Part II Permits

   The following permit applications or requests for plan approval have been received by the Department of Environmental Protection (Department).

   Persons wishing to comment on any of the applications are invited to submit a statement to the office noted above the application within 15 days from the date of this public notice. Comments received within this 15-day comment period will be considered in making the final decision regarding the application. The comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

   The Department reserves the right to hold a public hearing if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation of the area. If no hearing is held, the Department's Water Management Program Manager will make a final determination regarding the applications after a complete review. Notice of this final determination will be published in the Pennsylvania Bulletin, at which time this determination may be appealed to the Environmental Hearing Board.

   A copy of the permit application or proposed plan is on file in the office indicated and is open to public inspection. Appointments to review the application may be made by contacting Records Management at the indicated telephone number.

NPDES Stormwater Individual Permit

   The following parties have applied for an NPDES permit to discharge stormwater associated with a construction activity into waters of this Commonwealth. Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain limitations set forth in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices (BMPs) which restrict the rate and quantity of sediment discharged.

   Where indicated, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.24(d).

   Persons wishing to comment on the proposed permit are invited to submit a statement to the appropriate Department Regional Office noted above the application within 30 days from the date of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and relevant facts upon which it is based. A public hearing may be held after consideration of comments received by the appropriate Department Regional Office during the 30-day public comment period.

   Following the 30-day comment period, the appropriate Regional Office Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

   The application and related documents, including the erosion and sediment control plan for the earth disturbance activity, are on file and may be inspected at the office identified in this notice.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 1


Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard or who intend to remediate a site as a special industrial area, must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

   Under Sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period the municipality may request that the person identified, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

   For further information concerning the content of a Notice of Intent to Remediate, contact the Environmental Cleanup Program Manager in the Department Regional Office under which the notice appears. If information concerning this acknowledgment is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed.    Former Sears Logistics Services, Inc., Terminal Freight Facility, City of Philadelphia, Philadelphia County. Thomas E. Farrell, Resource Control Corp., P. O.    Green Garden, Inc., Somerset Township, Somerset County. Englert, on behalf of Fourway Properties, L.P., 1198 Mulberry Street, Bridgewater, PA 15009, has submitted a Notice of Intent to Remediate soil contaminated with solvents. The applicant proposes to remediate the site to meet the Statewide Health Standard. A summary of the Notice of Intent to Remediate was reported to have been published in the Allegheny County Times on March 30, 2001.

   Tuscarora Incorporated, Vanport Township, Brighton Township and Industry Borough, Beaver County. Victoria Brind'Amour, on behalf of Tuscarora Incorporated, P. O. Box 448, New Brighton, PA 15066, has submitted a Notice of Intent to Remediate soil contaminated with lead and heavy metals. The applicant proposes to remediate the site to meet the Background Standard. A summary of the Notice of Intent to Remediate was reported to have been published in the Beaver County Times on March 8, 2001.

Notice of Plan Approval and Operating Permit Applications

New Sources and Modifications

   The Department of Environmental Protection (DEP) has developed an "integrated" plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for DEP, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

   Notice is hereby given that DEP has received applications for plan approvals and/or operating permits from the following facilities.

   Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the Regional Office identified in this notice. Persons interested in reviewing the application files should contact the appropriate Regional Office to schedule an appointment.

   Persons wishing to receive a copy of the proposed Plan Approval or Operating Permit must indicate their interest to the DEP Regional Office within 30 days of the date of this notice, and must file protests or comments on a Proposed Plan Approval or Operating Permit within 30 days of the DEP providing a copy of the proposed document to that person or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that a hearing be held concerning the proposed plan approval and operating permit. Any comments or protests filed with DEP Regional Offices must include a concise statement of the objections to the issuance of the plan approval or operating permit and relevant facts, which serve as the basis for the objections. If DEP schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior the date of the hearing.

These facilities are major facilities subject to the operating permit requirements under Title V of the Federal Clean Air Act and 25 Pa. Code Chapter 127, Subchapters F (relating to operating permit requirements; and Title V Operating Permits).

