Transfer of Regulations

   The Department of Conservation and Natural Resources (DCNR), the Department of Agriculture, the Department of Community Affairs, the Department of Environmental Protection and the Department of Health jointly submit this notice for the purpose of renumbering certain existing regulations and statements of policy. This renumbering has been made necessary by the enactment of the Conservation and Natural Resources Act (CNRA) (71 P. S. §§ 1340.101--1340.1103).

   Among other things, the CNRA created the DCNR, and transferred to DCNR certain functions which had previously been assigned to the Department of Environmental Resources. Section 320 of the CNRA (71 P. S. § 1340.320) requires the DCNR to submit a notice renumbering certain regulations and policies in acknowledgement of that reassignment of functions. In addition, the renumbering of other regulations is necessitated by other transfers of responsibilities from the Department of Community Affairs to DCNR, and from the Department of Environmental Resources (now the Department of Environmental Protection) to the Departments of Agriculture and Health. See sections 306, 505 and 506 of the CNRA (71 P. S. §§ 1340.306, 1340.505 and 1340.506).

   Therefore, in recognition of the transfers of functions set forth in the CNRA, the executive agencies named in this notice hereby request the Legislative Reference Bureau to create a new Title 17 of the Pennsylvania Code, and to make changes to the organizational numbering of the affected regulations and statements of policy, as set forth in the following tables:
