 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. Plan Description:

 Rockland Township Act 537 Plan, B1-06956-ACT. The Department of Environmental Protection (DEP) has reviewed the previously-referenced application and has determined that it is incomplete, and it is therefore denied. The application is incomplete due to the failure to provide sufficient information and supporting documentation as required by Act 537, The Clean Streams Law (CSL), and regulations promulgated thereunder, for DEP to complete a technical review and act upon the application. The following list specifies the items that were not included in your application: 1. Section II.D does not investigate relationships between elevated nitrate-nitrogen in groundwater wells with land-use or geology. Well sampling helps inform potential needs areas. No analysis was provided. 2. Section V.B.2 does not describe when a preliminary hydrogeologic evaluation is necessary. At a minimum, a preliminary hydrogeologic study is required when any of the criteria under 25 Pa. Code § 71.62(c)(2) is met. The analysis in Section II.D may inform that preliminary hydrogeologic studies are needed beyond the minimum requirements dictated under 71.62(c)(2). 3. A table displaying the well sampling raw data was not provided and is required. The table should include the well/sample number or identifier, address, latitude/longitude of well location (if recorded), well depth (if known), sampling date, and concentrations of all tested parameters (nitrate-nitrogen, coliform, and fecal coliform). A map showing the well/sample numbers or identifiers should be included. 4. Explanation was not given for the definition of alternating absorption area mentioned in section V.B.4.b. 5. The study does not address alternatives for when holding tanks are permitted to abate malfunctions on lots with limitations that prevent the use of other on-lot systems, including on-lot alternate technologies. 25 Pa. Code § 71.63(d) allows the use of holding tanks to abate a nuisance or public health hazard, but the Department considers these repair holding tanks to be temporary fixes, not permanent solutions. Therefore, the study has yet to provide any potential options for lots served by repair holding tanks. Any reconsideration of this project shall occur only if a complete and updated set of planning modules is submitted. The new DEP Code No. C1-06956-ACT must be used. All materials must be newly adopted by resolution, and otherwise meet the requirements of Chapter 71 of DEP's regulations.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The DEP may approve or disapprove plans and reports submitted. This notice provides DEP's decision and, if relevant, the basis for disapproval.

 Encompass Health Pennsylvania Real Estate, LLC, proposes the development of an inpatient rehabilitation facility and associated parking and circulation, lighting, stormwater management facilities, and other utilities on a 9.63-acre site located at 2660 Audubon Road, Lower Providence Township, Montgomery County, PA.

 The proposed improvements include the following: to relocate 380 linear feet (LF) of Lamb Run, a tributary to the Schuylkill River, resulting in 0.10 acre of permanent impacts to the existing stream. There will also be 0.03 acre of temporary impact to Lamb Run for construction access. The relocated stream will be 363 LF long and approximately 13 feet wide (0.11 acre). The project also proposes 0.96 acre of permanent disturbance within the assumed 50-foot floodway of Lamb Run, including the work to realign the stream, grading, stormwater outfalls, and a retaining wall. There will also be 0.3 acre of temporary disturbance to the assumed floodway consisting of tree clearing and earth disturbance to allow for access. Permanent impacts include 0.13 acre of a manmade pond and 0.10 acre of isolated wetland for construction of parking and grading west of the stream.

 The site is located near the intersection Trooper Road and Audubon Road at 2660 Audubon Road (Valley Forge, PA USGS map, Lat: 40.11770; Long: -75.42580) in Lower Providence Township, Montgomery County

 Special condition;

 A. All disturbed areas are to be restored to the original contours and shall be replanted with indigenous plant species.

 B. Streambank disturbances shall be minimized and stabilized with indigenous vegetation within ten (10) calendar days of final earthmoving to prevent erosion and provide cover, shading, and food source for aquatic life.

 C. Permittee shall monitor the stream and wetland plantings for at least five years. Reports shall be submitted to the respective DEP Regional Office in the spring and fall for the first two calendar years following construction and annually for three years thereafter. The monitoring reports shall contain information describing the success of the site at the time of inspection, an inventory of the surviving plant species and percent areal coverage, photographs of the replacement site with plans showing the location and orientation of each of the photographs, and a written plan to correct any deficiencies identified during the monitoring phase. Permittee shall ensure at least an 85 percent survival rate. Additional plantings and or reports may be required if an 85 percent survivability of planted species is not achieved.

 D. The Department has determined that the Permittee has made arrangements to satisfy their compensatory mitigation requirements for 0.10 wetland credits through the purchase of 0.10 wetland credits from the approved compensatory mitigation provider First Pennsylvania Resource, LLC. (FPR) DEP File No.: MB9915-0001, approved for use in Compensation Service Area: Lower Delaware River Subbasin (PA State Water Plan Subbasin No. 3). Within 60 days from the date of issuance of this permit, Permittee shall provide to the Department proof of transfer of the approved credit amounts and types and FPR's acceptance of liability to provide the compensatory mitigation requirements. Failure to provide such proof of transfer of credits and FPR's acceptance of liability of compensatory mitigation requirements shall violate the terms and conditions of this permit. This failure may result in the modification, suspension, or revocation of this permit, in whole or in part, and/or the Department may, in addition, institute appropriate legal proceedings.

 E. Upon discovery of significant changes that could compromise the integrity of the project, the permittee shall immediately notify Pennsylvania Department of Environmental Protection (DEP) Southeast Regional Office (SERO) at 484-250-5160.