   Appointments to review copies of the Title V application, proposed permit and other relevant information must be made by contacting Records Management using the appropriate Regional Office telephone number noted. For additional information, contact the appropriate Regional Office noted.

   Interested persons may submit written comments, suggestions or objections concerning the proposed Title V permit to the Regional Office within 30 days of publication of this notice. Written comments submitted to the Department during the 30-day public comment period shall include the name, address and telephone number of the persons submitting the comments, along with the reference number of the proposed permit. The commentator should also include a concise statement of any objections to the permit issuance and the relevant facts upon which the objections are based.

   35-00010: MACTAC, Inc. (4560 Darrow Road, Stow, OH 44224) in Moosic Borough, Lackawanna County. MACTAC, Inc. contains processes used in the manufacture of coated paper. As a result of emissions of Volatile Organic Compounds (VOCs), MACTAC is considered a major stationary source subject to the Title V Operating Permit requirements adopted in 25 Pa. Code 127, Subchapter G. The proposed revision of the Title V Operating Permit will incorporate applicable air quality requirements from the New Source Performance Standards (NSPS) for sources at the facility, and include the Department's revised VOC air quality regulations. In addition, Plan Approval No. 35-318-081 will be incorporated into the Title V operating permit through an administrative amendment along with this revision. Plan Approval No. 35-318-081 is for installation and operation of a hot melt coater (509), curing ovens and an 8 MMBTU hot oil boiler. The plan approval limits VOC emissions from the new hot melt coater to 39.9 tons per year on a 12-month rolling sum. The operating permit will contain additional record keeping and operating restrictions designed to keep the source operating within all applicable air quality requirements.

   06-05064: Atlantic Refining and Marketing Corp. (1801 Market Street, Philadelphia, PA 19103) for a revision to their Title V Operating Permit as per 25 Pa. Code § 127.542 for their Montello Terminal in Spring Township, Berks County. The original Title V Operating Permit was issued on January 12, 1998. On March 28, 2000, the United States EPA made the determination that some of the facility sources were subject to the Gasoline Distribution MACT (that is, 40 CFR 63, Subpart R). Subsequent to the issuance of the original Title V Operating Permit, the permittee had obtained separate approvals on January 11, 2000, to add a new storage tank (that is, Storage Tank #13) under the conditions in GP2-06-05064 and on December 14, 2000, to add a new vapor control unit (VCU) under the conditions in Plan Approval 06-05064A. The applicable requirements relating to the addition of Storage Tank #13 and the new VCU will also be included in the final revised Title V Operating Permit.

   36-03125: Susquehanna Valley Organics Corp. (3705 Trindle Road, Camp Hill, PA 17011-4334) for construction of a sludge (biosolids) heat drying facility in Lancaster Township, Lancaster County that will accept dewatered municipal wastewater solids and convert it into palletized granules for use as a commercial fertilizer. The facility will consist of biosolids handling, biosolids drying, product storage and handling and air emission controls. The air emission control system consists of a condensing scrubbing unit and a coriolis scrubber unit. This project is subject to 40 CFR Part 61, Subpart E--National Emission Standard for Mercury.

   36-05117: Dart Container Corp. of PA (60 East Main Street, Leola, PA 17540) for construction of an expandable polystyrene cup manufacturing operation at the Pitney Road site in East Lampeter Township, Lancaster County. The cup manufacturing operation will be subject to Major New Source Review requiring the purchase of Emission Reduction Credits (ERCs) and controlliing emissions using the Lowest Achievable Emission Rate (LAER). The facility's two 800 horsepower boilers will be subject to 40 CFR Part 60, Subpart Dc--Standards of Performance for Small Industrial-Commercial-Institutional Steam Generating Units.

