34-05002B: Texas Eastern Transmission, LP, 3318 Pumping Station Road, East Waterford, PA 17021, Lack Township, Juniata County. For the construction of two (2) new Solar Titan 130, 18,100 HP, natural gas-fired, simple cycle turbines at the Perulack Compressor Station. These new turbines will replace four (4) of the existing natural gas-fired, turbines (Source IDs 034—037). The turbines will be built with SoLoNOx dry low NOx (DLN) technology for the control of NOx and equipped with oxidation catalysts for the control of CO, VOCs and organic hazardous air pollutants (HAPS). The facility is also replacing the current Waukesha 600 bhp emergency generator (Source ID 040) and Leroi 600 bhp emergency generator (Source ID 041) with Waukesha, VGF24GL, 585 bhp, and CAT 3512C, 1,114 bhp, natural gas, emergency generators. The project will also include the installation of two (2) fuel gas heaters, each rated at 1.154 MMBtu/hr heat input, one (1) 1,880 gallon pipeline liquid tanks, one (1) 3,550 gallon oil tank, one (1) 12,690 gallon oily water tank, one (1) truck loading source for pipeline liquids, one (1) truck loading source for used oil, one (1) truck loading source for oily water and five (5) separator vessels (two (2) 33 gallon vessels, (2) 83 gallon vessels and one (1) 185 gallon vessels) associated with the blowdown separators. Permitted sources at the facility include a 500,000 Btu/hr natural gas boiler, 2 paint booths, 2 natural gas fueled air-makeup units, welding operations, paint mixing, manual paint application operations, and miscellaneous natural gas heating emissions. Potential Emissions for the site are as follows: 3.07 tpy CO; 3.88 tpy NOx; 0.62 tpy particulate matter; 0.02 tpy SOx; 40.6 tpy VOC, 9.91 tpy xylene; 7.46 tpy ethylbenzene; and 19.4 tpy all HAPs combined. The facility is a Natural Minor. The Operating Permit will include a site-level VOC emission restriction of 49.32 tpy. Proposed State Water Quality Certification Required By Section 401 Of The Clean Water Act For The US Army Corps Of Engineers Codorus Creek Flood Risk Management.

Codorus Creek Flood Risk Management Maintenance Project in York City, York County (York, PA Quadrangles, from Lat: 39.9705, Long: -76.7274 to Lat: 39.9841, Long: -76.7233).

 On February 23, 2024, Applicant requested a state water quality certification from the Department of Environmental Protection (Department), as required by Section 401 of the Clean Water Act (33 U.S.C.A. § 1341), to ensure that the operation and maintenance of the Codorus Creek Flood Risk Management (FRM) Maintenance Project will protect water quality in this Commonwealth through compliance with State water quality standards and associated State law requirements, which are consistent with the requirements of the Clean Water Act.

 The proposed project consists of rehabilitation of the flood channel system through the removal of shoaled material above and below the waterline within the Codorus Creek Channel, totaling approximately 3.7 acres with 0.05 acre of emergent wetland impact.

 The Department anticipates issuing a State water quality certification to the applicant for the Codorus Creek FRM Maintenance Project that will require compliance with the following State water quality permitting programs, criteria and conditions established pursuant to State law to ensure that the Codorus Creek FRM Project does not violate applicable state water quality standards set forth in 25 Pa. Code Chapters 93 and 96:

 1. Erosion and Sediment Control Permit—Applicant shall comply with the Department's Chapter 102 Erosion and Sediment Control requirements pursuant to the Commonwealth's Clean Streams Law and Storm Water Management Act (32 P.S. §§ 680.1—680.17), and all applicable implementing regulations (25 Pa. Code Chapter 102).

 2. Erosion and Sediment Control Plan—Applicant shall develop an Erosion and Sediment Control Plan that is consistent with the requirements identified in 25 Pa. Code Chapter 102. Applicant shall implement best management practices (BMPs) to minimize the potential for accelerated erosion and sedimentation from the project and to protect, maintain, reclaim and restore water quality and the existing and designated uses of waters of the Commonwealth and comply with all applicable implementing regulations (25 Pa. Code Chapter 102) pursuant to Pennsylvania's Clean Streams Law.

 3. Water Obstruction and Encroachment—Applicant shall comply with the requirements of 25 Pa. Code Chapter 105 for the construction, operation and maintenance of all water obstructions and encroachments associated with the Codorus Creek FRM Project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P.S. §§ 673.1—693.27), and Flood Plain Management Act (32 P.S. §§ 679.101—679.601).

 4. Water Quality Monitoring—The Department retains the right to specify additional studies or monitoring to ensure that the receiving water quality is not adversely impacted by any operational and construction process that may be employed by Applicant.

 5. Inspection—The Codorus Creek FRM Maintenance Project, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of the Department to determine compliance with this State Water Quality Certification, including all required State water quality permits and State water quality standards. A copy of this certification shall be available for inspection by the Department, or an authorized representative thereof, during such inspections of the Codorus Creek FRM Project.

 6. Transfer of Projects—If Applicant intends to transfer any legal or equitable interest in the Codorus Creek FRM Project which is affected by this State Water Quality Certification, Applicant shall serve a copy of this certification upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the Department Regional Office of such intent. Notice to the Department shall include a transfer agreement signed by the existing and new owners containing a specific date for transfer of certification responsibility, coverage, and liability between them.

 7. Correspondence—All correspondence with and submittals to the Department concerning this State Water Quality Certification shall be addressed to: Department of Environmental Protection, Southcentral Regional Office, Program Manager, Waterways and Wetlands, 909 Elmerton Avenue, Harrisburg, PA 17110.

 8. Reservation of Rights—The Department may suspend or revoke this State Water Quality Certification if it determines that Applicant has not complied with the terms and conditions of this certification. The Department may require additional measures to achieve compliance with applicable law, subject to Applicant's applicable procedural and substantive rights.

 9. Other Laws—Nothing in this State Water Quality Certification shall be construed to preclude the institution of any legal action or relieve Applicant from any responsibilities, liabilities, or penalties established pursuant to any applicable Federal or state law or regulation.

 10. Severability—The provisions of this State Water Quality Certification are severable and should any provision of this certification be declared invalid or unenforceable, the remainder of the certification shall not be affected thereby.

 Prior to issuance of the final State Water Quality Certification, the Department will consider all relevant and timely written comments, suggestions or objections submitted to the Department within 30 days of this notice. Written comments should be submitted to the Department by e-mail to RA-EPWW-SCRO@pa.gov or by mail to the previously listed address or through the Pennsylvania AT&T Relay Service at (800) 654-5984 (TDD) and should be directed to Program Manager, Waterways and Wetlands Program.
