LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

Under Act 2, 1995

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediations Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program.

   Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediations Standards Act (Act). Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

If information concerning a plan or report is required in an alternative form, contact the community relations coordinator at the appropriate Regional Office listed.    3600 Reed Street Property, City of Philadelphia, Philadelphia County. Michael A. Christie, P.G., Penn Environmental & Remediation, 2755 Bergey Road,Hatfield, PA 19440, has submitted a Remedial Investigation/Cleanup Plan concerning remediation of site soil contaminated with lead, heavy metals, BTEX and polycyclic aromatic hydrocarbons and groundwater contaminated with solvents. The report was approved by the Department on September 20, 2000.

   Glasgow Bridgeport Facility, Upper Merion Township, Montgomery County. Christopher Orzechowski, RT Environmental Services Inc., 214 W. Church Road, King of Prussia, PA 19406, has submitted a Final Report concerning remediation of site soil contaminated with lead, BTEX and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Statewide health standards and was approved by the Department on September 21, 2000.

   Airport Business Center, Tinicum Township, Delaware County. Susan L. Gordon, Farer Fersko, 600 South Avenue, P. O. Box 580, Westfield, NJ 07091-0580, has submitted a Final Report concerning remediation of site soil contaminated with heavy metals, pesticides and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Statewide health standard and was approved by the Department on September 26, 2000.

   Former Diamond Oil Property--Lot 2, City of Coatesville, Chester County. James Taylor, Taylor Geo Services, 341 Dartmouth Avenue, Swarthmore, PA 19081, has submitted a Baseline Remedial Investigation Report concerning remediation of site soil and groundwater contaminated with BTEX and polycyclic aromatic hydrocarbons. The report was approved by the Department on September 27, 2000.

   2555 Street Road, LLC, Bensalem Township, Bucks County. Darryl D. Borrelli, Manko, Gold & Kathcher, LLP, 401 City Avenue, Suite 500, Bala Cynwyd, PA 19004, has submitted a Remedial Investigation/Final Report concerning remediation of site groundwater contaminated with solvents. The report demonstrated attainment of site-specific standards and was approved by the Department on October 4, 2000.

   Heating Oil Partners, L. P./Gill Brothers Oil Co., Northampton Township, Bucks County. Sean M. Grexa, The Tyree Organization, Ltd., 1350 S. U. S. Highway 130, Burlington, NJ 08016, has submitted a Final Report concerning remediation of site soil contaminated with petroleum hydrocarbons and groundwater contaminated with BTEX. The report demonstrated attainment of site-specific standards and was approved by the Department on October 4, 2000.

   Spector Residence, Bensalem Township, Bucks County. Louis F. Vittorio, Jr., P.G., EarthRes Group, Inc., P. O. Box 468, 7137 Old Easton Road, Pipersville, PA 18947, has submitted a Final Report concerning remediation of site soil contaminated with BTEX and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Statewide health standard and was approved by the Department on October 5, 2000.

   Romagano Residence, Bensalem Township, Bucks County. Louis F. Vittorio, Jr., P.G., EarthRes Group, Inc., P. O. Box 468, 7137 Old Easton Road, Pipersville, PA 18947, has submitted a Final Report concerning remediation of site soil contaminated with BTEX and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Statewide health standard and was approved by the Department on October 5, 2000.

   ChiRex Technology Center, Inc., Charlestown Township, Chester County. Steven L. Tanen, HydroScience, Inc., Center City Executive Centre, 607 Washington Street, Reading, PA 19601, has submitted a Final Report concerning remediation of site soil contaminated with solvents. The report demonstrated attainment of the Statewide health standard and was approved by the Department on October 5, 2000.

   Goshiney Residence, Ryan Township, Schuylkill County. Brian Holtzhafer, Geologist, Hydrocon Services, Inc., 2945 South Pike Avenue, Allentown, PA 18103 submitted a Final Report (on behalf of his clients, John and Niki Goshiney, Locust Lake Road, Barnesville, PA 18214) concerning the remediation of site soils found or suspected to have been contaminated with no. 2 home heating fuel oil. The report documented attainment of the Statewide health standard and was approved on October 19, 2000.

   E39-386.  Encroachment. Whitehall Township, 3219 MacArthur Road, Whitehall, PA 18052. To remove the existing structure and to construct and maintain a single-span prefabricated steel truss pedestrian bridge, having a span of approximately 30 feet with an underclearance of approximately 5 feet, across Coplay Creek. The project is located within Hockendauqua Park, approximately 0.2 mile upstream of the Lehigh Street Bridge over Coplay Creek (Catasauqua, PA Quadrangle N:  6.1 inches; W:  16.4 inches), in Whitehall Township, Lehigh County.

   E40-545.  Encroachment. Pennsylvania Department of Transportation, Engineering District 4-0, P. O. Box 111, Scranton, PA 18501. To remove the existing structure and to construct and maintain an 18-span prestressed concrete bridge, having a total span of 2,375 feet with a maximum underclearance of 61 feet, across the Susquehanna River. The project will temporarily impact 0.03 acre of wetlands during construction. This impact will be restored at the completion of the project. The project is known as the Carey Avenue Bridge Replacement Project and is located along S. R. 2005, Section 371 (Wilkes-Barre West, PA Quadrangle N:  20.9 inches; W:  7.9 inches), in Plymouth Borough and Hanover Township, Luzerne County.