   34-303-002B: Jay Fulkroad and Sons, Inc. Notice of Intent to Issue a Plan Approval and Amend a Title V Operating Permit

   37-264E: Ellwood Quality Steels Co.--New Castle Facility (EQS) (700 Moravia Street, New Castle, PA 16101) to increase production levels from 279,000 ton per year (tpy) of steel to 413,000 tpy of steel. EQS is a steel ingot manufacturing facility. This operation consists of an electric arc furnace (EAF), two ladle refining furnaces, a vacuum degasser, two ingot teeming aisles, an internal scrap yard, six natural gas fired annealing furnaces, miscellaneous steel cutting/grinding and four process steam boilers. The Department issued a plan approval for construction of the second ladle furnace on September 25, 1998. The plan approval required stack testing for the ladle furnace, as well as the EAF. The stack tests were conducted in 1999 and indicated that a Prevention of Significant Deterioration (PSD) approval would be necessary for the company to increase production levels beyond 325,000 tpy of steel. This application is subject to PSD regulations (40 CFR 52.21). This plan approval will, in accordance with 25 Pa. Code § 127.450, be incorporated into their Title V Operating Permit through an administrative amendment at a later date

   Sources subject to PSD regulations must meet certain conditions prior to the issuance of a pre-construction/modification approval. These conditions are briefly described. For exact text, refer to the regulations.

   1.  The best available control technology must be utilized to limit the emissions of all pollutants regulated under the act, which are emitted in "significant" amounts. This determination is made on a case-by-case basis taking into account energy, environmental, and economic impacts and other costs.

   2.  A source impact analysis must be performed to demonstrate that the proposed emissions would not cause or contribute to air pollution in violation of any National Ambient Air Quality Standard or any maximum allowable increase over baseline concentrations.

   3.  An analysis of the impairment to visibility, soils and vegetation that would occur as a result of the source operation and associated growth in commercial, residential and industrial activity must be performed.

   Information submitted by EQS indicates that the emissions from the source shall comply with all applicable requirements of PSD regulations and any applicable requirements contained in the State Implementation Plan (SIP) as approved for Pennsylvania by the Environmental Protection Agency.

   The permit would be subject to the following conditions.

   1.  The production and operations of the above sources shall be modified in accordance with the plan submitted with the application (as approved herein).

   2.  The ladle furnaces shall both be controlled by the baghouse manufactured by Wheelabrator-Frye (Model Number 168) during all times that the sources are operated.

   3.  The sources are subject to 25 Pa. Code §§ 123.1, 123.31 and 123.41 for fugitive, odor and visible emissions, respectively.

   4.  The production of steel ingots from the facility shall not exceed 413,000 ton of steel ingots per year (based on a 12 month rolling total).

   5.  The operating hours for the facility shall not exceed 8,760 hours per year. This condition removes the prior plan approval condition that limited the facility to 8,160 hours per year (based on a 12-month rolling total and the operation of the EAF).

   6.  The total natural gas consumption from the number 15, 16, 18 and 19 furnace (equipped with low NOx burners) shall not exceed 769,137 MCF of natural gas per year (based on a 12-month rolling total). The NOx emissions from the number 15 furnace shall not exceed 65 lb/MMCF. The NOx emissions from the number 16, number 18 and number 19 furnaces shall not exceed 65 lb/MMCF (for each unit, respectively).

   7.  The total natural gas consumption from the number 17 and 20 furnaces shall not exceed 212,195 MCF of natural gas per year (based on a 12 month rolling total).

   8.  The total natural gas consumption from the scrap torch, gas cutter, and the miscellaneous heaters shall not exceed 221,269 MCF of natural gas per year (based on a 12 month rolling total).

   9.  The natural gas consumption from the boiler shall not exceed 203,570 MCF of natural gas per year (based on a 12 month rolling total).

   10.  The natural gas consumption from the two ladle preheaters shall not exceed 119,637 MCF of natural gas per year (based on a 12 month rolling total).

   11.  The natural gas consumption from the EAF preheat shall not exceed 38,451 MCF of natural gas per year (based on a 12 month rolling total).

   12.  The emissions from the EAF shall not exceed the following (the TPY limit shall be based on a 12 month rolling total)

   13.  Within 60 days of achieving production levels in excess of 350,000 TPY and 400,000 TPY, respectively (based on 12 month rolling total), a test procedure and a sketch with dimensions indicating the location of sampling ports and other data to ensure the collection of representative samples shall be submitted to the Department.

