Section 303(d) List of Waters; Notice of Availability

   The Department of Environmental Protection announces that Pennsylvania's section 303(d) list of waters which requires the development of Total Maximum Daily Loads (TMDLs) is available for review and comment. The list was developed by the Department to comply with section 303(d) of the Federal Clean Water Act and 40 CFR Part 130. TMDLs are the total amounts of point and nonpoint source pollutants that may be discharged into a water body that will still meet water quality standards. For point sources, the TMDLs are used as a basis for water quality-based limits in NPDES permits. For nonpoint sources, watershed management plans are developed which identify the Best Management Practices or other measures necessary to improve water quality with the goal of meeting water quality standards. A water body need not be listed if a TMDL has already been established. In addition, a water body that will meet water quality standards after the implementation of technology-based requirements need not be listed.

   The Department developed the list using existing and readily available information regarding waste sources, water quality, water uses and water quality criteria. It considered the 16 screening categories of information included in EPA guidance in developing the list. The list considered compliance with water quality criteria for conventional, nonconventional and toxic pollutants. The waters included on the list are those identified through the Department's Watershed Permitting Process, Water Quality Assessment Program (including the section 305(b) Water Quality Inventory Report) and the Department's Nonpoint Source Program. The Department expects to develop TMDLs for some of the listed waters over the next 2 years.

   Persons wishing to comment on the list may do so in writing to the Bureau of Water Quality Management at the above address or by Internet E-Mail (Sowers.Christine@a1.dep.state.pa.us) by no later than May 20, 1996. Comments received by facsimile will not be accepted. If sufficient interest is generated, a public hearing may be held at an appropriate location.
