STATE CONSERVATION COMMISSION

PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed (National Pollutant Discharge Elimination System) NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. These NMPs are published as proposed plans for comment prior to taking final actions. The NMPs are available for review at the CCD office for the county where the agricultural operation is located. A list of CCD office locations is available at http://www.nacdnet.org/about/districts/directory/pa.phtml or can be obtained from the SCC at the office address listed or by calling 717-787-8821.

 Individuals wishing to comment on an NMP are invited to submit a statement outlining their comments on the plan to the CCD, with a copy to the SCC for each NMP, within 30-days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the NMPs. Comments should include the name, address and telephone number of the writer and a concise statement to inform the SCC of the exact basis of the comments and the relevant facts upon which they are based. PUBLIC WATER SUPPLY PERMITS

 Under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17), the following parties have applied for Public Water Supply (PWS) permits to construct or substantially modify public water systems.

 Individuals wishing to comment on permit applications are invited to submit statements to the office listed before the application within 30-days of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding an application. A comment should include the name, address and telephone number of the writer and a concise statement to inform the Department of Environmental Protection (DEP) the exact basis of a comment and the relevant facts upon which it is based. AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS

 The Department of Environmental Protection (DEP) has developed an integrated plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for DEP, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.

 The DEP received applications for Plan Approvals or Operating Permits from the following facilities. Copies of the application, DEP's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate DEP Regional Office. Appointments for scheduling a review must be made by calling the appropriate DEP Regional Office. The address and telephone number of the Regional Office is listed before the application notices.

 Individuals wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the DEP's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.

 Any individual wishing to request a hearing may do so during the 30-day comment period. A public hearing may be held, if DEP, in its discretion, decides that a hearing is warranted based on the information received. 14-00045A: GP Cabinets LLC, 276 Spearing St., Howard, PA 16841, Howard Borough, Centre County. Application received: September 1, 2023. For a State Only plan approval application that would authorize the construction of a surface coating operating consisting of four spray booths that apply coatings via HVLP guns. The Department's review of the information submitted indicates that the air contamination sources to be constructed, will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirements (BAT) of 25 Pa. Code §§ 127.1 and 127.12. Based on this finding, the Department proposes to issue a plan approval for the surface coating operation. The emissions from the surface coating operation is being permitted to not exceed the following limits: total VOC, and total HAP emissions from the surface coating operation (including cleanup activities) shall not exceed 7.12 tons and 1.49 tons respectively in any twelve consecutive month period. In addition, each paint booth shall by equipped with panel filters to control the particulate matter overspray. Moreover, the coatings applied in the surface coating operation shall be applied using HVLP guns and must comply with the VOC content limitations specified in 25 Pa. Code § 129.52 for wood furniture manufacturing operations. In addition to the previously listed emission, and other, limitations the other conditions that the Department intends to place in the plan approval for all sources at the facility include: testing, periodic monitoring, recordkeeping, reporting, work practice, and other requirements as necessary to verify compliance in accordance with all applicable regulatory requirements within 25 Pa. Code Chapters 121—145. The facility will be a State Only facility. If the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and the specifications in the application for Plan Approval 14-00045A, the requirements established in the plan approval will be incorporated into a State Only Operating Permit pursuant to 25 Pa. Code Chapter 127, Subchapter F. All pertinent documents used in the evaluation of the application are available for public review during normal business hours at the Department's Northcentral Regional Office, 208 West Third Street, Suite 101, Williamsport, PA 17701. OPERATING PERMITS


Notice of Intent to Issue Title V Operating Permit(s) Under the Air Pollution Control Act (35 P.S. §§ 4001—4015) and 25 Pa. Code Chapter 127, Subchapter G.

67-05001, Magnesita Refractories Co., 425 South Salem Church Road, York, PA 17408-5955, West Manchester Township, York County. Application received: December 20, 2022. Approval of a Reasonably Available Control Technology (RACT) 3 plan for the Magnesita Refractories Co. as a significant modification to its applicable Title V operating permit.

 In accordance with 25 Pa. Code §§ 129.111—129.115 (relating to additional RACT requirements for major sources of NOx and VOCs for the 2015 ozone NAAQS), the Pennsylvania Department of Environmental Protection (Department, DEP) has made a preliminary determination to approve a RACT 3 plan for the Magnesita Refractories Co. The RACT 3 plan approval, if approved by the Department, will be issued as a significant modification to the facility's Title V operating permit (67-05001).

