   A.  WA-55-1005.  Adams Township Municipal Authority, Hassinger Spring, 4,800 feet north of the Village of Troxelville in Adams Township, Snyder County. Application for a water allocations permit to withdraw up to 14,400 gallons per day for public water supply use to serve Troxelville.


ACTIONS

   The Department of Environmental Protection has taken the following actions on previously received permit applications and requests for plan approval and has issued the following significant orders.

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decisional law.

   The following reflects changes from the notice published in the August 13, 1994, Pennsylvania Bulletin:

   Outfall 001--Existing Outfall with discharge to an unnamed tributary to Schuylkill River.

   Effluent limits for Total Residual Chlorine have been included as 1.3 mg/l for 59 months and 0.04 mg/l for 60th month of the permit. The effluent limit for whole effluent toxicity has been changed from 1.3 TUa (Acute Toxic Units) to 1.8 TUc (Chronic Toxic Units).

   The effluent limit for copper has been revised from 0.022 mg/l (Average Monthly) to 0.032 mg/l (Average Monthly) and for zinc the limit has been revised from 0.108 mg/l (Average Monthly) to 0.174 mg/l (Average Monthly).

   Outfall 002--new outfall with direct discharge to the Schuylkill River.

   Effluent limits for Total Residual Chlorine have been included as 1.3 mg/l (Average Monthly) for first 3 years and 0.5 mg/l for last 2 years of permit. The effluent limits for whole effluent toxicity has been revised from 1.3 TUa (Acute Toxic Units) to 26 TUc (Chronic Toxic Units).

Unless otherwise indicated on the basis of preliminary review, or application of lawful standards and regulations, the Department of Environmental Protection proposes to issue coverage under the General Permit subject to effluent limitations, monitoring and reporting requirements and other conditions set forth in the General Permits.

   Location: City of New Castle, Townships of Neshannock, Hickory, Shenango, Taylor and Union, Borough of South New Castle, Lawrence County; New Castle Sanitation Authority, P. O. Box 1404, New Castle, PA 16103.

   Project Description: The approved plan provided for expansion of the POTW's hydraulic capacity from its present permitted average daily flow of 9.0 mgd to 17.0 mgd. The plant will be able to handle a peak daily flow of 26.5 mgd. To achieve these capabilities, the following major POTW modifications will be undertaken: one additional primary clarifier tank, three new aeration tanks, two new final settling tanks, a new dewatering belt filter, a new chlorine contact tank, new influent and effluent pumps, site work and dechlorination. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal.

   Location: Frankstown Township, Blair County, Box 19, Sylvan Drive, Hollidaysburg, PA 16648.

   The approved plan provided for construction of public sewer service collection systems to serve the Brushmead, Loop Area and Kline's Acres areas of the Township. Treatment will be at the Hollidaysburg wastewater treatment plant. An onlot sewage disposal management program will be implemented in the remainder of the Township. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES permits or WQM permits must be obtained in the name of the municipality or authority.

   Location: New Milford Borough and New Milford Township, Susquehanna County.

   Project Description: The Department has completed its review of the Official Sewage Facilities Plan Update (Update) for New Milford Borough and portions of New Milford Township, revised July, 1995. The revised Update was sent to us by Milnes Engineering, Inc.'s (MEI's) September 13, 1995 transmittal letter. Previously, MEI had submitted an Update, revised November, 1993, for our review and comment. This Update was returned as it was incomplete and to give New Milford Township additional time to reach an agreement with both New Milford Borough and with New Milford Municipal Authority to provide sanitary sewer service within the Township. The Department has found that the Update is now acceptable and hereby grants planning approval.

   The Planning Area included under the Update is:

   *  The entire Borough of New Milford, and

   *  The following portions of New Milford Township:

   --Properties adjoining Route 11 North of New Milford Borough up to and including Township Road 698,

   --Properties adjoining Route 1018 from Route 11 up to and including the Blue Ridge High School,

   --Properties adjoining Route 11 southwest of New Milford Borough up to and including the Summit Inn,

   --Properties adjoining Route 492 east of New Milford Borough from the Borough line to and including Lakeside Village, and

   --Properties surrounding Page Lake on private roads of the Lakeside Outing Club, excepting those properties in Jackson Township.

   The Update was written to address the continuing problems faced by both the Borough and the Township due to repeated malfunctions of the onlot sewage disposal systems. In addition, the Update proposes the elimination of the wastewater treatment plant that serves the Blue Ridge High School.

