PUBLIC WATER SUPPLY PERMITS Under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17), the following parties have applied for Public Water Supply (PWS) permits to construct or substantially modify public water systems.
Individuals wishing to comment on permit applications are invited to submit statements to the office listed before the application within 30-days of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding an application. Acknowledgment of Notice(s) of Intent to Remediate Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).
Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent (NOI) to Remediate. An acknowledgment of the receipt of a NOI to Remediate is used to identify a site where an individual proposes to, or has been required to, respond to a release of a regulated substance at a site. Individuals intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a NOI to Remediate with DEP. A NOI to Remediate filed with DEP provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. An individual who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by DEP. Furthermore, an individual shall not be subject to citizen suits or other contribution actions brought by responsible individuals not participating in the remediation.
Under Sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the NOI to Remediate is published in a newspaper of general circulation in the area of the site. For the following identified site(s), proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30-days of the following specified date. During this comment period the municipality may request that the following identified individual, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

AIR QUALITY
PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS The Department of Environmental Protection (DEP) has developed an integrated plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for DEP, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.
The DEP received applications for Plan Approvals or Operating Permits from the following facilities. Copies of the application, DEP's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate DEP Regional Office. Individuals wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the DEP's Regional Office. The Department of Environmental Protection intends to issue a plan approval to SGL Carbon's facility to install one (1) new dust collector(s) to control PM emissions from their new sawing operation at their facility located in City of Saint Marys, Elk County. This is an existing natural minor facility. Public notice is required for sources required to obtain a Plan Approval in accordance with 25 Pa. Code § 127.44.
Source 104, Sawing Operation, consists of one (1) Mazak ''Integrex E-1850V'' CNC machine and one (1) Friggi ''2 MF 2000x2000x4000 TM Horizontal Dual Column'' band saw which will be controlled by a cartridge style dust collector (Source ID C104). The control device is designed for an inlet volume of 8,000 CFM at 68 degrees Fahrenheit and will control PM emissions.
The Sawing Operation processes graphite at a rate of 445 tpy per saw and, for permitting purposes, are assumed to operate 8,760 hours annually. 10,899 lbs/month of graphite dust is loaded into the collector. SGL grossly overestimates their emissions by assuming that all 10,899 lbs is emitted as particulate. Their analysis with the efficiency of the dust collector cartridges (99.9995%) is that 0.54 lb/month will be emitted after the control device. They provided manufacturer guarantees of the previously mentioned control efficiency. The 0.54 lb/month equates to 0.00324 ton per year and 0.00095 lb/hr. To ensure proper operation, SGL must regularly monitor the pressure drop and visual emissions of the new dust collector. The dust collector will be equipped with a broken cartridge alarm.
Fugitive emissions will be prohibited. Monitoring of the baghouse pressure drop will be required. Visible stack emissions will be prohibited. The quality of the filter media will be monitored through yearly inspections and the use of a broken cartridge detection system. A copy of the control device manufacturer's operational and maintenance literature will always be maintained onsite. Records of all monitoring and maintenance will be kept. Spare filter media and parts for monitoring systems will be kept on site. All excursions from normal operating values will be recorded and corrected as needed. A plan to resolve repeated excursions will be developed and implemented as needed.
The Plan Approval will contain testing, recordkeeping, emission restriction, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.
In accordance with 25 Pa. Code § 127.44(f)(1), all the pertinent documents regarding this application (applications, review memos, and draft approvals) are also available for review from 8:00 a.m. to 4:00 p.m. at the Meadville Regional DEP office (Air Quality). Appointments for scheduling a review must be made by calling the DEP at (814) 332-6940.
