Rescission Order

By the Commission:

   On May 23, 2002, Law Bureau Prosecutory Staff filed a Formal Complaint against WorldxChange Corp. (the Respondent), an IXC reseller certificated at A-310972, for failure to file its 2000 Annual Report. Subsequently, on October 29, 2002, the Commission entered a Default Order that sustained the complaint and cancelled Respondent's certificate of public convenience. Notice of the Default Order was published November 9, 2002, at 32 Pa.B. 5596.

   Subsequent to the issuance of the Default Order, on December 6, 2002, respondent filed an emergency petition for stay and rescission, and to the extent necessary, reinstatement of certification. Respondent attached to its petition its 2000 and 2001 Assessment Reports and its 2001 Annual Report. Further investigation by Commission staff revealed that Respondent had in fact filed its 2000 Annual Report on March 20, 2002; however, because its name is similar to another carrier, and because both carriers have a San Diego address, WorldxChange Corporation's 2000 Annual Report was posted to the wrong carrier. Since Respondent's certificate was cancelled due to an administrative error, we hereby rescind the October 29, 2002, Default Order and reinstate Respondent's certificate.

   In its petition, Respondent also informed the Commission that its primary address has changed to 9775 Business Park Avenue, San Diego, CA 92131. Commission records must be changed to reflect Respondent's new address. Commission records show that no other complaints have been filed against Respondent; Therefore,

It is Ordered That:

   1.  The Default Order entered October 29, 2002, at this docket is hereby rescinded.

   2.  The certificate of public convenience held by WorldxChange Corp. at Doc. No. A-310972 is hereby reinstated.

   3.  A copy of this order be published in the Pennsylvania Bulletin.

   4.  The Secretary change the Commission's official records to reflect Respondent's current address at 9775 Business Park Avenue, San Diego, CA 92131.
