilton Township, Franklin County.
The CAFO is situated near Back Creek (TSF, MF) in Watershed 13-C, which is classified for Trout Stocking and Migratory Fishes. The CAFO will be designed to maintain an animal population of approximately 406.32 animal equivalent units (AEUs) consisting of 18,900 Turkey Tom Brooders and 18,900 Turkey Heavy Toms. All solid turkey manure will be stored on the floor of the turkey barns. There are no manure storages located on this operation. A release or discharge to waters of the Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 100-year, 24-hour storm event.
The Department has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations, the Department has made a tentative determination to issue an NPDES permit for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the permit.

The CAFO is situated near Chiques Creek (WWF, MF) in Watershed 7-G, which is classified for Warm Water Fishes and Migratory Fishes. The CAFO will be designed to maintain an animal population of approximately 810.99 animal equivalent units (AEUs) consisting of 5,200 Swine Grow Finish. Liquid Swine Manure is collected in two existing swine underbarn storages. The operation is proposing the construction of a third swine barn with underbarn storage. Prior to operation of the new swine manure storage facility, the design engineer will be required to submit certification that the facility was constructed in accordance with appropriate PA Technical Guide Standards. A release or discharge to waters of the Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 100-year, 24-hour storm event.

Project Description: The Project consists of the installation of 10 miles of new 2-inch, 3-inch, 4-inch and 6-inch plastic gas pipeline in Beallsville Borough, Deemston Borough, North Bethlehem Township, Somerset Township, West Bethlehem Township, and West Pike Run Township, Washington County, PA. PNG intends to complete a portion of the Project using Horizontal Directional Drilling (HDD) to reduce earth disturbance and limit environmental impacts. The remainder of the Project will be installed via trenching methods. Use of the existing pipeline will be abandoned. The pipeline will remain in place except for sections of exposed pipeline within streams and wetlands, which will be removed. Additionally, the abandoned pipeline will either be removed or capped at all stream and wetland crossings in accordance with PA DEP requirements. In-lieu of grouting the abandoned line at resource crossings, PNG shall maintain liability of the abandoned line. If there are any environmental concerns or any issues identified due to the abandoned pipe, PNG will be responsible to correct the issue. The Project will be restored to pre-construction conditions and no new permanent impervious areas are proposed.
