FISH AND BOAT COMMISSION

Notice of Proposed Designation of a Section of the Youghiogheny River

   At its July, 1998 meeting, the Fish and Boat Commission (Commission) designated a section of the Youghiogheny River, Somerset and Fayette Counties, from the mouth of the Casselman River downstream to the Route 381 Bridge at Ohiopyle, to be regulated and managed under the All-Tackle Trophy Trout program under 58 Pa. Code § 65.4a, effective January 1, 1999. This designation provided for year round trout angling with no tackle restriction under a 14 inch minimum size limit and two trout daily creel limit during the regular trout season (8 a.m. opening day through midnight Labor Day) with no harvest permitted during the remainder of the season.

   In September 1998, the Commission reviewed the action taken at the July meeting and decided to apply the All-Tackle Trophy Trout regulations only to a 3.5 mile section of the Youghiogheny River from the confluence with Ramcat Run downstream to the pipeline crossing at the confluence with Lick Run, instead of the longer section. This action was based on public comments received subsequent to the July meeting. The Commission decided to defer action on designating an additional section of the river under the All-Tackle Trophy Trout regulations pending further public input and analysis of data gathered by the Commission's fisheries management staff.

   The Commission is now proposing to designate a 9-mile section of the Youghiogheny River from the confluence with Ramcat Run downstream to the Route 381 Bridge at Ohiopyle to be managed and regulated under the All-Tackle Trophy Trout program. This designation, if approved, will go into effect on January 1, 2001.

   At this time, the Commission is soliciting public input concerning the proposed designation. Persons with comments, objections or suggestions concerning the proposed designation are invited to submit comments in writing to Executive Director, Fish and Boat Commission, P. O. Box 67000, Harrisburg, PA 17106-7000 within 30 days after publication of this notice in the Pennsylvania Bulletin. Comments submitted by facsimile will not be accepted.

   Comments also may be submitted electronically at ''regulations@fish.state.pa.us.'' A subject heading of the proposal and a return name and address must be included in each transmission. In addition, all electronic comments must be contained in the text of the transmission, not in an attachment. If an acknowledgment of electronic comments is not received by the sender within 2 working days, the comments should be retransmitted to ensure receipt.
