Consolidated Rules of Court; No. 17 Miscellaneous 1999

Adopting Order

   And Now, this 2nd day of February, 1999, it is hereby Ordered:

   1.  The following designated Somerset County Rule of Civil Procedure (SOM.R.C.P.) is hereby adopted as a rule of this Court, effective thirty days after publication in the Pennsylvania Bulletin:

   SOM.R.C.P. 1915.3 Commencement of Custody Proceedings

   2.  The Somerset County Court Administrator shall:

   A.  File seven (7) certified copies of this Order with the Administrative Office of Pennsylvania Courts.

   B.  Distribute two (2) certified copies of this Order to the Legislative Reference Bureau for publication in the Pennsylvania Bulletin.

   C.  File one (1) certified copy of this Order with the Pennsylvania Civil Procedural Rules Committee and one (1) copy with the Pennsylvania Domestic Relations Procedural Rules Committee.

   D.  File proof of compliance with this Order in the docket for these rules, which shall include a copy of each transmittal letter.

Rules of Court

Som.R.C.P. 1915.3.  Commencement of Custody Proceedings.

   A.  Upon the presentation of a request for scheduling of a conference or hearing on any claim for custody, partial custody or visitation, the moving party shall pay an administrative fee in the amount of $50.00, unless excused by the Court.

   B.  Upon the presentation of a request for scheduling of a conference or hearing on a claim for modification of an existing custody, partial custody or visitation order, the moving party shall pay an administrative fee in the amount of $30.00, unless excused by the Court.

   C.  Conference or hearing will not be scheduled unless the required fee is paid, or an order is entered excusing payment.