   The current status of sewage disposal systems was evaluated and alternatives for improved sewerage facilities were proposed to meet the identified sewage disposal needs for the foreseeable future. The chosen alternative consists of the installation of a centralized sewerage collection system, and construction of a 250,000 gallons per day wastewater treatment facility (WWTF). These systems may subsequently be owned by the New Milford Municipal Authority. For New Milford Borough, the sewer system will be either low pressure or vacuum. For New Milford Township, the sewer system will be low pressure. Sewage from both Page Lake and Lakeside Village and the Blue Ridge High School will be conveyed through force mains to the Borough. The WWTF is sized to treat 851 EDUs initially and 916 EDUs ultimately. Initially, 489 EDUs from New Milford Borough and 362 EDUs from New Milford Township will be connected to the system. The proposed WWTF is a Sequential Batch Reactors System. The proposed plant discharge will enter Martins Creek.

   The Department's review of the Update has not identified any significant environmental impacts resulting from the proposals.

   In accordance with the provisions of the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.2(a)) (Act 537) and Chapter 71 of the Department's Regulations, 25 Pa. Code Chapter 71, the Department will hold both the Borough and the Township responsible for the complete and timely implementation of the chosen alternative, as stated in the EXECUTIVE SUMMARY (Page iii of the Update); in Section VII Alternative Selection (Page 63 of the Update); and in Section IX Plan Summary, where a Schedule of Implementation is presented (Pages 66 through 69 of the Update).

   Location: Tobyhanna Township, Monroe County.

   Project Description: The Department received the latest Sewage Facilities Plan Revision titled ''Tobyhanna Township Act 537 Revision, October 1995'' on December 4, 1995 and additional documents on January 9, 1996, as prepared by Michael J. Pasonick, Jr., Inc. The Department's review of the plan has not identified any significant environmental impacts resulting from the proposal and we hereby grant planning approval for the project.

   The plan proposes the following:

   1.  Construction of a 0.300 mgd advanced wastewater sewage treatment plant to serve 560 EDUs initially and 1,000 EDUs ultimately from the Blakeslee Village, Greenwood Acres, and Camelot Forest areas of the Tobyhanna Township. The plant will be constructed along State Route 115, and the treated effluent will be discharged into Tobyhanna Creek.

   2.  Installation of a sewage collection and conveyance system consisting of gravity sewer, low pressure sewer and grinder pumps, laterals, three pumping stations, and force main to collect and convey sewage from the stated service areas to the treatment plant site.

   In accordance with the provisions of the Sewage Facilities Act (Act 537), 35 P. S. §§ 750.1--750.20(a) and Chapter 71 of the Department's Regulations, 25 Pa. Code Chapter 71, the Department will hold Tobyhanna Township responsible for implementing the project in accordance with the schedule contained in the plan.

This proposal involves the construction of the Kelton-Pennock Pump Station. The pump station will increase the finished water transmission capability from 44 mgd to 60 mgd when operating in conjunction with the Rosedale Pump Station in New London Township, Chester County.

   Permit No. 0995514.  Public water supply. Chalfont Borough Water Department, 40 North Main Street, Chalfont, PA 18914. This proposal involves installation of corrosion control feed equipment at five existing wells: well nos. 8, 11, 12, 13 and 14 in Chalfont Borough, Bucks County.

   Type of Facility: Public water supply system.

   3993509.  Public water supply. A permit was issued on January 12, 1996, to Slatington Borough, 125 South Walnut Street, Slatington, PA 18080. This proposal involves the construction of a 0.75 mgd filtration plant, one 0.5 mg concrete reservoir, the installation of polyethylene liners in two existing reservoirs (i.e. Slatington Springs), and the connection of the Blue Valley Quarry to the Borough's system to be used as an additional source of supply. It is located in Washington Township, Lehigh County.

   4895502.  Public water supply. A permit was issued on January 12, 1996, to Gap View Trailer Park, c/o Phillip Ahearn, Owner, R. D. 2, Box 2088, Bangor, PA 18013. This proposal involves permitting of the existing two wells and associated distribution system with the addition of raw water disinfection. It is located in Upper Mount Bethel Township, Northampton County.

   4895503.  Public water supply. A permit was issued on January 4, 1996, to Portland Borough Authority, Water Filtration Plant, P. O. Box 572, Portland, PA 18351. This proposal involves the construction of a 0.184 mgd DE Filter Plant and 0.35 mg steel storage tank, located in Portland Borough, Northampton County.