 The RACT 3 Title V significant modification incorporates provisions and requirements for the control of emissions of nitrogen oxides (NOx) and/or volatile organic compounds (VOCs). These provisions and requirements are intended to address the Commonwealth's RACT obligations under section 184 of the Clean Air Act for the 1997, 2008 and 2015 8-hour ozone National Ambient Air Quality Standards. The RACT 3 Title V significant modification does not adopt any new regulations. If approved by the Department, this RACT 3 plan approval will be submitted to the United States Environmental Protection Agency (EPA) for approval as a revision to the Commonwealth's State Implementation Plan (SIP). Requirements that are not part of the RACT 3 plan approval will be excluded from the SIP revision submittal.

 The following is a summary of the RACT 3 plan approval requirements for this facility that are proposed to be submitted to the EPA as a revision to the Commonwealth's SIP:

 This condition constitutes a case-by-case RACT 3 determination for the sources in this group:

 A.) The permittee shall retrofit each rotary kiln (Sources 405 and 415) with enhanced air mixing technology for NOx reduction and shall thereafter operate and maintain the kilns as thus modified.

 B.) The sources in this group shall comply with their previously SIP-ed RACT 2 case-by-case requirements, which are as follows:

 I. Rotary Kilns (Sources 405 and 415)

 a. Emissions from the Rotary Kilns shall not exceed the following:

 1. Kiln 1: 34.0 pounds of NOx per ton of product

 2. Kiln 2: 38.0 pounds of NOx per ton of product

 b. The permittee shall do the following O&M activities related to the Rotary Kilns:

 1. Oxygen and carbon monoxide analyzers associated with the automated combustion control system on each rotary kiln shall be inspected for proper operation at least weekly, with corrective action taken if problems are noted.

 2. Kiln feed controls on each rotary kiln shall be verified for proper calibration at least every six months, with adjustments made as necessary.

 3. Fuel feed controls on each kiln shall be verified for proper calibration at least annually, with adjustments made as necessary.

 4. Coal mill level controls on each kiln shall be verified for proper calibration at least annually, with adjustments made as necessary.

 5. Thermocouples associated with the combustion control system on each rotary kiln shall be inspected and verified for proper calibration at least annually, with adjustments made or corrective actions taken as necessary.

 6. The flame pattern on each kiln shall be visually inspected at least each week, with corrective actions taken as necessary.

 7. The burner pipe on each kiln shall be inspected at least annually, with corrective actions taken as necessary.

 c. The permitted shall keep records of the following for the Rotary Kilns:

 1. Weekly oxygen and carbon monoxide analyzer inspections, plus records of any maintenance done in response to problems noted during the inspections

 2. 6-month rotary kiln feed control calibration verifications, plus records of any adjustments made as a result of the verifications

 3. Annual rotary kiln fuel feed control calibration verifications, plus records of any adjustments made as a result of the verifications

 4. Annual rotary kiln coal mill level control calibration verifications, plus records of any adjustments made as a result of the verifications

 5. Annual rotary kiln thermocouple inspections and calibration verifications are maintained, plus adjustments or maintenance performed as a result of the inspections or verifications

 6. Weekly rotary kiln flame pattern inspections, plus records of any corrective actions taken as a result of each inspection.

 7. Annual rotary kiln burner pipe inspections, plus records of any corrective actions taken as a result of each inspection.

 d. NOx emissions from each of Sources 405 and 415 shall be verified one time in each 5-year calendar period. This testing shall be conducted in accordance with the provisions of Chapter 139 of the Department's rules and regulations.

 II. Tunnel Kilns 5 and 6 (Sources 810 and 820), Kiln 7 (Source 830), Curing Oven (Source 801)

 a. The permittee shall do the following O&M activities:

 1. Visually inspect each Source 801 burner at least annually.

 2. Visually inspect each burner on each kiln (Sources 810 and 820) at least once each week.

 3. Physically inspect each burner on each kiln (Sources 810 and 820) at least once each calendar month and adjust the air to fuel ratio if necessary.

 4. Monthly change the filters for the combustion air and diffusion air (secondary air) for Source 830.

 5. Physically inspect each burner for Source 830 at least every 500 hours of operation.

 b. The permittee shall keep records of the following:

 1. Periodic burner inspections for Sources 801, 810, 820 and 830.

 2. All inspections, adjustments or maintenance related to burner or kiln operation for Sources 801, 810, 820 and 830.

 3. Monthly filter changes for Source 830.

 A 30-day public comment period is provided for persons wishing to file a written protest, objection, comments or additional information, which they believe should be considered prior to the issuance of a permit. The written comments, information, protests or objections may be submitted to Thomas Bianca, Environmental Engineering Manager, Air Quality Program, at 909 Elmerton Avenue, Harrisburg, PA 17110, or at tbianca@pa.gov on or before the closing date of this 30-day public comment period. The 30-day public comment period closes on January 15, 2024.

 Each written submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed RACT 3 plan approval, including the permit number, and a concise statement regarding the proposed RACT 3 plan approval provision or requirement that the person is commenting on and the relevancy of the information or objections to issuance of the RACT 3 plan approval.