In accordance with 25 Pa. Code § 127.44(f)(2), a 30-day comment period, from the date of publication, will exist for the submission of comments. This is an existing natural minor facility. Public notice is required for sources required to obtain a Plan Approval in accordance with 25 Pa. Code § 127.44. Source 104 and 105, Burn-Off Oven 4 & 5, consists of two (2) Eco Burn-Off Ovens Corp Model EBR-287 and have a throughput of 0.8 MBtu/hr of natural gas and rated at 20 lbs per hour. They are equipped with Midco International J-121 burners and a secondary chamber. The primary burner is rated at 0.325 MBtu/hr and the secondary is rated at 0.475 MBtu/hr. The units are equipped with low NOx burners and secondary chambers to reduce emissions. The secondary chamber must be capable of reducing particulate matter emissions to or below 0.02 grain per dry standard cubic foot(gr/dscf) corrected to 12% CO2, maintain a minimum temperature of 1,400°F during the period of operation, and have a minimum retention time of gas within the secondary chamber of at least 0.5 second. This is the established BAT for burn-off ovens in the GP4 general operating permit and plan approval.

◦ The Burn off ovens may be used for the following list of materials: Drying grindings, Shavings, Swarf, Turnings, Chips, Sludge, Pucked grindings (briquette), Burn-off filters, Filter paper cartridges, Cartridges, & Filter rolls only if the material meets one of the following:
◦ The precious metal content must be over 0.05 percent by weight.
◦ The combined metal or oxide forms of Ni, Co, Mo, W, V, Cu, Zn, Al, Ti, Si, Fe, B, Cr, Mg, Mn, Zr, Nb, Ta, Sn, Ga, In, total must be over 5 percent by weight.
◦ The rare earth metals content must be over 10 percent by weight.
Monitoring and record-keeping requirements:
◦ Install, maintain, and operate a temperature indicator and recorder to measure and record the temperature in the secondary chamber of the burn-off oven.
◦ Maintain records of the type of material that enters the ovens.
◦ Maintain records of the weight percent of the recoverable metals with the specific metals recovered in the record.

The facility has potential emissions of 257.2 TPY NOx; 165.4 TPY CO; 76.8 TPY PM; 1.8 TPY SOx; 29.25 TPY VOC; 5.6 TPY total HAP; 1.6 TPY single HAP; and 29,069 TPY CO2e. Emission limitations, operating requirements, and work practice standards along with monitoring, recordkeeping, and reporting requirements have been included in this proposed revision to the Title V operating permit to ensure that the facility complies with applicable Federal and State air quality regulations.
Furthermore, in accordance with 25 Pa. Code §§ 129.111—129.115, the Pennsylvania Department of Environmental Protection has made a preliminary determination to approve a RACT III plan and an amendment to the State Implementation Plan (SIP) for the aforementioned facility. The facility is not subject to any RACT III requirements for VOC.
The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT III approval for the facility, which are intended to satisfy the requirements for the 1997, 2008, and 2015 National Ambient Air Quality Standard (NAAQS) for ozone.
The proposed amendments to the RACT III determination, if finally approved, will be incorporated into a revised operating permit 63-00027 for the facility. The relevant RACT III requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT III determination will be excluded from the SIP submittal.

Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application may be submitted by any person or any officer or head of any Federal, State or Local Government Agency or Authority to DEP at the address of the District Mining Office indicated above each application within 30-days of this publication, or within 30-days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences). Such comments or objections should contain the name, address and phone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform DEP on the basis of comment or objection and relevant facts upon which it is based.
In addition, requests for an informal conference, or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. MINING ACTIVITY NPDES DRAFT PERMITS This notice provides information about applications for a new, amended or renewed National Pollutant Discharge Elimination System (NPDES) permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).
The Department of Environmental Protection (DEP) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.
Effluent Limits for Coal Mining Activities
For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).
The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Effluent Limits for Noncoal Mining Activities
The limits for noncoal mining activities as provided in 25 Pa. Code § 77.522 are pH 6 to 9 and other parameters DEP may require.
Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (DEP). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341), requires the State to certify that the involved projects will not violate the applicable provisions of Sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), as well as relevant State requirements. Delaware County is proposing the following water obstruction and encroachment activities along an approximate 1.5-mile segment of the proposed 14-foot-wide Chester Creek Branch Rail to Trail project on existing railroad tracks, impacting approximately 0.02 acre of wetlands. The proposed activities are:
1. To remove the existing rails, ties, and ballasts.
2. To construct and maintain a 14-foot-wide trail in the 100-year floodway of Chester Creek.
3. To replace a deteriorated existing pipe carrying Channel 7 (UNT to Chester Creek, WWF/MF), and construct and maintain an 84-inch CMP (75 feet × 7 feet) with a steel end section installed upstream and a rock riprap apron installed downstream at 39. (STA 38+35). Additional rock will be placed to stabilize the washed-out current conditions. The work will also a includes temporary placement of a clean water bypass pumping system within Channel 7, totaling 20 linear feet (240 square feet). This work also includes permanent placement of fill in wetlands and temporary excavation to wetlands. To construct the trail, 0.008 acre (304 square feet) of permanent fill will be placed in PEM/PSS/PFO Wetland C (39.86557°, -75.40296°/STA 39+50) and 0.001 acre (40 square feet) of permanent fill in PEM/PSS Wetland D (39.86557°, -75.40296°/STA 38+75). A temporary excavation to construct the trail will impact 0.008 acre (332 square feet) of PEM/PSS/PFO Wetland C (39.86557°, -75.40296°/STA 39+50) and 0.001 acre (61 square feet) of temporary excavation in PEM/PSS Wetland D (39.86557°, -75.40296°/STA 38+75).
4. To construct and maintain a 72-inch CMP (93 feet × 6 feet) carrying Channel 6 (UNT to Chester Creek, WWF/MF) under the Dutton Mill Road Trailhead and Parking Lot with a steel end section will outlet over a riprap apron on the downstream end before entering Chester Creek outside the LOD. To place fill in Channel 6 (UNT to Chester Creek, WWF/MF) totaling 160 linear feet (3,520 square feet) at 39.86719°, -75.40822° (STA 55+90). The work includes temporary placement of a diversion dike and clean water bypass pumping system within Channel 6 totaling 22 linear feet (176 square feet).
5. To maintain the 48-inch RCP (75 feet × 6 feet) carrying Channel 5 (UNT to Chester Creek, TSF/MF) and add a rock riprap apron to the downstream side at 39.86965°, -75.41056° (STA 72+50). The work includes any flow from the intermittent Channel 5 will be pumped and filtered before entering Chester Creek, totaling 15 linear feet (90 square feet) of temporary impact.
6. To construct and maintain a 31.50-foot plank beam structure (31.5 feet × 13.5 feet × 62 feet) over Channel 4 (UNT to Chester Creek, TSF/MF) and add rock to stabilize the sediment around the washout at 39.87255°, -75.41362° (STA 79+90). Fill will be added to Channel 4 totaling 26 linear feet (208 square feet). The work includes a diversion dike and clean water bypass pumping system will be utilized to install both the structure and the stabilizing rock on either side of the washout, totaling 61 linear feet (366 square feet) of temporary impact.
7. To construct and maintain an 84-inch CMP with a steel end section and a rock riprap apron to replace the deteriorated existing pipe carrying Channel 3 under the railway at 39.87255°, -75.41355° (STA 84+60) totaling in 105 linear feet (735 square feet). The work includes a diversion dike and clean water bypass pumping system will be utilized to install both the pipe and the stabilizing rock, totaling 44 linear feet (308 square feet) of temporary impact.
8. To maintain and enhance the existing single span riveted steel plate girder bridge (119.7 feet × 15.8 feet × 66.2 feet) carrying the Chester Creek Trail over Chester Creek and place R-6 rock on the abutments to stabilize the structure at 39.89401°, -75.41355 (STA 90+00), totaling 68 linear feet (816 square feet). Temporary excavation to improve the abutments totaling 65 linear feet (520 square feet).
The site is located approximately between the southern trail head off of Bridgewater Road (SR 3018) in Aston Township and Chester Creek Road (SR 3015) and terminate in Middletown Township—Station 27+00 to Station 94+50 (Marcus Hook, PA USGS map, Lat: 39.865725, Long; -75.406622) in Aston and Middletown Townships, Delaware County.
