NOTICES

NOx Budget Trading Program; NOx Allowance Allocations for 2008--2012

   In accordance with 25 Pa. Code § 145.41(b) (relating to timing requirements for NOx allowance allocations), the Department of Environmental Protection (Department) is publishing the NOx allowance allocations for the 2008 through 2012 control periods (May 1 through September 30). The NOx budget for electric generating units (EGUs) is 47,224 allowances, 95% of which are available for allocation to EGUs during each year from 2008 to 2012 for units subject to 25 Pa. Code § 145.4(a)(1) (relating to applicability). The NOx budget for nonelectric generating units (non-EGUs) is 3,619 allowances, 95% of which are available for allocation to non-EGUs during each year from 2008 to 2012 for units subject to 25 Pa. Code § 145.4(a)(2). This final allocation follows the notice published at 25 Pa.B. 599 (January 22, 2005) with a 15-day comment period. As a result of general comments,discussed later in this document, most prorated NOx allocations for qualifying units were adjusted upward.

   Action at the Federal or State level could affect these allocations. For example, the United States Environmental Protection Agency (EPA) could promulgate a new annual NOx Budget Program, leading to revisions of the Commonwealth's NOx Budget Program. Consequently, it is possible that NOx allowances allocated for 2008--2012 would be terminated, limited or otherwise affected. In 25 Pa. Code § 145.2 (relating to definitions), a ''NOx allowance'' is defined as: ''An authorization by the Department under the NOx Budget Trading Program to emit up to one ton of NOx during the control period of the specified year or of any year thereafter, except as provided under § 145.54(f) (relating to compliance). No provision of the NOx Budget Trading Program, any permit, or an exemption under § 145.4(b) or § 145.5 and no provision of law will be construed to limit the authority of the Department or the Administrator to terminate or limit the authorization, which does not constitute a property right. For purposes of all sections of this subchapter except §§ 145.41--145.43 and 145.88, NOx allowance also includes an authorization to emit up to one ton of NOx during the control period of the specified year or of any year thereafter by the Department or the Administrator.'' For the purposes of the NOx Budget program, the ''Administrator'' is defined as the Administrator of the EPA or the Administrator's authorized representative.

   In addition to the normal NOx allocations, one facility was allocated allowances in accordance with the provisions of 25 Pa. Code Chapter 145 (relating to interstate pollution transport reductions), regarding the retirement of budget units and the transfer of emission reduction credits (ERCs) to nonbudget units. Shenango (Oris Code 54532) has filed a request to transfer ERCs from its Boilers 9 and 10 to non-NOx budget units as of April 31, 2004. As per 25 Pa. Code § 145.90(c)(3) (relating to emission reduction credit provisions), allocations for NOx allowance control periods following 2002 to a NOx ERC source may not include allowances equivalent to that portion of the non-NOx budget units' NOx control period allowable emissions provided for by the NOx ERCs. In accordance with the requirements of 25 Pa. Code § 145.40(b) (relating to State Trading Program budget) and 25 Pa. Code 145.90(c), the ERC transfer will permanently retire 45 NOx allowances from the non-EGU budget. The difference between Shenango's 2008 to 2012 NOx adjusted allowance allocations and its ERC transfer is 13 allowances per year. Thus, Boiler 9 will be allocated 13 allowances during each of these control periods. Shenango will also be required to retire 45 allowances for each control period from 2004 to 2007.

   One facility was allocated allowances in accordance with the provisions of 25 Pa. Code Chapter 145, in accordance with its Twenty-Five Ton Exemption Status. The Naval Surface Warfare Center's (Oris Code 880009) Unit 99, exempted under the provisions of 25 Pa. Code § 145.4(b), the 25-ton exemption rule, is allocated at a heat input of zero in accordance with 25 Pa. Code § 145.42(a)(2)(ii) (relating to NOx allowance allocations).

   Table 1, pertaining to the 2008 through 2012 NOx Budget Allocations, lists the following: the units' average ''Heat Input,'' the ''Name'' of each facility, the ''Oris Code,'' ''Unit Number,'' ''Allocation'' and the ''Adjusted Allocation'' prorated to fit within the Commonwealth's NOx Budget. Slight differences in the adjusted allocation for the same allocation total are a result of heat input differences and rounding errors.

   Several comments were received indicating that the allocation of allowances to common stacks and multiple stacks should not occur. The Department agrees. Only ''units'' may get allocated NOx budget allowances under 25 Pa. Code Chapter 145. The Department made the required corrections for the final allowance allocations and adjusted all allowances for each unit accordingly.

   A few comments were made with regard to units that were part of the original OTC Budget Program in 25 Pa. Code Chapter 123 (relating to standards for containment) but were not subject to the 25 Pa. Code Chapter 145 NOx Budget Trading Program. The commentators stated that even though those units had heat input for 2002, they should not get allocations under 25 Pa. Code Chapter 145 requirements. The Department agrees; the Chapter 123 units that were not subject to the 25 Pa. Code Chapter 145 NOx Budget Trading Program were identified and removed from the 2008 to 2012 allocation process.

   Reliant Energy commented that three of its retired units had heat inputs for 2002 and 2003 and should be included in the allocation. The Department agrees and Units 12, 14 and 15 were added to the allocation. The units were allocated allowances based upon 2 years of heat input averaged over 3 years.

   The remaining comments dealt with typographical errors and minor corrections to heat input data. The Department made corrections as appropriate.

   Persons aggrieved by an action may appeal, under Section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service at (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

   For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.
