FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department of Environmental Protection (DEP) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, DEP has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of Sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), and that the construction will not violate applicable Federal and State Water Quality Standards.

 Individuals aggrieved by these actions may appeal, pursuant to Section 4 of the Environmental Hearing Board Act, 35 P.S. § 7514, and the Administrative Agency Law, 2 Pa.C.S.  • 16-foot by 6-foot, 38-foot-long precast concrete box culvert at Bethel Avenue East

 These activities will also include the relocation of Bezors Run (WC 106, WWF) and the construction and maintenance of four (4) outfalls with grading and riprap rock aprons (24-inch CMP, 2 18-inch CMP, 24-inch RCP) resulting in a total of 867 linear feet (11,269 square feet) of permanent watercourse impact, 108 linear feet (901 square feet) of temporary watercourse impact including temporary bypass channels, 26,786 square feet of permanent floodway impact and 12,010 square feet of temporary floodway impact (USGS PA Marcus Hook Quadrangle—Latitude 39.849694° N, Longitude 75.439676° W).

 4. To place fill and grade within a wetland area (WL LTZ 23, PEM/PSS/PFO) and floodway of Bezors Run (WC 106, WWF) to facilitate the construction of stormwater facility resulting in 999 square feet (0.023 acre) of permanent wetland impact, 1,566 square feet (0.036 acre) of temporary wetland impact, 26,786 square feet of permanent floodway impact, and 12,010 square feet of temporary floodway impact. This activity also includes the construction and maintenance of an 18-inch RCP outfall with riprap rock apron to facilitate discharge from the constructed stormwater facility (USGS PA Marcus Hook Quadrangle—Latitude 39.847393° N, Longitude 75.437356° W).

 5. To remove an existing single span slab bridge at Bethel Road (SR 3016) and a 70-foot-long concrete arch culvert at SR 0322 at SR 0322 carrying East Branch of Marcus Hook (WC 107, WWF), and in their place, construct and maintain the following:

 • 22-foot by 6-foot, 41.6-foot-long precast concrete box culvert at Bethel Road

 • 17-foot by 13-foot, 104-foot-long precast concrete box stream enclosure at SR 0322

Action(s) Taken on the Following Plans and Reports Under the Storage Tank and Spill Prevention Act (35 P.S. §§ 6021.101—6021.2104).

 Provisions of 25 Pa. Code Chapter 245, Subchapter D, Administration of the Storage Tank and Spill Prevention Program, require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports.

 A remedial action plan is submitted to summarize the site characterization, document the design and construction details for the remedial action, and describe how the remedial action will attain the selected remediation standard. The remedial action plan also provides results of studies performed and data collected to support the remedial action and a description of postremediation care requirements. A remedial action completion report is submitted to document cleanup of a release of a regulated substance at a site to the selected remediation standard. A remedial action completion report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

 DEP may approve or disapprove plans and reports submitted. This notice provides DEP's decision and, if relevant, the basis for disapproval.

The ''TMDLs'' included allocations for nonpoint sources; wasteload allocations for the Kelly Crossroads Sanitary Sewer System; reserves for point sources not assigned individual wasteload allocations and future point sources; as well as margin of safety factors. Nonpoint source load allocations were made for cropland, hay/pasture land and streambank source sectors present in the watershed. Data used in establishing the TMDLs were primarily generated using a water quality analysis model (Model My Watershed) made available through the Stroud Water Research Center.

 In accordance with the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act, Act 101 of July 28, 1988, as amended, and Chapter 272 of the Pennsylvania Rules and Regulations, 25 Pa. Code, the Counties of Mifflin and Juniata are soliciting proposals from regional landfills with the capacity to provide disposal for municipal solid waste (MSW), including construction and demolition (C&D) waste and municipal sewage sludge (Sludge) originating from Mifflin and Juniata Counties. Mifflin and Juniata counties (combined) generate approximately 40,000 tons of municipal waste, including C/D waste, annually. The term of provision of disposal capacity shall be ten (10) years, beginning in January 2025. Qualified respondents will be listed as designated facilities in the Regional Municipal Waste Management Plan that is currently being updated.

 Written questions from proposers are due Friday, March 24, 2023, by 3:30 p.m. There will be no mandatory pre-proposal meeting.

Proposed Revision to The State Implementation Plan (SIP) and Notice of Intent to Modify Ract Plan Approval for Philadelphia Gas Works.

 Air Management Services (AMS) proposes to modify the approved Reasonably Available Control Technology (RACT) plan approval for the following facility:

Philadelphia Gas Works—Richmond, 3100 East Venango Street, to remove the following Condition from the approved SIP and RACT plan approval:

Internal combustion engines rated at less than 500 bhp (gross) which are set and maintaining 4° retarded relative to standard timing.

 The modified RACT plan approval will be submitted to the U.S. Environmental Protection Agency for approval and incorporation into Pennsylvania's SIP.

RACT and SIP Revision Background

 The three (3) 295 hp Caterpillar emergency fire pump engines were first installed in 1974 and were originally permitted as non-emergency engines. During the approval of the 1997 RACT permit, the facility proposed to comply with the presumptive RACT emissions limitations of 25 Pa. Code § 129.93(c) for the engines, which are the installation, maintenance, and operation of the source in accordance with manufacturers specifications. The presumptive RACT emissions limitations of 25 Pa. Code § 129.93(c) apply to source types under 25 Pa. Code § 129.93(c)(1)—(7). Condition 1(B)(3) of the RACT permit included the following source type in establishing the NOx RACT for PGW:

 (3) Internal combustion engines rated at less than 500 bhp (gross) which are set and maintaining 4° retarded relative to standard timing.

 This source type requirement under 25 Pa. Code § 129.93(c)(3) was included in the RACT plan approval No. 51-4922, issued July 26, 1999. EPA approved the source-specific case-by-case determinations of the RACT permit as part of the SIP on October 31, 2001 (66 FR 54947).

 Ultimately the units never maintained at 4° retarded relative to standard timing, as indicated by a 2012 Manufacturer Letter. PGW has provided documentation from the manufacturer that indicates the units were installed operating at 12.5 degrees retarded and that further retarding the timing would result in premature valve and turbo charger failure. Additionally, retarding the engine timing by 4 degrees would result in increased emissions of hydrocarbons.

 The plan approval will contain monitoring, recordkeeping, and reporting requirements to ensure operation within all applicable requirements.