 Public hearing. A public hearing will be held on February 8, 2024, at 10:00 a.m. at the DEP Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA 17110, to accept oral comments on the proposed RACT 3 plan approval action and the proposed SIP revision. The last day to pre-register to speak at the hearing will be the Friday before the hearing.

 Oral testimony at the hearing will be limited to a maximum of 5 minutes per individual and two written copies of the oral testimony are requested. Each organization is requested to designate one witness to present testimony on its behalf. For the operation of the thermoplastic and fiberglass reinforced plastic components manufacturing facility. This is for renewal of the existing Title V permit. Actual 2022 air emissions from the facility are estimated at 23.69 tons VOC, 13.74 tons Total HAP, 8.89 tons Single HAP (Styrene), and less than 1 ton each PM-10, NOx, SOx, and CO. The Operating Permit will include emission limits and work practice standards along with monitoring, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality regulations. To issue a renewal State Only (Synthetic Minor) Operating Permit for the Jersey Shore Asphalt Plant. The facility's sources include one 2.24 MMBtu/hr, No. 2 fuel oil-fired asphalt tank heater, two propane-fired space heaters, two liquid asphalt tanks, one No. 2 fuel oil storage tank, one diesel fuel oil storage tank, one 50 MMBtu/hr hot mix drum asphalt concrete operation and miscellaneous sources. The facility has potential emissions of 0.20 TPY of CO; 0.80 TPY of NOx; 2.80 TPY of SOx; 0.80 TPY of PM/PM10; 2.45 TPY of VOCs; 0.36 TPY of combined hazardous air pollutants; 895 TPY GHGs. This facility is subject to 40 CFR 60, Subpart I—Standards of Performance for Hot Mix Asphalt Facilities. The emission limits and work practice standards along with testing, monitoring, recordkeeping and reporting requirements have been included in the operating permit to ensure the facility complies with all applicable Federal and State air quality regulations. These operating permit conditions have been derived from the applicable requirements of 25 Pa. Code Chapters 121—145, as well as 40 CFR Part 60. All pertinent documents used in the evaluation of the application are available for public review during normal business hours at the Department's Northcentral Regional Office, 208 West Third Street, Suite 101, Williamsport, PA 17701. 10-00381, Mountain Gathering LLC, 190 Thorn Hill Rd, Warrendale, PA 15086, Forward Township, Butler County. Application received: August 26, 2022. The Department intends to renew a State Only Operating Permit for Mountain Gathering LLC's Forward Compressor Station. The primary emissions sources are six 1,775 HP compressor engines and six compressors, one Triethylene Glycol dehydrator, reboilers, line heaters, condensate and water storage tanks, a gun barrel tank, and fugitive emissions at the facility. Potential emissions from the facility are less than the Title V emission thresholds. The facility is a Natural Minor. The potential emissions from the facility are as follows: 54.09 tpy NOx; 26.51 tpy CO; 40.49 tpy VOCs; 0.19 tpy SOx; 3.34 tpy PM10; 3.34 tpy PM2.5; 5.11 tpy total all combined HAPs. Actual reported emissions for the calendar year 2022 were 43.82 tons NOx; 8.72 tons CO; 17.70 tons VOC; 0.18 ton SOx; 3.27 tons PM10; 3.27 tons PM2.5; 2.518 tons HAPs; and 37,285 tons CO2. Sources at this facility are subject to the following Federal emission standards: 40 CFR Part 60 Subpart JJJJ, the standards of performance for stationary spark ignition internal combustion engines; and 40 CFR Part 60 Subpart OOOO, the standards of performance for crude oil and natural gas production, transmission and distribution; and 40 CFR Part 63 Subpart HH, the national emission standards for hazardous air pollutants from oil and natural gas production facilities. The conditions of the previous plan approvals are incorporated into the renewal permit. The permit contains emission restrictions, recordkeeping, work practice, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

The subject facility has the potential to emit NOx at 1.1 tpy, PM at 0.8 tpy, and SO2 at 0.2 tpy. The Operating Permit will include emission limits and work practice standards along with monitoring, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality regulations.

06-03028, Can Corporation of America, 326 June Ave., Blandon, PA 19510-9566, Muhlenberg Township, Berks County. Application received: August 15, 2023. For their metal can manufacturing facility. Actual emissions from the facility in 2022 were estimated at 0.40 ton of CO, 0.48 ton of NOx, 0.04 ton of PM10, 8.44 tons of VOC, and 1.34 tons of combined HAPs. MINING ACTIVITY NPDES DRAFT PERMITS

 This notice provides information about applications for a new, amended or renewed National Pollutant Discharge Elimination System (NPDES) permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 The Department of Environmental Protection (DEP) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.

