Actions Taken by the Commission

   The Independent Regulatory Review Commission met publicly at 10:30 a.m., Thursday, March 22, 2001, and took the following actions:

Regulations Deemed Approved under Section 5(g) of the Regulatory Review Act--Effective March 15, 2001

   Insurance Department #11-201: Allocation of Joint Expenses (amends 31 Pa.  Code Chapter 3).

   Insurance Department #11-202: Miscellaneous Provisions (amends 31 Pa. Code Chapter 11).

Regulations Approved:

   Insurance Department #11-203: Annual Audited Insurers' Financial Report Required (amends 31 Pa. Code Chapter 147).

   Department of Transportation #18-349: Administrative Practice and Procedure; Outdoor Advertising (amends 67 Pa. Code Chapters 445 and 491).

Insurance Department; Annual Audited Insurers' Financial Report Required; Regulation No. 11-203

   On September 21, 2000, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Insurance Department (Department). This rulemaking amends 31 Pa. Code Chapter 147. The proposed regulation was published in the September 30, 2000 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on February 22, 2001.

   The Department made minor amendments to Chapter 147 to reflect the revised National Association of Insurance Commissioners' Manual for annual audits of financial statements filed by insurers.

   We have determined this regulation is consistent with the statutory authority of the Insurance Department (71 P. S. §§ 66, 186, 411 and 412) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Department of Transportation; Administrative Practice and Procedure; Outdoor Advertising; Regulation No. 18-349

   On October 6, 1999, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Department of Transportation (Department). This rulemaking amends 67 Pa. Code Chapters 445 and 491. The proposed regulation was published in the October 23, 1999 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on November 8, 2000. At its December 14, 2000 public meeting, the Commission voted to disapprove the final-form regulation. On January 30, 2001, the Department notified the Commission of its intent to revise and resubmit the regulation. On March 2, 2001, the revised final-form regulation was submitted to the Commission.

   The final-form regulation revises the current administrative procedural rules applicable to Department hearings, enumerates the specific requirements for hearing requests and facilitates the administrative review of Department procedures. The Department made several changes that further streamlined and clarified administrative procedures.

   We have determined this regulation is consistent with the statutory authority of the Department of Transportation (2 Pa.C.S. §§ 501--508 and 701--704) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is now in the public interest.
