Federal Consistency under the Coastal Zone Management Act; Neill Drive Pumping Station Stream and Infrastructure Protection

 This notice is published under section 306(d)(14) of the Federal Coastal Zone Management Act of 1972 (CZMA) (16 U.S.C. § 1455(d)(14)), regarding public participation in consistency determinations. The Department of Environmental Protection (Department), Coastal Resources Management Program, has received notice that the Philadelphia Water Department (applicant) is proposing to complete stream channel stabilization, install an encasement around an existing waterline and repair four existing outfalls, three stormwater and one sewer, within and along an Unnamed Tributary (UNT) to Schuylkill River in the City of Philadelphia (Project).

 The proposed Project will include channel grading to remove the sharp, erosion-prone bends in the stream, 35 boulder cascades, 16 rock step structures, 7 boulder toe revetments, vegetated riprap, soil choked riprap, an engineered riffle through the existing stone masonry arch bridge and a cross-rock vane at the lower limit of the Project. The applicant also proposes to have regrading and channel stabilization completed on two tributaries to the UNT to Schuylkill River as part of this project. Additional proposed Project elements include the repair of four existing outfalls, three of which are stormwater and one sewer, and the protection of one 8-inch existing water line with a concrete encasement. Upon construction completion, the applicant proposes to restore the disturbed areas by planting trees, shrubs, live stakes and distributing a floodplain seed mix and a forest understory seed mix as detailed in the developed Landscape Plan. There are no wetland impacts associated with this Project. The applicant is seeking a Federal authorization from the United States Army Corps of Engineers under section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C § 403) and section 404 of the Federal Clean Water Act (33 U.S.C. § 1344) to perform this work.

 This Project is subject to Department review for Federal consistency because it is an activity requiring a Federal license or permit and will have reasonably foreseeable interstate effects on this Commonwealth's coastal resources or uses.

 In accordance with section 307 of the CZMA (16 U.S.C. § 1456) and the National Oceanic and Atmospheric Administration (NOAA) regulations at 15 CFR Part 930, Subpart D (relating to consistency for activities requiring a Federal license or permit), the applicant has certified that the proposed activity will be conducted in a manner consistent with the applicable enforceable policies of the Commonwealth's NOAA-approved Coastal Resources Management Program.