   E17-348.  Encroachment. Pennsylvania Department of Transportation, Engineering District 2-0, 1924--30 Daisy Street, Clearfield, PA 16830. To remove an existing structure and to construct, operate and maintain a single cell box culvert to carry SR 0729, Segment-Offset 0060/0474 across an unnamed tributary to Muddy Run. The public road crossing shall be constructed with a pre-cast reinforced concrete box culvert that will have a span of 10-feet, rise of 4.25-feet, depression of 0.50-feet, and skew of 75-degrees. The project is located along SR 0729 approximately 2,229-feet north of T-537 and SR 0729 intersection (Ramey, PA Quadrangle N:  3.6 inches; W:  10.1 inches) in Beccaria Township, Clearfield County. To construct and maintain an open pavilion 13 feet by 29 feet by 10 feet high supported by twelve 4 inch by 4 inch posts on a concrete pad in the floodway of the West Branch Susquehanna River on lot 26 at the Montgomery Boat Club (Muncy, PA Quadrangle N:  9.2 inches; W:  12.55 inches) in Clinton Township, Lycoming County. This permit was issued under section 105.13(e) ''Small Projects.''

   E59-396.  Encroachment. Pennsylvania Department of Transportation, Engineering District 3-0, 715 Jordan Avenue, Montoursville, PA 17754. To change the channel of Slate Creek; modify, operate and maintain an existing stream enclosure of Slate Creek; modify, operate and maintain existing stream enclosures of nine unnamed tributaries to the Tioga River; modify, operate and maintain an existing stream enclosure of Ellen Run; realign, operate and maintain the channel of Ellen Run; construct, operate and maintain a four span bridge across the Tioga River; modify, operate and maintain an existing stream enclosure of Kelly Creek for the construction of a limited access highway. The channel change and modification of the stream enclosure of Slate Creek shall be limited to a maximum waterway impact of 509-feet. The maintenance of the Ellen Run channel shall be in perpetuity with design cross-sections being maintained for a minimum of 400-feet downstream of the stream enclosure outlet. The bridge across the Tioga River shall be constructed with a minimum total span of 535-feet, underclearance of 49.8-feet, and skew of 56-degrees. The modifications at the stream enclosure of Ellen Run shall be limited to a maximum waterway impact of 400-feet. The modifications at the stream enclosure of Kelly Creek shall be limited to a maximum waterway impact of 190-feet. The modifications at the stream enclosures of the nine unnamed tributaries to the Tioga River shall be limited to a total waterway impact of 722-feet. Construction of SR 6015, Section E61 and Section F12 will result in the permanent impact to 0.60-acre of wetland and 1464-feet of waterway. Construction of SR 6015, Section E61 and Section F12 will result in the temporary impact to 2.33-acres of wetland and 20-feet of waterway. All permanent wetland impacts authorized by this permit shall be mitigated by the permittee through replacement wetlands at the Hilfiger site (0.60-acre). The 1434-feet of permanent impact to waterways authorized by this permit shall be mitigated by the permittee through the stream stabilization and riparian corridor restoration at Canoe Camp Creek. All waterway and wetland mitigation shall be constructed prior or concurrent with the activities authorized by this permit. This permit also authorizes the construction, operation and maintenance of temporary construction accesses across Waters of the Commonwealth; upon completion of the project, all construction accesses shall be removed and the areas restored to original contours, elevations, geometry and hydrology. The project is located along the eastern right-of-way of SR 0015 approximately 500-feet east of SR 0015 and SR 0006 intersection (Mansfield, PA Quadrangle N:  9.8 inches; W:  5.7 inches) in Mansfield Borough and Richmond Township, Tioga County. This permit authorizes the multiple encroachments for the stabilization and riparian corridor restoration of a 1.2-mile reach of Canoe Camp Creek for the mitigation of the permanent impact associated with section E61, section F12 and section D52.

Public Hearing Notice

   The Department of Environmental Protection (DEP) will conduct a public hearing on Tuesday, December 12, 2000, beginning at 7 p.m. in the auditorium of Seneca Valley High School, 128 Seneca School Road, Harmony, PA, in response to an application from AK Steel Corp., Butler Works for discharge of treated industrial wastewater.    Any person who wishes to present testimony at the hearing should submit a written notice of such intent to Pat Williams, Water Quality Program, DEP, 230 Chestnut Street, Meadville, PA 16335-3494, on or before December 5, 2000. The written notice should include the person's name, address, telephone number and a brief statement as to the nature of the testimony to be offered at the hearing. Testimony may be presented in either written or oral form. All testimony should be concise, to the point and relevant to the permit issue. Oral testimony will be limited to a maximum of 5 minutes per speaker. Those presenting written testimony can submit a written copy of their comments and any relevant documents at the hearing. Written testimony can also be sent to Pat Williams in the Meadville Water Quality Program either prior to the hearing or until December 22, 2000.

   After the hearing DEP will prepare a document including a summary of the written and oral comments submitted at the hearing, the DEP's responses to the comments, and the reasons for such responses. DEP will make its decision on the application following completion of this summary.

   Interested persons may obtain further information or inspect and copy public forms and related documents at the DEP Regional Office at 320 Chestnut Street in Meadville between the hours of 8 a.m. and 4 p.m. Monday through Friday. Calendar Year 1999 Applications For Municipal Recycling Program Performance Grant Applications

   The Department of Environmental Protection (Department) announces an extension to the deadline for calendar year 1999 Recycling Program Performance Grant applications from municipalities for grant assistance under section 904 of the Municipal Waste Planning, Recycling and Waste Reduction Act (Act 101) (53 P. S. § 4000.904).

   The deadline for submission of calendar year 1999 applications has been extended to 3 p.m., November 17, 2000. Applications must be on forms provided by the Department. Applications received by the Department after that date will not be considered. All grant awards are predicated on the receipt of recycling fees required by sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.
