MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to the applications will also address the applicable permitting requirements of the following statutes:  the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated before each application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.

   Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment and informal conferences).

   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the previous, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining that may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the previously-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications and requests for Environmental Assessment approval and requests for Water Quality Certification have been received by the Department of Environmental Protection. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA 33 (U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Initial requests for 401 Water Quality Certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between the hours of 8 a.m. and 4 p.m. on each working day at the office noted before the application.

(Carbondale, PA, Quadrangle N:  18.2 inches; W:  4.6 inches).

   To remove the existing 48 inch diameter by 30 foot long CMP culvert and to construct and maintain a 48 inch diameter by 30 foot long CMP culvert with headwalls in Bennett Creek on Stevensville Mountain Road off Route 706 about 3,000 feet south-southeast of Stevensville (Leraysville, PA Quadrangle N:  0.3 inch; S:  6.9 inches) in Stevens Township, Bradford County.

   The project will not impact wetlands while impacting approximately 50 feet of waterway. Bennett Run is a warm water fisheries stream.

   E17-359.  Forest Drive Stream Enclosure Association, Inc., 427 Forest Drive, Clearfield, PA 16830. Modifications-Forest Drive Stream Enclosure, in Lawrence Township, Clearfield County, ACOE Baltimore District (Clearfield, PA Quadrangle N:  5.2 inches; W:  11.8 inches).

   To modify, operate and maintain as existing 36-inch diameter plastic pipe enclosing an unnamed tributary to the West Branch, Susquehanna River for the improvement of private property. The 36-inch diameter corrugated plastic pipe enclosing the stream shall be modified and maintained to a maximum length of 400-feet. The enclosure shall be perpetually operated free of all debris or obstructions at the inlet, outlet and throughout its total length. The modifications shall also include the construction of an overflow channel and a Type VI energy dissipater that shall be perpetually operated and maintained in accordance with the plans drawing and specifications that were reviewed and approved for this permit. The project will not impact wetlands while impacting 450-feet of waterway. The project is located along the southern right-of-way of Martin Street approximately 3,500-feet from Turnpike Avenue and Martin Street intersection.

   E17-360.  Clearfield County Commissioners, 230 East Market Street, Clearfield, PA 16830. T-315 Bridge Replacement, in Burnside Township, Clearfield County, ACOE Baltimore District (Burnside, PA Quadrangle N:  7.9 inches; W:  3.2 inches).

   To remove an existing structure and to construct, operate and maintain a two span prestressed concrete box beam bridge to carry T-315 across the West Branch, Susquehanna River (Warm Water Fishery). The two span bridge shall be constructed with a minimum total span of 170-feet, underclearance of 13.1-feet and skew of 77-degrees. The constructed bridge will impact 0.6-acre of wetlands while impacting 115-feet of waterway. The project is located along the western right-of-way of SR 0219 approximately 200-feet west of T-315 and SR 0219 intersection. The permanently impacted wetlands authorized by the permit shall be mitigated by the through 0.6-acre of replacement wetlands that shall be constructed prior to or concurrent with the bridge construction authorized by this permit. This permit also authorizes construction, operation, maintenance and removal of temporary road crossing, stream diversions and cofferdams; upon completion of bridge construction all temporary structures shall be removed with all disturbed areas being restored to original contours and elevations.

   E41-487.  Randall and Barbra Stiger, 530 South Main Street, Muncy, PA 17756. Residential Bridge, in Penn Township, Lycoming County, ACOE Baltimore District (Picture Rocks, PA Quadrangle N:  .01 inch; W:  5.9 inches).

   The application proposes to construct, operate and maintain a single span residential bridge structure with a 4-foot under clearance and a span of 28-feet on Sugar Run Creek. This structure also proposes two 18-inch relief culverts in the floodway. This structure does not impact any wetlands and will impact 50 linear foot of stream.

   E53-363.  Coudersport Borough, 201 South West Street, Coudersport, PA 16915. 36" Stormwater Outfall, in Coudersport Borough, Bradford County, ACOE Pittsburgh District (Coudersport, PA Quadrangle N:  3.8 inches; W:  3.4 inches).

   To construct and maintain a 36-inch diameter stormwater outfall pipe to the Allegheny River approximately 140-feet west of the intersection of Cherry and Bank Streets. The project will not impact wetlands while impacting approximately 5-feet of waterway. The Allegheny River is a Cold Water fisheries stream.

   Southwest Region:  Water Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E03-401.  Pennsylvania Department of Transportation, Engineering District 10-0, P. O. Box 429, Indiana, PA 15701-0429. East Franklin Township, Armstrong County, ACOE Pittsburgh District.

   To remove the existing structure, to construct and maintain a single span bridge having a normal span of 108.5 feet and an underclearance of 18.2 feet across Limestone Run (WWF) on a new alignment located approximately 600 feet downstream from the existing structure and to place and maintain fill in 0.54 acre of PEM/PFO wetland for the purpose of improving highway safety. To compensate for wetland impacts, the applicant will construct 0.76 acre of replacement wetlands on site. The project is located on S.R. 4023, Section 150, Station 205+75. (Kittanning, PA Quadrangle N:  19.56 inches; W:  1.89 inches).

   E56-308.  Gilmour Properties, 104 North Center Avenue, Somerset, PA 15501. Somerset Borough, Somerset County, ACOE Pittsburgh District.

   To place and maintain fill in 1.32 acres of wetland, within the watershed of an unnamed tributary to the East Branch Coxes Creek (WWF) for a proposed commercial development (Somerset, PA Quadrangle N:  3.22 inches; W:  11.32 inches).

   Northwest Region:  Water Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

   E20-515,  Commonwealth of Pennsylvania, Department of Transportation, Engineering District-01. I-79 Northbound and Southbound Bridges over tributary to French Creek in Union, Crawford County, ACOE Pittsburgh District (Geneva, PA Quadrangle N:  16.7 inches; W:  6.3 inches).

   To remove the existing bridges and to construct and maintain pre-stressed concrete I-beam bridges across a tributary to French Creek on I-79 approximately 3 miles north of S.R. 285. The northbound structure has 2 bearing-to-bearing spans of 47.24 meters (155 feet) and a minimum under clearance is approximately 14.63 meters (48 feet). The southbound structure has two bearing-to-bearing spans of 44.96 meters (147.5 feet) and a minimum under clearance of 14.63 meters (48 feet).

Site-Specific Installation Permits

   The following Storage Tank Site-Specific Installation Permit application has been received by the Department of Environmental Protection (Department) and is currently under review. Persons wishing to comment on the proposed permit are invited to submit a statement to the Bureau of Land Recycling and Waste Management, Division of Storage Tanks, P. O. Box 8763, Harrisburg, PA 17105-8763, within 30 days from the date of this publication. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application.    The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications and requests for plan approval. The actions are listed in two categories. Section I lists all municipal and industrial permits and Section II lists oil and gas related permits.