   14.  Within 120 days of achieving production levels in excess of 350,000 TPY and 400,000 TPY, respectively (based on 12 month rolling total), stack tests shall be performed in accordance with the provisions of Chapter 139 to show compliance with the CO and PM-10 emissions for the EAF in condition number 12 for the EAF. The stack tests shall be performed while the aforementioned sources are operating at the maximum rated capacity as stated on the application (based on 413,000 TPY). During the stack test for PM-10, the sampling time and volume for each run shall be at least 4 hours and 160 dscf. The CO testing for the EAF shall be conducted in the duct prior to the positive pressure baghouse.

   15.  At least 2 weeks prior to the test, the Department shall be informed of the date and time of the test.

   16.  Within 45 days after completion of the test, two copies of the complete test report, including all operating conditions, shall be submitted to the Department for approval.

   17.  The PM-10 emissions from the baghouse that controls the two ladle furnaces shall not exceed 4.13 TPY (based on a 12 month rolling total), and shall not exceed 0.02 lb/ton of steel.

   18.  A magnehelic gauge shall be permanently installed and maintained at a conveniently readable location to indicate the pressure drop across each of the baghouses.

   19.  Twenty percent of the total number of bags in each of the baghouses is required to be on hand.

   20.  The ladle furnaces and the baghouse for those furnaces shall be maintained and operated in accordance with the manufactures specifications and in accordance with good air pollution control practices. The owner and operator of the facility shall perform weekly preventative maintenance inspections of the fabric filters and check the pressure drop across each of the fabric filters.

   21.  The owner and operator of the facility shall maintain a rolling total of the CO, NOx, SOx, VOC and PM-10 emissions from the EAF. The rolling total shall be determined by adding the amount of emissions from the most recent calendar month to the previous 11 calendar months.

   22.  The owner and operator of the facility shall maintain a rolling total of the natural gas consumption and facility production by adding the monthly totals to the 11 previous months.

   23.  The owner and operator of the facility shall install and maintain fuel meters to indicate the natural gas consumption of the furnaces (No. 15--20), the boiler, the two ladle preheaters, the EAF preheater, the scrap torch, the gas cutter and the miscellaneous heaters.

   24.  Issuance of an operating permit is contingent upon satisfactory compliance with condition numbers 1--23, upon the source being constructed and operated as stated on the application, and upon the satisfactory demonstration that the emissions from the source will not be in violation of applicable rules and regulations of the Department.

   25.  Any information required to be submitted as part of the previous conditions should be submitted to Devendra Verma, Engineering Services Chief, Air Quality, 230 Chestnut St., Meadville, PA 16335.

   The Department has determined that the application reflects the use of best available control technology, as required by the PSD regulations.

   The facility will trigger PSD for CO pollutants only. The EPA model ISCST3 was used to estimate maximum concentrations on all of the terrain in the vicinity of the EQS facility. Meteorological surface data collected at a COPAMS site approximately 1/2 mile north of the EQS facility was used in the modeling. Supplemental surface and upper air meteorological data from the Pittsburgh International Airport during the period 1987--1991 was also used to complete the data set for the modeling application. A PSD increment analysis is not required because increment concentration threshold values do not exist for CO. The CO 1-hour maximum concentration was 4,021 ug/m3 combined with the background concentration of 8,239 ug/m3, the total ground level impact was 12,260 ug/m3, which is less than the NAAAQS of 40,000 ug/m3. The CO 8-hour maximum concentration was 2,175 ug/m3 combined with the background concentration of 2,747 ug/m3, the total ground level impact was 4,922 ug/m3, which is less than the NAAQS of 10,000 ug/m3. An additional impacts analysis was performed to assess the impact of EQS proposed production increase on growth, and soils and vegetation. A visibility analysis was not performed because CO is not considered a visibility-related pollutant by the current visibility models. Both the growth, and the soils and vegetation analyses indicate the impact from the EQS facility are below criteria levels and is not expected to cause an adverse impact. Also, because EQS is more than 240 km away from a Class I area (Dolly Sods and Otter Creek Wilderness Areas in WV), and since Class I Area PSD Screening Levels do not exist for CO, a Class I Area analysis was not required.
