Administrative Docket Filing Fee Schedule

   The Department of Transportation (Department), acting through its Office of Chief Counsel under 67 Pa. Code § 491.5(a)(1) (relating to filing fee), establishes the schedule of fees for administrative filings until the next list is published.

   The administrative docket filing fee schedule prescribes the filing fee not otherwise provided for by statute or regulation for administrative filings and requests for a hearing regarding Department actions under 2 Pa.C.S. §§ 501--508 and §§ 701--704 (relating to the Administrative Agency Law).

   The Department has reviewed its existing filing fee schedule and has determined that amendment of the fee schedule is needed at this time.

Administrative Docket Filing Fee Schedule

1.  Basic filing fee--$100

   Includes requests for hearing regarding the following matters:

   (a)  Cancellation, denial or recall of occupational limited license privilege.

   (b)  Cancellation, denial or recall of probationary license.

   (c)  Denial of a request for record review under 75 Pa.C.S. § 1516 (relating to department records).

   (d)  Denial of credit toward suspension of operating privilege or toward suspension of vehicle registration.

   (e)  Minimum use driveway permits (25 vehicles, or less per day).

   (f)  School bus/hazardous walking routes.

   (g)  Miscellaneous matters.

   Also includes filing of the following:

   (h)  Petitions to intervene in permit application review process.1

   (i)  Petitions to intervene in matters docketed for hearing.

   (j)  Formal and informal complaints.2

2.  Level II filing fee--$150

   Includes requests for hearing regarding the following matters:

   (a)  Low volume driveway permits (25 to 750 vehicles per day).

   (b)  Municipal reimbursement matters.

   (c)  Overweight or oversize truck hauling permits.

   (d)  Private airport permits.

   (e)  Motorist information sign matters.

3.  Level III filing fee--$250

   Includes requests for hearing regarding the following matters:

   (a)  Medium volume driveway permits (750 to 1,500 vehicles per day).

   (b)  Highway beautification/outdoor advertising matters.

   (c)  Utility highway occupancy permit matters.

4.  Level IV filing fee--$500

   Includes requests for hearing regarding the following matters:

   (a)  High volume driveway permits (1,500 vehicles per day).

   (b)  Public airport permits.