Effluent Limits for Coal Mining Activities

 For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

 The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

 Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

 The limits for noncoal mining activities as provided in 25 Pa. Code § 77.522 are pH 6 to 9 and other parameters DEP may require.

 Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

 The applicant proposes to:

 1. Construct and maintain a 99 linear foot (LF), 53-inch tall by 83-inch-wide corrugated metal pipe arch culvert to carry a proposed roadway over watercourse R-1, an unnamed tributary (UNT) to Deer Creek (TSF), along with a riprap apron at the outlet, and associated roadway fill. This activity would permanently impact 167 LF of watercourse and 17,368 square feet (SF) of floodway. At the point of this impact, watercourse R-1 has less than a 100-acre drainage area.

 2. Place and maintain permanent fill within the entire length, 97 LF, of watercourse R-7, a UNT to a UNT of Deer Creek (TSF), and 3,422 SF of its floodway associated with roadway fill for the aforementioned culverted crossing. At the point of this impact, watercourse R-7 has less than a 100-acre drainage area.

 3. Construct and maintain five (5) utility line crossings of watercourse R-1, which will be embedded in the roadway fill above the culvert noted in item 1. Cumulatively, these utility line crossings would permanently impact 30 LF of watercourse R-1 and 5,750 SF of its floodway, these impacts completely overlap with the impact area noted in item 1 previously listed. At the point of these impacts, watercourse R-1 has less than a 100-acre drainage area. These utility line crossings consist of:

 • one (1) 15-inch high-density polyethylene (HDPE) storm sewer line,

 • one (1) 8-inch ductile iron pipe (DIP) potable water line,

 • one (1) 4-inch copper and polyvinyl chloride (PVC) electric line,

 • one (1) 6-inch HDPE gas line, and

 • one (1) 8-inch PVC sanitary sewer line.

 4. Place and maintain permanent fill at another location within 121 LF of watercourse R-1 and 35,760 SF of its floodway associated with grading for lot development. At the point of this impact, watercourse R-1 has less than a 100-acre drainage area.

 5. Construct and maintain a sanitary sewer manhole and tie in, permanently impacting 220 SF of the floodway of watercourse R-1. At the point of this impact, watercourse R-1 has less than a 100-acre drainage area.

 6. Construct and maintain five (5) outfall structures to watercourse R-1. Cumulatively, these structures would permanently impact 60 LF of watercourse R-1 and 4,221 SF of its floodway. At the point of these impacts, watercourse R-1 has less than a 100-acre drainage area.

 7. To place and maintain permanent fill within 420 LF of watercourse R-2 and 42,000 SF of its associated floodway, and to construct and maintain a stream enclosure and relocation consisting of 436 LF of 6" diameter high density polyethylene (HDPE) tubing and 135 LF of 15" diameter HDPE pipe to convey this relocated reach of watercourse R-2. These impacts are associated with grading for lot development. A bark chip surfaced stormwater basin access road will be constructed on this fill slope. Additionally, a single 5 LF outfall structure that serves this piped and rerouted watercourse as well as stormwater basin BMP-3 is included in these impacts.

 8. Place and maintain permanent fill in 2,052 SF of the floodway of watercourse R-2, a UNT to watercourse R-1 (TSF). At the point of this impact, watercourse R-2 has less than a 100-acre drainage area. This impact is associated with constructing stormwater basin BMP-2.

 9. Place and maintain permanent fill within the entirety, 6,643 SF, of pond R-5 and piping of the groundwater source that fed it via the impact previously mentioned. This impact is associated with grading for lot development.

 10. Place and maintain permanent fill within 237 LF, of watercourse R-3, a UNT to a UNT of Deer Creek (TSF), and 18,400 SF of its floodway associated with grading for lot development. At the point of this impact, watercourse R-3 has less than a 100-acre drainage area.

 11. Place and maintain permanent fill within 320 LF, of watercourse R-4, a UNT to a UNT of Deer Creek (TSF), and 26,300 SF of its floodway associated with grading for lot development. At the point of this impact, watercourse R-4 has less than a 100-acre drainage area.

 For the purpose of constructing a new residential development, consisting of 26 single family homes, 16 duplex units, 3,200 LF of roads, 4 stormwater basins with associated outfall structures, and necessary utility lines. Cumulatively, the project will permanently impact approximately 1,452 LF or watercourse and 155,493 SF of floodway. The project would also result in permanent impacts to 6,643 SF of waterbody. To compensate for unavoidable impacts to aquatic resources, the applicant is proposing to purchase credits from a third-party mitigation bank. The project is located approximately 1,000 feet north-northeast of the McIntyre Road/Allison Road intersection (Valencia, PA USGS topographic quadrangle; 40° 37` 54.93" N, -79° 55` 08.52" W; Sub-basin 18A; USACE Pittsburgh District).
